I was told that the covents for CRR had expired and that they could not legaly collect dues.
Doesn't seem as if anyone is interested in persuing this. Might be worthwhile to check it out.

Probably because it's totally untrue. The covenants do not expire for another 17 years. Check back then.

How were they renewed? Did the residents vote on renewal then? Have to have a big majority to do this. Don't think they got it.

They were NOT renewed. They do not need to be renewed for 17 years. After 17 years there will have to be a vote with 100% of owners agreeing, which is impossible. CRR has requested legislative relief. Go to the web site and read some of the older newsletters for detailed explanation.

Covenants were put in place in mid 80's, but that has nothing to do with expiration. GA code states that if there is no renewal provision (which CRR doesn't have) than covenants will expire 20 YEARS AFTER COUNTY ADOPTS A LAND USE PLAN. I'm not sure of the exact date, but Gilmer County didn't adopt a land use plan until 2006 or 2007.

I just checked the Gilmer County Website and the land use plan was adopted in 2005. Therefore CRR covenants expire in 2025.

Try Habitat for Humanity. They would probably love to build a house there. The annual fee could be added into the house payment and only increase it $50 per month.

I have owned my home in Coosawattee since 2000 when the dues were around $300.00. I agree that they've gone up too much, especially enlight of the current economy but its still a deal. In metro Atlanta all that you get is a pool for $400.00. We have an olympic-sized saline pool that is heated so that we can use year-round! We have an abundance of amenities available and community events such as the 4th of July event for our money. They'll even come and put salt on the paved road in the winter and send security out to your house (faster than the police) if there is trouble. Perhaps a group of us should sign a petition asking for a reduction next year in dues because of the economy. I'm all for them having their reserve cash for the budget but we need ours too so that we can keep our homes. Tamara - Beaver Lake

OK, being the Chairman of the Board of Directors for ANOTHER local HOA, this is what I can tell you. Most things are based on the Bylaws, Covenants & Restrictions & Rules & Regulations. You should always thoroughly review all these 3 main documents before purchasing & even have your attorney explain anything you don't understand.

Usually, most communities can place a Lien against your property if you don't pay your share of dues & also deny your use of common areas, pools, etc & also your right to vote at meetings, community elections, etc are suspended, as well. They can also charge late fees, interest & the like.

OK, here's the biggy! You need to look at what you get for your money. You have areas on the river for picknicks, etc, indoor/outdoor pools, workout facility, gated, 24 hour security, maintenance crew, I could go on & on about the amenities that Coosawattee provides. If you think what you pay is expensive, you should take a look at what Walnut Mountain owners pay in dues! I'm not afiliated with them but from what I hear it's almost double what Coos owners pay & they don't even have 1/3 the amenaties you guys do. Also, the community Im afiliated with pays just a small amount less than Coos owners do annually & we don't have a gate, security, pool, club house, or nothing!!! I mean nothing but grounds maintenance & this is because it's such a small community & therefore it drives up the dues required to maintain the grounds having less than 2% of the number of owners that Coos does. What Im saying is, YOU ARE VERY FORTUNATE!!!

If you would like more down to earth explainations if HOA/POA's, there is a wonderful book called "Homeowner's Association Manual" 5th Edition by Peter & Marc Dunbar. It can be found at most major book stores & online. It's an excellent book to help understand how things work.

Covenants are filed w/ the County Court house & they never expire. Covenants are also not the major document that outlines the dues that owners pay...it would be the Bylaws that outline the dues the association can charge, how they can raise them, etc. However, the Bylaws never expire either & Bylaws usually are not filed with the Court House anylonger, the Bylaws is a document that outlines what the board, etc can, cannot, how, must & sometimes do & they are usually only onfile with the association office & with the owners that have them. REQUESTS A COPY OF YOUR HOA COVENANTS & RESTRICTIONS, BYLAWS, & RULES & REGULATIONS from your local HOA office. If you are a property owner you should have no problem getting these 3 documents & they will explain everything you should ever need to know. One thing to remember, there are no loop holes such as expiration of a document or anything that will cause you not to have to pay your dues if you are an owner. & not doing so will only cause you more problems & cost more money in the end than the basic dues will. I have no involvement with Coossawattee at all but hoping to provide some helpful info from my experience.

The major rule of thumb is if you don't like the way they do things, vote, do what the Bylwas state you can do if you disagree with something or the huge fix, if you disagree with the way things work in a community that is governed by an HOA, don't buy in that type of community or sell & get out if you already have. Becaue, what is going on at Coos sounds like the typical standard legal way things work in an HOA community as far as what I have heard thus far. Hope that helps!

YES! I own in another HOA in Gilmer County but not Coosawattee. But if anyone wants to give their lot away...I will pay you $1,000 for it & gladly pay $600 or less yearly just for access to the amenities & me not even actually living in the community!

If you consider how much it would cost to get n2 the County Swimming Pool & how much an annual Gym Membership would cost, that in itself would total more than your annual dues. Just the gate & 24 hour security is worth that much!!!

So, if anyone wants to unload their lot, post back & I will gladly give you $1,000 for it!!!

Thanks NGAGUY. I agree with you in regard to the postings of CRR and the fees being raised. I will soon be moving to Ellijay and was contemplating moving to CRR and began doubting my decision when I went to the website and saw all the fuss was about $599/yr ($50/month). It may have went up in the last few years, but is it not a better place to live? I had occasion to stay in one of the cabins recently and really enjoyed the area and really wish I would have had the time to enjoy ALL the amenities.Like you said, the security would be worth that alone!

Well Eager, Do you live in CRR? If so, what is so bad about it? Please give me some info so that I can make an informed decision as to why I should not move to CRR. The three pools, river access, fishing and tennis courts along with the gaurded entrance seemed very nice.

Security what security the barnie fifes. They can't do anything but you pay them. And Durgin insists on Toyota trucks for them to ride around in.
