Some drivers in Mary Kay flap pay up
No charges filed over allegations

CHARLESTON, W.Va.-- No charges have been filed against any of the Kanawha County school bus drivers who were fired or resigned last year amid allegations they collected tens of thousands of dollars in overtime pay while selling Mary Kay products.

But the county school system has recovered nearly a third of the money on its own.

Ten or so bus drivers and aides from the Elkview bus terminal drew about $70,000 dollars in overtime pay while selling cosmetics.

The school treasurer's office said it has collected $20,000 from the employees.

But more than 18 months have passed since the school system began its investigation, and none of the employees from the Elkview bus terminal has been prosecuted, said school system attorney Jim Withrow.

He said when school officials learned of the situation in spring 2007, they went to the Kanawha County Prosecutor's Office almost immediately because they didn't want to do anything that might cause problems for a criminal investigation.
