Expert Testimony

Part 1 of 3

After the testimony of world-renown pathologist Vincent DiMaio’s testimony, any intelligent person should have many of the myths and demagoguery connected with the George Zimmerman trial dispelled and debunked.
To understand why this expert’s testimony was necessary, you must first understand the deliberate lies and distortions of the media. Once they put out this propaganda, those susceptible to demagoguery have it seared into their brains and even expert testimony and logic is not going to dislodge it, but hopefully the jury will be composed of mostly intelligent people. Here is a partial list of the les spread by the media, trying to make this incident a racist killing:
1. They obtained a copy of the 911 call tape and altered it, deleting certain important segments. They managed to put in juxtaposition these two statements by Zimmerman:(1)“He looks like he is up to no good,” and,(2):“He looks black.” When compared with the original tape, after several days of ignoring the claim that they had altered the tapes, they admitted it and “apologized.” In the original tape, there were several transmissions between the 911 operator and Zimmerman, and when he said,“He looks black,” it was in response to a direct question by the operator as to the race of the suspect. But in spite of the “apology,” they had accomplished their objective of depicting Zimmerman as a racist.
2. Shortly after the incident, The media managed to dig up and publish an old elementary school picture of Travon Martin that made him appear to be an innocent-looking adolescent, about 12-years-old and not likely to assault anyone. It was several days after the incident that the media finally published an up-to-date photo of Martin, showing him to be fully grown, well developed and athletic in appearance.
3. The media further ignored the reason that Zimmerman had stated to the 911 operator that Martin looked like he was “up to no good.” Martin did not take a direct route from his father’s condo toward the gate of the complex. Instead, he took a circuitous route, going between buildings and peering through residents’ windows. They also ignored the fact that when he headed back toward Zimmerman for a confrontation to ask why Zimmerman was following him, he stopped briefly beside another building where, under some bushes, the police later discovered a bag of marijuana and a “slim jim”(burglary tool).

The judge granted the prosecution’s request to not permit Travon William’s cell phone text record into evidence. Among other things that they would have found was a prosecuting witness statement that , Martin called Zimmerman a “creepy-ass cracker” just before going back to confront Zimmerman. That is the only racist comment that has arisen during so far the course of this trial.
The media and the prosecution have downplayed Zimmerman’s injuries. After the fight with Martin, he suffered a broken nose when Martin sucker-punched him, dropping him to the sidewalk, whereupon Martin promptly jumped on top of him and began pummeling and banging Zimmerman’s head against the sidewalk. Although Zimmerman suffered notable injuries, as photographed by news media, police, and EMS photographers, Zimmerman declined medical attention. More often than not, victims of crime decline medical attention at a crime scene, even though they need it. This is because they are not thinking clearly and thinking in terms of needed third party evidence and of course they know that they will eventually be billed for the cost of the treatment.
In reports after the incident, the media tried to make it look like Zimmerman shot Martin while Martin was trying to run away.(Statements from various persons who knew Martin know that he never ran, or even walked away from a fight. That is further consistent with his school records where he was suspended for refusing to abide by the rules, and for his generally contemptuous conduct.) The expert testimony of DiMaio thoroughly dispelled that version. Martin was shot in the left side at an angle consistent with Zimmerman holding his gun in his right hand at point blank range while Martin was on still top of him. After being shot, martin got off and made a futile attempt to get away (telling Zimmerman,“Okay, I’m done,”) and probably thinking of going back to his father’s condo and getting medical help. As Vincent DiMaio testified, the heart can be totally ripped from a person and still leave enough oxygen in the brain to perform physical feats up to 10 to 15 seconds after a fatal wound to the heart. That would leave enough oxygen in the brain for an athletic person to run from 100 to 150 yards after such a wound. Any policeman who has investigated many gunshot murders, knows this. That fact will expand the crime scene and often confuse inexperienced investigators. Many victim’s of fatal wounds to the of the heart have been found blocks away from the scene of the shooting.

The prosecution tried to suppress the evidence that marijuana was found by the pathologist in Martin’s body. For a change, the judge made the right ruling when she denied that prosecution’s request. This fact is important because it speaks to Martin’s character; it is more evidence of Martin’s flouting the rules, and indeed, the law. It speaks to his character. But contrary to the warped judgment of some of the media pundits, such as Mary Grace, the use of marijuana can impair one’s judgment. Policemen know this better than most of us. Mary Grace (“What difference does it make?”) lost a lot of respect from many conservatives because, early on. she apparently made a decision to back the prosecution’s version of the facts, rather than intelligently wait until all the facts emerge. It’s the old “That’s my view and I’m sticking to it,” syndrome.
It was apparent during the cross examination of Vincent DiMaio by the prosecution that the prosecutor is now in CYA mode. Most of the exculpatory evidence uncovered was there to be discovered by the prosecution if they had been less interested in appeasing the emotional faction of the case. He is using ad hominem tactics to try to persuade the jury. He ridiculed DiMaio’s allegory of stating that “If I ripped out the heart of someone, he still has enough oxygen left in the brain to carry on physical activates for 10 to 15 seconds.” Such statements are no doubt common from pathologists in explaining physiological aspects of a crime. Although the wording of the allegory may have not been the best, the prosecutor did not challenge the veracity of DiMaio’s statement with any contravening scientific evidence; he was simply appealing to the members of the jury who may be more emotionally responsive than rational.

It's all racialist. Jurors are people too and they can't separate race from shinola in most cases. The best thing to do is just to sacrifice George and avoid a full scale riot. Then we can all get back to pursuing lives of religious fulfillment.

Sarcasm, of course. But there is more than a grain of truth to what you say. Our society is not any better than the Aztecs and other Pre-Colombian tribes that made human (young virgins) sacrifices to their pagan gods. We see the same callousness in the abortion issue. Abortion should never be used as a method of birth control. Emotions are more still more powerful than logic and rationale.

Whether George Zimmerman is found innocent or guilty by the jury, I am firm believer that all of us live by karmic law, and he will ultimately be punished for the death of Trayvon, no matter what.

The prosecution's "star witness," Rachel Jeantel, went a long way toward losing the case for them. She said that the phrase, "creepy-ass cracker" is not a racist slur. There's more insight and truth here than will ever meet the eye of the truly racists.
