I doubt if you know who I am! I haven't been active at Quest for over 5 years.

1 "worried in Austin, Tx" I am unsure who you are but anyone close to the case and my immediate family know what is going on. Please refrain from putting my daughter's name in future posts. I am trying to keep her name out of it, since she is a minor the fewer people that can put her name to this case the better. We are doing very well and adjusting to all the changes in our lives. |

1 Tough one for me to take sides on and waiting for case to go to trial to present all the evidence and put before a jury. Serious ramifications either way the decision goes. |

1 I am still amazed that the media did not pick up this story. |

I understand there is a Rule 24 hearing on October 5 (which relates to cases wherein the D.A. is seeking or may seek the death penalty), but that may not be accurate. The hearing may be just some pre-trial thing that keeps getting moved.

Any word on the october hearing? So much for the right to a speedy trial. I wonder how fair it will be at this rate.

Just shows you have to have money to defend yourself in the legal system to get folks to pay attention and he doesn't have any. All his assets are frozen.
He's still in jail, more than a year now. No he's not up on death penalty. It's still his word against hers and the state. His story has still not been heard and the evidence has not been presented. I think they are holding him as long as they can as they know they do not have a significant case. As the judge said someone is not telling the truth and that's the courts job to get to the bottom of it. Everything else is noise and banter and spin and usually unevenness as folks feel they have to take sides. What will be interesting is to see folks reactions when the real truth comes out. Who's lying? No one really knows yet. Is it her? Is it him? Perhaps both of them. Admit no guilt unless your cornered and there is no way out of it? Poor kids. Adults acting like idiots and I'm not referring to the parents. Where did everyone's values go? Did you every have any? |

They are holding him because he can't make bail. They are holding him because the judge apparently believes he is a threat to his (ex?)wife and child. They are holding him because, as Wondering said, someone is not telling the truth and it is up to a judge and jury to sort through whatever evidence is offered at trial and figure it all out.
While Robert has been in jail a long time, it is not a disproportionately long time. The guys who killed UNC student body president Eve Carson won't be going to trial until at least May 2010, and that will be more than two years after the crime was committed. In some states, it is common for criminal matters to come to trial 3-5 years after the alleged crime. For people who can't afford private attorneys in criminal cases, the state provides a Public Defender. These folks are over-worked, under-paid and often excoriated for their willingness to defend people accused of crimes. If this case has been an eye-opener regarding the functioning (or lack thereof) of the criminal justice system, then stop whining and take action! There are many opportunities to become involved with groups working to improve the criminal justice system and the rights of those who are unjustly accused. |

If one is innocent then sitting in jail for any amount of time must be frustrating and they cannot get that time back.
I imagine the legal system gets it right most of the time but not always as we read and hear about at times. How does one become involved to affect the criminal justice system more specifically? By the way have some wine and chill out. |

Start with the Center for Actual Innocence in Durham. They have many suggestions.
Too early for wine. I think more caffeine is called for! |

Quite honestly, the banter, the accusations, the assumptions, and the incriminating comments need to come to an end. Let the justice system and the designated legal teams do their jobs, do not think that what any of you have to say will make a bit of difference. There are multiple victims in this tragedy, we all need to remember that. The damage has been done and it is irreversible so it is time to let the family heal and to move on from this unfortunate crime. Actual Innocence is a non profit organization that is used for individuals who are currently incarcerated and who are "ACTUALLY INNOCENT", so keep that in mind. I almost lost my friend on that day, that is something I will never forget or let go of. The blogging, the posting, the comments should cease, out of respect for all involved.

1 To say the Center for Actual Innocence in Durham is for those that are truely innocent shows your prejudgement and assumes you believe everything you've been told. Out of respect went out the window when people said very hateful things towards the accused and what should happen to him without regard to due process. Many of us have been much more patient than the folks that posted these hateful thoughts. As the judge said someone is lying and everyone deserves a fair trial. We'll see what comes out when both sides of the story have been told. Until then the slow wheel of democracy continues to turn and at least the accussed is protected from the lynch mob. |

3 Nobody is guilty (especially with a good lawyer) until proven guilty. I have seen many circumstancial evidence point to one thing and the truth be entirely opposite. What you read in the paper is rarely what comes out in court. The DA can and will use any and ALL evidence against this perp and for the state. Let's give this thing a chance before we start electrocuting another person. |

If you think there were troubles before ... now that he is loose you better wacht out. |
||||

just durham is stirring the pot. yes he's out on bail because enough people still care about him and want to hear more of the truth about the case. 13 months in jail and not trial date is not due process. again if he is found innocent then what? if you were accused for something you did not do i imagine you would want someone to support your point of view. then again some folks don't care or can only see their point of view. i avoid ignorance as an excuse.

so, I'm confused...is he out of jail? Is he allowed contact with his daughter? Seemed like such a cut and dry case...but I suppose things may not always be as they seem...
