as far as ip masking which one are you talking about? you do know there are at least 3 ip's right?
the one on your eithernet card means nothing! what about the one in your router? or the one you service provider links to the channel your pc is on? if you think a proxy server hides you than i bet you still think a virus program will stop someone from looking at your pc! fyi any open port on your computer and your done, watched! do you know what piggy backing is? you know all someone has to do is get on a friends list or email you and boom their in your pc and no virus program can do anything about it! virus programs are a scam to make ignorant people feel their not getting hacked period! example you could be using skype and put someone on your friends call list and that person has a way through a port to your computer!

I forgot U have made no issue of a little word called Intent! that little word can take something legal and it magically becomes a crime without having any language in a law book stating its a crime, you people do know that right? its not all O's and one's it how you can make it look and show and prove to the court what that Intent is! and if they buy it you win! so it really matters in how you can articulate your position to the court, its why we dont have a computer program as the court stamping out yes or no, guilty or not guilty! It's all in how you can make your case and having video of the fools commiting slander and talking of following you around and investigators doing the same, im sorry but you will lose!

I challenged you to explain how Internet access could be traced back to me if I accessed the Internet through a public hotspot with a forged MAC number. The public IP would identify the location and owner and location of the modem. The router or gateway ID is local address space, as is the client's static or dynamically assigned IP. A MAC number is not an IP address. If you jump on a public hotspot and don't visit any sites that might suggest your identity or allow an incriminating cookie to be read, how could that access be traced back to the user? There is the challenge.
Likewise, I challenged you to come up with one example of a criminal libel or slander case based on the Federal law you misquoted.

Give us one bit of proof you know anything about networking. What do you mean when you say an open port allows a person to be watched? Do you think an open port automatically means there is a security deficiency? You really have no idea, do you? Certain open ports suggest the possibility of a problem but there are reasons that ports are open. Namely, they must be open to allow access.

As soon as you claimed that libel and slander were crimes, you showed your ignorance. Your jibberish about network security further showed everyone you like talking about things you know nothing about.

I just noticed your comment about intent. In both civil and criminal matters, intent is often a key element. In the case of criminal law, whether intent should be considered is always specifically noted in criminal statutes. You don't really seem to know the difference between torts and crimes. I could say anything I want about you on this forum other than a threat of violence or extortion without committing any crimes. I might open myself up for a civil libel suit, but that's not a crime. Get it, dumbazz?

Thanks, Fortruth. Bates stumbled into a minefield. I am an IT professional with a fair knowledge of network security. As a young man, I thought about law school and continue to have a keen interest in a handful of legal subjects, especially those associated with individual expression and free speech. The funny thing is, Bates doesn't have the skills to research the right answers. When I saw his "Federal libel and slander law", I knew there was no way I would have missed that. I had to take a look at what the heck he had copies and pasted.

Your excellent posts are very evident (at least to me) of your knowledge on the topics of defamation, and network security- which you explained brilliantly.
However- the "jaw dropping" psychotic rebuttals that Bates replied to your factual and educated posts- claiming himself to be the knowledgeable one- and you to be an ignorant mentally ill redneck...- blew me away, and I couldn't resist replying back.:-)

either way it is sad, that ppl, come on these sites and say stuff about someone and that person takes it so personally that they waste the courts time and taxpayers dollars, cuz we pay the judges, with this shit, oh sure, there may be one or two cases where someone is literally defamed and lose their job or their life is really ruined but for the most part, the accusations are baseless, they are rumor or hearsay, and sometimes they are true or have some basis of truth....
it hurts to be talked about and it hurts to be lied on and have your named dragged thru the mud, but in the end, going to court is probably going to be a waste of time

Most of these cases don't go to trial because the judge may evaluate the merits of the damage claim, pretrial. They actually ask the plaintiff, if you prove your case, what is the evidence for your damages? At this point, most judges refuse to go to trial. Hurt feelings don't carry much weight.

There have been millions of libelous posts on Topix. How many lawsuits have actually resulted? Very few.

Likewise, how many posts have described pending legal action against Topix? How many actual cases have been filed? Very few, if any.

A more interesting question is whether websites are responsible for user-generated content. Other than copyright issues, Section 230 of the Communications Decency Act has broadly protected website operators from actions resulting from third-party postings.

However, in In Fair Housing Council of San Fernando Valley v. Roommates.com , the court starting carving out exceptions. In this case, the design of the site almost guaranteed that fair housing laws would be violated by some posters (those offering housing). Certain drop-down menus contained potentially discriminatory selections.

I don't really think that this case really diminished Section 230. Instead, the court really just said that Roommates.com was in the housing and real estate business, as opposed to just providing a venue for third-party postings of a general nature.

Exactly!!! Gossip has been around since the dawn of man. The first thing Mrs. Oleson did when they installed the switch board in Walnut Grove was listen in on everyones telephone calls. LOL.
