I posted this back in July in the thread "Unintended Consequences" and think it bears repeating based on some of the latest DOJ actions:

Well, I have another one. Have you all seen the new revised Americans with Disabilities Act? This went into effect on March 15th. Businesses must now allow miniature horses on their premises as guide animals for the disabled. So they have to modify their premises to accommodate little horses! Who pays for this???

This new act now limits the height of slopes on miniature golf holes. All spaces on the miniature golf course must be 48 in. by 60 in. and not steeper than 1:48 at the start of play. Saunas must now accommodate wheel chairs providing acceptable turning space and an accessible bench.
All Shooting ranges must now provide for wheel chairs and all shooting ranges must provide for EACH possible firing position for the handicapped. All golf courses must have an accessible route to connect all accesible elements including being able to get to golf car rental, be able to get on and off all tee boxes, putting greens and weather shelters! Who is going to pay for that???
All gyms must have at least one of each type of exercise machine so that it can be accessible and used by a person in a wheelchair.
And get this one. ALL AMUSEMENT PARKS -- any new and altered ride must provide AT LEAST one seat for a person in a wheelchair.

Have we gone f&^^ing crazy or what?????
Most amusement parks and miniature golf courses and real golf courses are in bad enough shape now. If they have to modify everything for wheel chairs and all handicapped possibilities, they will close. Look at the people that will be put out of work and look at the facilities lost for everyone else. I feel for people confined to wheelchairs. My mother spent 10 years in one, but she certainly wouldn't have ever gone on the Ferris Wheel or roller coaster in her wheelchair!!
Stay tuned for latest DOJ lawsuit under this new act!

The DOJ

(1) didn't have the manpower to keep track of guns they supposedly sold in the "fast & furious" debacle to trace illegal gun sales going across the border because they didn't "think" about putting in tracking devices;

(2) can't be bothered to discover or do anything about all the voter fraud even when hard core concrete evidence is provided; or

(3) can't do anything about all the illegal border crossings, BUT can find time to sue the states of Arizona and New Mexico for enforcing the federal immigration laws,

BUT, get this, CAN find time to find violations of the unbelieveably onerous and ridiculous new ADA law. They actually sued a library in Sacremento that was trying to encourage reading by starting a pilot program that allowed patrons to borrow NOOK ebook readers that were donated by Barnes & Noble. The DOJ sued the library because it discriminated against people who were BLIND!!! The fact that the library makes books on audio tapes available for the blind, didn't matter.

"The Justice Department said the settlement is aimed at stopping discrimination:“Emerging technologies like e-readers are changing the way we interact with the world around us and we need to ensure that people with disabilities are not excluded from the programs where these devices are used,”

"As part of the settlement agreement, the Justice Department directed the library system to purchase at least 18 e-readers that are accessible to the blind, something that comes in the midst of budget cuts that have forced Sacramento libraries to implement one employee furlough day each month for two years." The library system is also forbidden to purchase any additional e-readers that don't accommodate the blind.

This is your gubment at work. Here is the link:

There is no explanation for this madness, other than our country has gone insane.

PS: Fast and Furious had nothing to do with tracing illegal gun sales.
It was the excuse created AFTER Holder, the AG, was caught running a simple gun smuggling operation, selling guns to Mexicans drug lords to raise dirty money for dirty campaign tricks.

my take when it first broke was that it was about gun control. they did try to make it so for about a split second in conjunction with something else right at the same time but then their fast "facts" and timeline started unraveling.

Yes, it's gone insane.

Pro~This sentence here;
""(2) can't be bothered to discover or do anything about all the voter fraud even when hard core concrete evidence is provided; ""

is quite a hypocrisy, isn't it?
The DOJ is suing, left and right, states with voter ID laws.....yet you are required to SHOW ID when entering the DOJ.(Or the White House or the DNC convention...)
Insane.

I see plenty of motels with empty swimming pools, in my limited travels. I wonder if it's due to the new handicap accessibility laws.
Let's do more damage to struggling businesses.

Could the DOJ find anything better to do, than go after a library with E Books? Anything???

This stuff makes the F word flow from my fingertips. The delete button is my friend.

EB I think the real reason that the DOJ, note, the DOJ, the Department of Justice in Washington D.C. is going after little libraries. The libraries in this country are fighting to stay open even part time in most counties because all counties are struggling with the reduced tax digests. So libraries are trying to find ways to make reading material available to help our educationally (like that word?) deficient children improve their reading for the least cost, and what happens, the DEPARTMENT OF JUSTICE in Washington, D.C. sues them!! And sues them because blind people can't read the Nook or Kindle! Isn't that what they make headphones for???

Our government wants us stupid, get it? That's why we have gone from 3rd in the world in education to 17th and now we're at 27th, yet we spend more money on education than any country in the world. Sounds like a bad investment to me.

So, government wants us stupid, and now the latest ADA laws will force thousands of small businesses that have been hanging on by the skin of their teeth to close because they can't afford to comply with making golf course tee boxes handicap accessible and modifying all equipment in the local little gym (that Michelle O wants us to use so we don't get fat) so that one of each piece will accommodate a wheelchair and every ride at the amusement park will accommodate a wheelchair.

There is no one in Washington trying to reduce the debt, create jobs or anything else worthwhile. Every person seems to have been assigned the task of finding another way to destroy mom & pop businesses, but that's OK cause we let it happen. We elect these buffoons that sit in Congress and do nothing, DO NOTHING!!! We should be working on recalls and we should start with Chambliss and Isakson.

And yes, EB, it's hard not to type the F word.

Hmmmmm, I think the little people should start demanding the same attention. The world is not very accomodating to people of short stature. Just a thought.

The AD is also responsible for those dead beat parking spaces at all businesses also. When a 70 year old man and his wife pull into a handicap space in a brand new 2012 F-350 4WD truck that has plainly never been off of the pavement and he and his wife walk around the store for 1 to 2 hours "shopping" because that is just what they do to spend their time, it just proves how lazy some folks are. Yes, there are people that are truly handicapped, but when they exit a vehicle I should see at least a cane or an oxygen tank.
I used to be an instructor at a technical college and we were sued because we did not have handicapped equipped semi trucks for instructing folks in a wheel chair on how to drive a semi. Nothing ever came of it but just shows how when the lawyers get involved there is money to be had.

Someone just posted in another thread about the increased number of handicap spots. The new ADA regulations require a lot more per establishment plus more for H/C vans which are larger spaces and, get this, they are now required to provide more at golf courses, amusement parks, homeless facilities (seems if a person had a handicapped equiped van they could sleep in that) exercise facilities, fishing piers, boating facilities and miniature golf courses.

In 1967, 1,152,861 Americans were receiving disability checks.

Today, 2012, 8,786,049 Americans are receiving disability checks.

The numbers jump after those on unemployment run out of benefits. So from one to the other.

Also, I understand true disability. I understand and respect true disability. had to make this clear.

But since 1967, we are now aborting imperfect babies. That's what all those prenatal tests are for.
So we can subtract the imperfect babies flooding the earth.

And with the over abundance of safety rules in the workplace, and also in our private lives, i.e. seat belt laws, helmet laws, swing sets on playground laws, no big sugar drinks in NYC and so on and so forth, there isn't much to injure a person anymore.

So where are all these disabled folks coming from?

You're an amazing person, filled with arrogance. If you live alone, I understand. If you do not live alone, then you should be living alone.

A handicap spot is something I would not want to own, but if I ever have the need, it is there for me. You should think ( instead of laugh ) along those same lines, for we do not know what tomorrow will bring. If you can walk into a store under your own power, thank God for the opportunity.

can't remember which state but one of them is fighting back with law that obliterates drive-by lawsuits that plague certain parts of the country. this topic has divided the disability community itself. a lot of the lawsuits there, though, involve individuals like a particular lawyer out of florida going after mom-and-pops. certainly not all but much of the doj activity i've seen involves going after cities and BIG businesses (like national chains).

totally unrelated, topix server must not have had its coffee yet this morning. it jammed that obnoxious "quoted text" block in the middle of your comment instead of at the beginning this time. left it there for posterity.*grin*

Something must be done in this country, about all this lawsuiting going on.
I think America tops this vile act.

And it hurts the people who legitimately need a disability check.

I know someone who does not need one, she is just that way. She wants something for absolutely nothing. She's 37 and complains, "I've worked all my life. I can't work anymore."
And she's been playing the doctor game for almost 3 years! They send her off with work orders and she won't accept it. So she finds a new doc.

Her paperwork should be rejected or accepted any day now. She disgusts me, but she's 'somewhat' family, so I have to fake smile when I see the deadbeat.

I wonder if this is arrogant of me?

Okay, here you go...

Short people, they ain't tall,
Short people ain't always small.
It takes a big man for himself to declare,
That's out of reach; who put that up there???
Short people if they trip at all,
Won't be hurt cause it's not far to fall.
Don't invite short people to a dance;
And you'll never see one in a karate stance.
For all short people we should give a hand;
They even helped Dorothy back in Munchkin Land.
I don't mean to offend so don't be a sap;
But if you get mad don't punch my knee-cap.
Short people....
Short people....
Short people.....

The ADA was a grand idea that ended up being a joke like many other grand ideas.
Not only is it responsible of the parking crap mentioned above, but every business that has round door knobs is braking the law. That's right, you have to have push or hook handles.
There are so many rules that are just asinine in there.
It needs a rewrite for sure.
