BENTON -- Dramatic testimony from Amanda Tope's best friend came this morning as the trial of accused double murderer James Coulter continued in Franklin County court.

Coulter is charged with murder in the October 2006 deaths of Tope, Coulter's estranged wife, and her friend Jack Weston of Zeigler.




Tope was scared of Coulter, the friend testified, and had been granted an emergency order of protection in Williamson County just hours before her death on Oct. 12.

The friend termed Coulter's behavior in the weeks leading up to the murders as "obsessive" and "controlling." She said both she and Tope had received numerous text and voicemail messages from Coulter that threatened violence against himself or others.

I'm sorry but yes he is. He shot and killed two people at point blank range after kicking in the door. This wasn't crime of passion as he had numerous times to stop , even after killing the first one! He didn't stop did he, he hunted her down in the closet and fired! So yes he is a Cold Blooded Killer and actually deserves to die for it, to bad the IL. death penetly sucks!!

dont blame anyone for having an opinion but once again "under the influence you dont have control over yourself or actions" sorry but you or i have never obviously been that messed up nor we would we ever think of murder period but i will still uphold what drugs does to a person and thats my story i have witnessed just what cocaine, meth or even vicoden can do to someone. ask the law as they are scared of any and all who are under the influence of such. they are more powerful than u could imagine. there is no stopping them or reasoning with them. SAD BUT TRUE.

BENTON - In the weeks leading up to her death, Amanda Tope was bombarded with sometimes threatening, sometimes self-pitying voicemails and text messages from the man accused of her murder, Tope's best friend testified Friday during the trial of James Coulter.

Coulter, 46, is charged with two counts of murder in the October 2006 slayings of Tope and her friend, Jack Weston.




Franklin County State's Attorney Tom Dinn began presenting the prosecution's case before the jury Thursday, along with Morris, assistant state's attorney.

The bodies of Tope, Coulter's estranged wife, and Weston were discovered Friday the 13th at Weston's Zeigler residence. Both suffered single shotgun blasts to the chest.

Brandy Helleny-Connor of Herrin, Tope's friend since middle school, described the turmoil that marked the final days before her best friend's death.

"She was very fearful. There were constant phone calls, drive-bys, texts and voicemails," from Coulter, Helleny-Connor said. "He would leave messages ranging from anger to sadness to threats of suicide. He would also threaten her with 'If I can't have you, no one can.'"

When Tope started dating Weston, just a couple of weeks before the murders, the threats became more specific, Helleny-Connor said.

"He said, and I'm quoting,'I'll (expletive) kill any (expletive) that lays a hand on my wife.' We received messages from Jim that suggested he was keeping surveillance on my house, and we were fearful of having any unknown (to Coulter) vehicles there," Helleny-Connor testified. "On Oct. 10 or 11, he left a message saying,'I know Jack Weston, and he better not touch my wife. I'll (expletive) kill him.'"

She also testified to accompanying Tope to the Williamson County Courthouse so Tope could obtain an emergency order of protection, which was granted on the morning of Oct. 12, just hours before the two were killed.

Helleny-Connor told the jury about the day the bodies were discovered.

"I was calling her cell phone every 30 minutes starting at 7:30 in the morning. I never received an answer. I was scared ... highly concerned," she said.

Through a friend, she arranged for Weston's brother, Chekoda Frick, to check on the couple at Weston's Prairie Street residence, and she decided she would also go to the house.

She made it to the four-way stop in Zeigler, she said, when she got a call.

"It was Chekoda. He was hysterical and screaming,'My brother's dead. He's dead,'" she said.

When she finally reached Weston's house, "I saw Chekoda and the police and Amanda's truck, and I asked if Amanda was in there, too. I told police,'He did this. Jim did this.'"

Other testimony Friday was offered by Courtney Wilkas, who was a bartender at an establishment Coulter frequented in Herrin. Wilkas said Coulter told her repeatedly in the days before the murder he was going to "kill Amanda and Jack and then kill himself."

Also on Friday, state police Sgt. John Nagle testified he retrieved a Remington 870 20-gauge shotgun and shells from Gary Minton of Herrin, who is expected to testify next week.

In his opening statement, Dinn said he would present evidence that Coulter borrowed a shotgun from a friend that Dinn said was then used in the murders.

The gun was entered into evidence. Nagle also testified to traveling to New Mexico, where Coulter was picked up by police within 24 hours of the discovery of the bodies.

"He said he did not wish to discuss the case with me on advice of counsel," Nagle said. "He said he already had a copy of the charges and said,'That's not the real me.'"

Testimony resumes Monday at 9 a.m. Dinn told Judge Leo Desmond he expects to complete his presentation of evidence Tuesday.

THEN THEY HAD A FEW MORE INCIDENTS WHICH LEAD TO HIS CONTINUENCE OF ABUSE TO DRUGS AND ALCOHOL. THE HAD BEEN UNDER THE INFLUENCE OF COCAINE FOR WEEKS.. THE STATE HAS A FEW WITNESSES TO THAT FACT YET THOSE WITNESSES WONT TESTIFY THAT THEY PROVIDED AND DID IT ALONG WITH HIM.
COCAINE INTENSIFIES LIFE PERIOD. AND WHY WOULD A FRIEND GIVE SOMEONE UNDER THE INFLUENCE A GUY AND KNOW THE MAN DIDNT HUNT??

Coulter's daughter takes the stand in double-murder trial

BENTON -- The daughter of accused double-murderer James Coulter testified Monday morning that her father admitted killing his estranged wife Amanda Tope and her friend, Jack Weston.

"He said he did it and that he was sorry but he didn't want to go to prison for the rest of his life," Kara Coulter testified.

The 18-year-old mostly avoided looking at her father who faces life in prison for the Oct. 12, 2006 shotgun slayings of Tope and Weston. Jurors are hearing testimony for the third day in Franklin County court where Coulter is charged with two counts of murder.

State's Attorney Tom Dinn carefully questioned the tearful Coulter about the events of that night. She said she spoke to her father via cellphone around 9:30 p.m. and "I went to the house because something didn't sound right. Dad was there. He told me he was going to kill them."

She testified that she tried to "convince him, no, you can't do this, think of the kids," but her father left.

Later in the evening, she said she met up with him again and he admitted to the killings. She also said she witnessed him cleaning a shotgun.

"The only thing he asked was if I wanted to go with him to Alabama. I told him no, that I needed to stay here for school," Coulter testified.

Also testifying Monday was Gary Minton of Energy who said he loaned Coulter his shotgun that night.

"He said he wanted to use it for trap and skeet," Minton said.

The shotgun was returned by Coulter at about 1 a.m., Minton's daughter testified.

"He said he didn't need the gun anymore and was going to return it," she said.

I have to say something to "sister", if you speak with Kara, please tell her that I think she is the bravest, strongest young woman I have ever met. I couldn't attend the trial, but after hearing what happened in court, my heart goes out to her. Besides Jack, Kara and all the kids involved have been my main concern through all this. If there is only 1 positive thing I can say about Jim, I saw him raise a very bright, strong, and most importantly honest daughter. Kara- what ever happened know that this is no reflection on you. Just because our parents or loved ones make mistakes (however big they may be)doesn't mean that everyone thinks badly of you. I never have thought any differently of you and I never will. Remember, you did the right thing no matter what anyone will try to say. As I told you at the bowling alley several months back, I am still here for you if you need me. I am so sorry Kara that this all happened, but you are an inspiration, and you will be able to sleep soundly knowing that you did do the right thing regardless the outcome.
I just needed to get this message to someone to get it to Kara and let her know how proud I am of her. And before anyone says anything about this entry, yes I know she was given immunity, and she should have been given immunity, she's been through enough as we all have. Do not belittle the strength it took this young woman to do what she had to do, PLEASE, it will do no good for anyone.

Security tightened for Coulter murder trial

Dirnbeck asked Coulter if she gave police the same account as she just testified to when she was questioned in the days after the murders. She admitted she did not give law enforcement that accounting of events until last month.
Dirnbeck then asked her if she was offered immunity from prosecution for withholding information or obstructing justice. She said she was.
Dinn then questioned Coulter again.
"Did you voluntarily come to my office and voluntarily tell your story?" he asked, to which she responded, "Yes."
As his daughter was led weeping from the witness box, Coulter turned to face the gallery filled with victims' family members - many of whom were crying, too, after the emotional testimony.
When one family member asked how Coulter, 46, could put his own daughter through such an experience, Coulter said, "You wanted to hear the truth, right? You said you wanted the truth."
Courtroom security rushed to step between Coulter and the gallery while Dinn asked the judge to have the defense attorneys "tell their client to stop communicating with family and agitating them."

Dr. James Jacobi, a pathologist and forensic pathologist who conducted the autopsies of the victims, also testified Monday.He said both died as a result of single shotgun blasts to the chest. He said he believed Tope, 31, was shot from one to three feet away, while the gun was above her, or she was below the gun. Plastic wadding from the shotgun shell was recovered in Tope's body.
Weston, he said, was shot from a distance of about 10 feet. No wadding was recovered from Weston's body or his Zeigler house where the shootings took place.
Jacobi also said a "misreading" of the toxicology report previously indicated Weston's body contained a potentially toxic amount of Vicodin or hydrocodone. In fact, he said, the level was low and "well within therapeutic range."
Weston's mother, Debbie Frick, said her son, 31, suffered lingering pain from a broken neck incurred some years before, and took the drug as prescribed by a physician.
Weston's ex-wife Angela also testified Monday. She said she spoke with Coulter on the phone, and later at a Herrin bar, on the night of Oct. 12, 2006.

"I'm going to kill him, I'm going to kill him," she said Coulter told her that night, referring to Weston. Angela Weston's date that night, Peter Conrad, also testified to what he heard at the bar. "He (Coulter) was talking and I was just sitting there. He said he was going to kill 'him' because he was (expletive) the wrong guy's wife," Conrad said. "He kept making the same comments over and over. He was mad and he said he was going to make 'him' pay for it. I thought he was a drunk guy in a bar being stupid."
Scott Karcher, a friend of Coulter's, also testified. He said on the night on Oct. 12, he, Coulter and another friend, Billy Mason, decided to go to a Zeigler tavern/restaurant to eat. On the way, they drove past Weston's house and saw Tope's vehicle there.
"He slowed, but didn't stop. We convinced him not to stop," Karcher said. "He made a phone call to Jack. He said,'You know that's a married woman you've got in there. I just want to let you know.' He was upset. He said,'I could just kill them.'"
Karcher said after leaving the restaurant, Coulter stopped by the Zeigler house of his friend, Jason Walker.
Walker testified that Coulter had asked to borrow his shotgun and to go to Wal-Mart to buy "ammo."
Walker said he at first agreed, but later decided it was not a good idea to do as Coulter asked.
"I told him I couldn't help him out," Walker said.

Dirnbeck asked Coulter if she gave police the same account as she just testified to when she was questioned in the days after the murders. She admitted she did not give law enforcement that accounting of events until last month.

Dirnbeck then asked her if she was offered immunity from prosecution for withholding information or obstructing justice. She said she was.

Dinn then questioned Coulter again.

"Did you voluntarily come to my office and voluntarily tell your story?" he asked, to which she responded, "Yes."

As his daughter was led weeping from the witness box, Coulter turned to face the gallery filled with victims' family members - many of whom were crying, too, after the emotional testimony.

When one family member asked how Coulter, 46, could put his own daughter through such an experience, Coulter said, "You wanted to hear the truth, right? You said you wanted the truth."

Courtroom security rushed to step between Coulter and the gallery while Dinn asked the judge to have the defense attorneys "tell their client to stop communicating with family and agitating them."
