Ohio couple: Pa. hospital harvested son's organs

By DAN NEPHIN, Associated Press Writer Wed Mar 4, 8:02 pm ET

PITTSBURGH The parents of an 18-year-old Ohio man who suffered a brain injury while snowboarding claim in a lawsuit that doctors at a northwestern Pennsylvania hospital intentionally killed him so they could harvest his organs.

The lawsuit claims that Hamot Medical Center doctors and a representative of the Center For Organ Recovery and Education caused Gregory Jacobs' death by administering medication and by removing his breathing tube, causing him to suffocate.
"But for the intentional trauma or asphyxiation of Gregory Jacobs, he would have lived, or, at the very least, his life would have been prolonged," the lawsuit said.

The suit was filed Wednesday in U.S. District Court in Pittsburgh by Jacobs' parents, Michael and Teresa Jacobs, of Bellevue, Ohio. It seeks more than $5 million for their son's pain and suffering, medical bills and funeral expenses, plus punitive damages.

Lucia Conti, a Hamot spokeswoman, said the hospital had not seen the lawsuit, but its policy is to not comment on litigation. The Center for Organ Recovery and Education, a Pittsburgh-based organization that helps hospitals procure donated tissue, also declined to comment.

Jacobs fell on March 8, 2007, while snowboarding at Peek 'n Peak Ski Resort in Findley Lake, N.Y., and was flown to the Erie hospital, the lawsuit said.
The suit claims Hamot contacted the Center for Organ Recovery and Education about the donation of Jacobs' organs even though his parents, who were at the hospital, wanted him to live. CORE directed that Jacobs' organs be removed in the absence of a valid consent, the suit said.

"Gregory was alive before defendants started surgery and suffocated him in order to harvest his organs" including his heart, liver and kidneys, according to the suit.

The suit said Jacobs "experienced neither a cessation of cardiac activity nor a cessation of brain activities when surgeons began the procedures for removing his vital organs."

The suit said the Center for Organ Recovery and Education benefited by obtaining Jacobs' organs "for transfer and sale to other individuals, who then paid money, a portion of which went to CORE, for the wrongful procurement of the organs."

Oh really Gail then why is the trauma doctor that was responsible for this patient no longer on staff at Hamot?

This is such a sad case, and if you read any previous information on it, the issue boils down to time of death. Hamot apparently listed the time of Greg's death a full half hour AFTER his organs had been harvested. Can you imagine what thoughts go through a parent's mind at that information? I feel bad for this kid's parents.

It is unfortunate that this family lost a son. However, the fact is that organs cannot be harvested from a dead body. There are very specific criteria required for an individual to qualify for organ donation. Any time there is impending death, and the patient/family is not opposed to organ donation, CORE is notified to initiate the process of deciding whether or not this patient is a donor candidate. This is normal procedure. Why would CORE or Hamot recover organs from a viable person only to take their life in order for another (or many others) to live???? They wouldn't. The focus ison life and wellness. No one profits from these activities except for the youg people whose lives are forever changed because someone graciously donated their organs. It is a sad, unfortunate tragedy and nothing more. Unfortunately, this unbelievable charge brought upon by extereme grief may deter others from organ doantion. That is the second tragedy in this story.

As I understand it the birth mother and father had split up, and remarried. One birth parent agreed to the harvest, the other and step parent did not, and some ambulance chasing lawyer must have convinced them they had a shot at some money. The law only requires the permission of one parent to make the decision.

I think you're out in left field. I don't know where you came up with all this stuff about birth parents and step-parents, etc. Are you sure you're on the right story???

This is my story. The same thing happened to my daughter in Fort Collins Colorado. She did not get prompt medical treatment from a neurosurgeon, she did not get advancement in treatment because she was a poor prognosis not because she was brain dead. This is happening all over the world. The brain injured victim is the number one supply chain for organs. The government requires the donor stores to maintain a quota, How can you put a quota on organs? This organ harvesting machine is greedy and is looking for ways to harvest all of our organs. I think we should all read the book and watch the movie coma. We are living in a Stephen King novel. Pray for the brain injured victicm whose organs are excised without anesthesia. This is why his heart will begin to beat faster as he anticipates the knife coming closer to slice him open. This why he will tightened his tummy. Tummy muscles are controlled by the brain. He will begin to move his limbs, I believe this is his adrenaline rush also a brain function. Please help the brain injured victim. Stand up for life.
