Made a Mistake

i was wondering if anyone knows the penalty for your first dui. it's my first offense and i wasn't much above the legal limit. do i need to hire a lawyer? any help would be appreciated, thx

You might have 1 day to serve with one day credit for time served when you were arrested but sometimes there are a few more days to serve. Fines and court cost will be around $750 and you will have to complete Alcohol Driver Education and a Victim Impact Panel class supervised by KAPS. You will see a KAPS rep in the courtroom and will be given an appointment when to report there. KAPS will provide you the information for DUI providers and sign you up for the VIP class. You will have a monthly probation fee at KAPS of $25 and the DUI classes cost $20 per class with a $50 assessment your first visit. You will take 10 DUI classes. The VIP is a one time class at a cost of $55. People I've talked to say a lawyer is a waist of money for this charge.

I hired a lawyer (which was a waste) only to find out I could have gotten free defense from a public defender that would of have had the exact same outcome. Look into that first.

If in Hardin County today you will lose your license for 120 days.

I would hire a lawyer. You were barely over tbe limit. By the time you pay the fine and other costs for classes a lawyer will probably be cheaper on you. Since it is your first offense a lawyer will probably get it ammended down to wreckless driving. This will look much better than a dui on your record. Plus the price of your insurance wont raise as much. Good luck

That wasn't part of the agreement when they passed the great idea of selling alcohol in Etown. Blame the fools who brought it here.

It's called responsibility. Some of us learn this, some don't. Drink at home. No reason to drive if you intend to drink. It's common sense. Not 'cause alcohol is sold now. This is the price you have to pay for bein' stupid. Luckily no one was hurt. The price would be bigger for everyone involved. Responsibility ought to be taught a bit louder.

I doubt a lawyer will get it amended down for you but if you want to pay extra for one go ahead. You can always get a free consultation and they can tell you if they think it might be possible to get it amended. Hardin County is tough on the duiers with great reason!

They were getting it way bfore then!! the people who attempt it now days with as many cops as their are out and the roadblox etc and the stiff penalties you get for doing it the first time!! you think people would be bright enough to realize HEY IF I DO THIS IM GOING TO GET CAUGHT!! instead of thinking they can get by with it, but some folks arent' the brightest crayons in the box now are they??? oh, well i have no sympathy if you do it, I hope you go to jail and stay there till you think about not doing it again!!

I will say I was lucky. Hardin County is tough on DUI chrges. I did retain a lawyer and he was able to get the charges ammened to wreckless driving. My BAC was rather low enough to do so. YES, you can get it AMMENDED to a wreckless if you barely blew over & it was your first offense. I did the only thing I had to do was pay some fines & my insurance did go up! BUT on the positive side you will not have to lose your license etc. Hire a good atoorney, Wes Durhum is who got me off.

Dunno-never had one but I was the plantiff this summer on a theft case and saw numerous DUI plea deals. Seems if you have a job you get a high fine. Everone goes to jail on weekends and everyone gets KAPS. It's just the fines are not the same. I did see several people getting hardship licenses, and you will have to pay $30.00 a day in jail too. Anyway be safe, and don't let it happen again.

Isn't 'got me off' so impressive. Shame on those who think in those terms. I am just glad you didn't kill or hurt someone else or yourself. What thinking. Shouldn't some be so grateful for those of us who do not put others in harm's way by acting so irresponsibly. Can't change the world full of those who have no character.
