Um...they guy was still married. I can understand why E-harmony would not let him list, as many of their clientele are looking for honest lasting relationships. It won't be fair to the others for him to be listed until he was divorced. I can't believe you can sue over this. Apparently the rights of the one or the few out weight the rights of the many.

If forced to list married individual how long before they get use for that by a person who is singled and got burnt?

This is why I would never use an online dating service. Where I live, almost all of the married men are not happy and trying to cheat. It's 100 miles from any big city, a suburb of the surburbs of a city. Everyone is bored out of their minds and trying to cheat, so I already know how many married men would be online pretending to be single. Another thing is they can put a picture that's ancient in there, next you go meet them and they are 100 years old. I don't trust any of it. Most folks can't afford a divorce. Divorce lawyers charge what - 50K at least. Folks lose their homes and half of all of their assets, so most men try to use another woman, and they are hoping she has her own place to live and her own money, better never need one thing. No one goes with them, not from what I've seen. There's an old saying, "most men in the suburbs live out lives of quiet desperation."
Unless the divorce laws are changed, these married guys are stuck for life, from what I've seen. It's like "hey baby, I have no money, nothing to look at, have kids to support, a wife who owns half of my house and half of my money and my pension, I'm kind of fat from not having sex for the last ten years, I'm losing my hair, want to have wild sex with me for NOTHING so I can stand to stay married?" Yeah, that's high on my list of things to do.
I heard most of the men in Sacramento were gay...

If I were a guy, and all I had to look at was you, I'd put the Beemer into reverse, too.

Remember the last guy got mad because they were showing him profiles of people that had already 'found' someone? Wasn't EHarmony, but still, these services are humorous to me.
Are there really that many, lonely desperate people out there?(I couldn't get the link to work, but this guy wasn't even single yet, how desperate could he be?)
so pretty desperate is the answer....

eHarmony started out as a Christian dating site didn't it? And then it got sued by some gays or lesbians for eHarmony refusing to allow them to register?

Why is it that itty bitty minorities can't just do their own thing and leave everyone else also? Oh no, they have force their way into to groups that don't want them. Not exactly a way to win popularity.
