thats the problem with scooters... even when you are right you lose. Bikers need to realize this and accept the circumstances... kinda like voting for obama...when you win you lose.

With all that construction and the guy on the bike drinking a cup of Joe while he rode I would fight all the charges!!! This guy was innocent, only guilty of driving legally?? Charges are a crock & should be dismissed!

Bottom line,involuntary MANSLAUGHTER.Defensive driving is the rule,driving as though everyone is out to do you harm,knowing that coffee drinking,texting,phone talking,reading,even eating by anyone SUBSTANTIALLY increases risk MORE so for a biker as opposed to auto driver.QUESTION,why isn't the auto driver being charged with involuntary manslaughter!!

Why should the law be harsher just because the other person decided to ride a scooter? If the driver pulled out in front of a car he would get the summary offense. Just because the scooter driver took his life in his hands so he could be free and enjoy the open air is no reason to break out major punishment. He gambled by riding a bike and lost with his life, bottom line.

To answer "why".If you followed that line of reasoning about a biker then what about if the doctor killed a young driver or a child in a Honda Fit or a Chevy Aveo.They also had chosen their vehicles and what if it was YOUR CHILD should the punishment stay the same?
