ROCKVILLE.-. The. father. of. a. man. killed. in. a. fatal. accident. has. filed. suit. against. the. driver. whose. vehicle. hit. the. man's. car. in. a. December. crash. at. the. intersection. of. routes. 195. and. 32. in. Mansfield.
Patrick.Smith,.39,.of.Spring. Hill. Road,.Storrs,.died.Dec..5.afte r. his. 1998.Saturn. SL1.was.struck. as.he. crossed. the. intersection. heading. west. on. Route. 32.
Smith's. father,. Robert. Smith,. of. Old. Springfield. Road,. Stafford. Springs,. filed. a. lawsuit. on. behalf. of. his. son's. estate. against. Wilfrid. Lebeau,. 63,. of. Beech. Mountain. Road,. Mansfield,. in. Rockville. Superior. Court. Jan.. 22.
Lebeau. hit. Patrick. Smith. in. his. 2005. Dodge. Dakota. pickup.. He. was. heading. north. on. Route. 195.
State. police. at. the. scene. of. the. accident. said. Lebeau. might. have. run. a. red. light..
Police. also. said. the. pickup. continued. moving. for. period. of. time. after. the. collision,. possibly. because. of. Lebeau's. medical. condition.
The. suit. alleges. Lebeau. was. traveling. unreasonably. fast. for. conditions,. speeding,. driving. recklessly. and. evaded. responsibility.
The. lawsuit.-. filed. by. Brian. Prucker. of. American. Legal. Services. in. Vernon.-. seeks. monetary. damages,. costs,. punitive. damages,. double. or. triple. damages. and. attorney. fees.
Prucker. said. Smith. is. survived. by. an. 11-year-old. son. and. his. parents.
He.said.that. in.a.wrongful. death. case,. Connecticut. takes. a. "coldblooded" . view. of. the. victim's. value,. which. is. determined. by. multiplying. their. remaining. life. expectancy. by. their. current. earnings.
According to Prucker, Patrick Smith has worked at Gerber Scientific for 20 years and, since Smith was still young, the monetary damages would be "fairly substantial. "
" In this case he didn't die instantly. When the defendant left the scene, he was still alive, according to the ambulance personnel," Prucker said.
He said the victim's suffering could add to the damages. "That would be a jury question," Prucker said.
Prucker said the family filed suit in part to gain access to information.
"There is no police report yet. There is no autopsy report yet because they're still investigatingthe criminal aspects of the case," he said. "We don't have a lot of answers that they may have."
Prucker said he has learned Lebeau's license was suspended by the state Department of Motor Vehicles, but he doesn't know why.
Robert Smith is suing Lebeau on two counts, his wife, Nancy Lebeau, who owned the car involved in the accident, and W.F. Lebeau Plumbing and Heating Inc. of Willimantic, because Lebeau was "operating the truck as the agent, servant or employee" of the company.
A fifth count is a common law recklessness complaint against Wilfrid Lebeau, Nancy Lebeau and Lebeau Plumbing and Heating.

So on top of destroying a life and rocking my families foundation I decided to relocate to Ct. to be here and assure there is justice for my brother. Mr. Lebeau, you will find I am a very stubborn person.

Ericka's killer only served 18 months!!! She served more time defending the country he calls home and he kills her and gets a slap on the wrist. I hope you find justice for your brother and peace for yourself. My prayers are with you and your family.
