House needs landscaping. I have always heard be close to your neighbor, but, this is much too close. Can't get a vehicle between the houses. Fire hazard, too. What's wrong with this guy? Surely he must have seen this was way too close to the neighbor. This guy couldn't have ruined his own reputation more if he would have tried.
Did they move this house yet?

No. They left room for a monkey cage on the one side. That's why it's like that.

I don't see the house ever being moved. Probably what will happen is the homeowner will receive compensation due to the fact the house was built too close to the property line. Gordon Vice was the contractor that built the house too close to the line. I still can't figure out why the property was not surveyed prior to construction, and why the bank did not require a survey and a site plan before any construction loan proceeds were disbursed.

The house on the right is located at 1701 Wildcat Drive, Abbeville in Northill Subdivision Phase II near Abbeville High School. It is a spec house built by GOB Construction, Inc.(Gordon W. Vice). The home was purchased from Vice by Ten Ky with Sunrise Realty being the broker.
Ten Ky filed suit against GOB Construction, Inc., Stewart Title Company and Sunrise Realty, Docket #89939G alleging that the boundary between the property line and Mr. Ky's home is 3 feet 11 inches at the front of the home and 4 feet 6 inches at the rear of the home. Mr. Ky alleges that this is in violation of local zoning ordinances which specify a minimum of a 5 foot setback between the property line and the home.
As a result, Mr. Ky's home was apparently constructed in violation of setback requirements causing Mr. Ky to suffer damages, which include:
* Mental Anguish
* Loss of value of the Property
* Loss of merchantability of the Property
* Fees, expenses and costs associated with seeking a waiver from the appropriate zoning authority and the Subdivision Association
* Cost of relocating the home upon the Property so that it does not fall within 5 feet of the boundary
* Orther damages which will be established at the trial
You would think the process of buying a home would reveal things like this, sounds like a witch hunt....

No, it would actually be rare for a buyer to commission a survey in the process of buying a house. The builder warrants, and the buyer is relying on the builder's warranty, that the home complies with all local setback and subdivision regulations.

Since the house on the left (the one that is encroached on) was built AFTER the home purchased by Ten Ky, it was not visually obvious that the Ten Ky home was encroaching on the house next door.

Not a witch hunt at all if you're Ten Ky. Anyone know if there has been any resolution on this. I do know that a variance request was made to the City Council.

It was financed by Gulf Coast Bank and Jenny Milligan was the loan officer... that answer your questions?

Vice built the house that I bought. I'm building a fence and just figured out that I can't run the fence parallel to the house along my property line because the house is sited crooked on the lot... the house does not run parallel with the lot lines!

I'm going to have to build the fence crooked too to make it look like everything is aligned!

With the election ten months away, and serious competition looming on the horizon, a lot of favors will be granted. We have six elected positions coming up (excluding the police chief)
Three new faces will be seen, maybe as many as four.
And, almost everybody agrees the police chief is a gonner.

I'm like a ghost
I'll be living in a dirt room
Waiting for the day to be closer
To the window when you're home
I'll be standing by your back door
Reaching for the knife in my coat
I'm going to put it to your throat
Sweaty piggy, you're a bad man
What a fucking sad way to go
Your mother raised you as a joke
I should have wiped away a burden
Use the curtain in the kitchen to choke
You

You think you own me
You should have known me
You took the future and the food off my family's plate
You think you'll use me
I'm stronger than you
You take my money, but it's useless
When see what I do to you
Look what I do to you

Oh god then you awoke
You started screaming through the duct tape
Don't ever think I'm letting you go
I'm busy digging you a hole
Now you'll be living in a dirt room
Breathing through the straw of your own
Come on
I really think that this is fun for the money
I'll make it comfy for the time wasted making you rich
I want to cover you in ants, bees and honey
Then take a picture for the cover of our album!

You think you own me
You should have known me
You took the future and the food off my family's plate
You think you'll use me
I'm stronger than you
You take my money, but it's useless
When see what I do to you

Well, apparently your's is not the only house that Vice sited crooked on the lot. The lawsuit alleges...

"alleging that the boundary between the property line and Mr. Ky's home is 3 feet 11 inches at the front of the home and 4 feet 6 inches at the rear of the home..."

meaning that the sides of the house are not sited parallel to the lot line!

Yep, you're right Vice can't shoot straight! LMAO!

A hearing was held in this matter this morning.

GOB Construction failed to make a Court appearance. Apparently, a summary judgement was rendered against GOB.
