employer not taking taxes out?

i worked at el charros last year and i wouldnt even get my check half the time and then she would say i will just pay you cash so does anyone know how i file my taxes? should i just have my parents claim me?

You are in a bind you are supposed to file tax's but if she paid you in cash she took nothing out thus all she would have to send you is a 1099 and you would have to pay all the tax's yourself. THis could run quite a bit. I don't think it is legal for her to pay you under the table like that because she is attempting to cheat uncle sam.

All it takes is for one such "cash" employee to complain to the proper authorities to get the employer in serious trouble with the IRS, etc.

The only way that El Charros would be at fault is if they hired you and you filled out a w-4. They can claim you were a contract employee and just send a 1099 out later if you did not. Taxes for a contract employee will run you around 28-35% usually, but you can get most or all of it back when you file your taxes with a good accountant.

It all comes down to the pretense that they hired you under. If you don't receive any tax documents such as a 1099 or w-2 pretty quickly, contact them and ask for your forms. Then if you are not satisfied you can contact a lawyer, the IRS, or, the Oklahoma Tax Commission.

What if you were hired, filled out a W-4 and the company didn't pull out federal taxes until the last month of the year, and they didn't pull out state taxes regularly?

Barely Legal suggests that you just turned 18. If that's the case chances are your parents are gonna claim you on their taxes. You'd have to have made a bunch to incur any "real" tax liability and I don't think El Charro is gonna do that for you. I might be wrong. Check with your parents. Either way your employer is required to tell you exactly how much they paid you and what, if any, amounts were withheld from your pay.

Actually if you are hired as contract labor you are suposed to set your own hours to work. If El Charro made a schedule with your name on it then you are no longer a contract employee. Therefore El Charro should have taken taxes out of your pay. Also depending on how you claimed (i.e. single 0 or Married 2 . . . ) you have to make over a certain amount before federal and state taxes are withdrawn from your taxes. It gets complicated. More than likly however El Charro is breaking the law if they are not taking taxes out, there should be no contract employees that work at a resturant (except the window washer who shows up unscheduled to clean the windows).

Most of this is true however they do not have to send you you a 1099, there's a $50 fine if they don't. More than likely they ARE saying what they pay you and then some. You may actually be being turned in for MORE than you get paid. It's not their responsibility to make sure you know what you made, seems like it should be but it's not. At least ask for a note that says what they paid you. Anything to take in if you are asked to pay in. Keep track from here on out too, if they say they paid you 20k and you got 16k then you pay the taxes on an extra 4k and they write off 4k.

I worked at strip club and it was my first job. I didn't get any tax paperwork and now they are telling me I am a self contractor. How can a stripper be considered a self contractor. My dad says he is going to call oklahoma tax commision and find out if this is legal. I quit when I saw minors drinking and drugs at the club.

If you're an adult why is your dad handling this for you? You as a "dancer" which I doubt, gotta report your own sh*t, you work for tips, Kelly dosnt pay you shit, you didnt sign a w-4, and you're not on any payroll. These are times when little strippers gotta be big girls and try and not under report the sh*t they earn. What the f*ck does it matter qwhy you quit? F*cking dumb c*nts in this state.

The outer limits does not report employees or have workmans compensation. They pay employees cash. Its businesses like this strip club that makes legit people pay more taxes. They have been reported to oklahoma tax commision, workers comp and already under investigation is what I was told when I reported it. They have to physically see employees and when they report 0 on workmans comp and withholding then the tax commission and workmans comp will file charges is what I was told.

OL dosnt have employees on payroll, everyone there is working off of a handshake agreement thats it, you want to demonize this thing off of stupidity. Have any idea just how many maintenance and handy man jobs are handled the same way? They are not required to pay workmans comp insurance for anyone who is not listed on payrole. The other thing dumb c*nt is OTC will not share any information until an offical ruling has been made and is public record. Either you're getting really bad information or you are just really retarded. Please cut yourself now and dont breed.
