Noise Ordinance

Has anyone ever heard of EPD arresting someone for violating the noise ordinance? I was driving down the Ave bout 8:00 and the cops had just finished a traffic stop by subway, I had my music turned up and I noticed the officers staring at me as I passed(i turned it down after i saw him get in his car) so I was sitting at the light and an officer pulled up to the passenger side of my car and tells me that if I can't turn it down that he had a ticket for me. But the light had turned green and we were holding up traffic so he told me to go on and pull over so I pulled up at Larry's pizza he got to my window and asked for my FL and stuff then asked me to step out of my car and come with him. I was standing at the back of his car and he then tells me I was under arrest for a criminal charge of violation of noise ordinance. He ended up releasing me with court appearance instead of taking me in and posting bond. But I don't understand how I was given a criminal charge if I had never even been warned. I've only got 1 ticket in my life and that was no seat belt but shouldn't I have gotten a warning or ticket first?

There has been a noise ordinance on the books for years and it was mostly for people with loud stereos in their vehicles. They don't have to give you a warning at all unless they're in a good mood that night. That being said, please remember that you're the only one that thinks your music is so good that everyone else wants to hear it. I did it way back in the day and finally got it through my hard head that no one else gave a damn what music I was listening to and disn't want to hear it. I doubt he would have actually arrested you but get ready to pay and keep it down from now on.

They cannot give you a ticket unless someone called and complained about your music.

You're wrong there. You need to find one of those dudes that caused all of this mess from the early 1990's. He used to rattle business windows and stuff. People complained and they started enforcing the ordinances more. Even if that meant stretching them so that they covered whatever they needed it to cover. Yes, they can do that.

In fact he once told me that the police came up to him when he wasn't even inside his vehicle and told him that they know who he is and all about his stereo and that if they heard him turning it up, they would just arrest him and have his vehicle towed away. They could make up almost anything. Why? Because more than likely the person won't fight it in court, because even if they did they would probably loose. Well, unless they have money to throw around. But like a previous poster, if you don't make them mad, they usually don't worry about it, because it's more paperwork for them. But if you make them mad, they don't care. And it's easy to make some of them mad.

Don't be a goober and you won't have to pay fines. Sounds like your little punkass was being disrespectful, so he had to pull you over. At least you learned something.
