Just wondering if you're flagged for tax interception for back child support how long does it take to get the money? Both for the ex-spouse receiving the back child support and for the one who filed the taxes to get whats left after its taken out?

unless they are married and you may not, the new wife if she is working may nix it all together, especially if they have kids together.

I'm the one waiting for the money. I was just wondering how long before I would get mine. and would they hold the remainder of his until I received mine.

Have you ever gotten financial assistance for your child/children from the state? If you have, they may take theirs before you get yours. I honestly can't say on that. Maybe you could ask the attorney who's helping you get the tax refund support payment.

I know this isn't YOUR situation but I am going to say this for all the women who are married to men ordered to pay support and they don't. When you file taxes, if you file "married, filing jointly", the IRS can tie up YOUR share of any refund until the IRS does whatever they're going to do. The IRS can't take YOUR share of the taxes to pay HIS obligation. But they can hold it all until they decide how and who it belongs to. So you should file "married, filing separately" so your share comes in even when his doesn't.

One more thing: If YOUR spouse or girl/boyfriend has children and is ordered to pay support, insist that they do. The kids have done nothing wrong and they're the ones hurt. We ALL have a financial obligation to support the children we have.

My ex has never paid his child support like he was supposed to. I have gotten his tax check for the last 6 years. Once they file taxes the state puts a hold on it. The check is sent to the child support in Franfort. The state holds in then for 30 days to make sure the state itself cannot take it due to such things afdc, etc. Ive never recieved mine any earlier than August. It really all depends on when they file. Hope this helped.

well my x owed child support and they took his taxes he then told me they took it in feb i got what he owed in march. He then didnt pay again and they intercepted his stimulas check and that was in june he also told me that they had taken it.Im still waiting to get the money. The muhlenberg county child support enforcement said that it had posted but still have not received it. don't know why it is taken longer now then it did before.

im waiting for my ex's tax intercept check to come back...they said six to 8 weeks...it is now the 8th week and i found out it is 6-8 weeks from when he got the letter his taxes were being intercepted!! i JUST WANT MY MONEY!! tired of waiting

It takes six to eight weeks from the time they file their taxes. They can't intercept the refund until the refund is filed so technically they could wait until April 15'th to file which would put you getting the refund sometime before or around the end of May or even the beginning of June. But if he really want to be a jerk he could wait until October and file late. Or he could just not file at all. If you have problems getting support just go to your local child support office and ask for the government to handle your case. Then they will give you a regular check and the government will track him down and garnish his wages. Either way if he doesn't pay you still get your check but if he doesn't pay then he goes into arrears. It's an incentive to keep a job.

To get around the IRS taking the spouses money they can file an "injured spouse return" originally along with their taxes and that way the IRS won't take the spouses share. Filing the form after the fact is just a headache. Might as well take care of it all at once. they should not file married filing separately if they also file an injured spouse return. There's a lot more money to be had filing jointly usually. At least for poor people it is.

And yes, the IRS will take whatever it needs to comply with the order, even the spouses share. That's why they file an injured spouse return first. Also, the CSE agency cannot disperse that money for some time because they give people enough time to retroactively file the injured spouse return. If so, they must give the spouses share back if the CSE received any of their money. So by law they can't take the spouses money, they can and will unless the spouse files an injured spouse return.

Well anyone needing to know about taxes that were intercepted for back child support, that money is held by the state for "180 DAYS" YUP I SAID 180 DAYS!!! Just got off the phone with IRS and was told the state is the one that puts a hold on it. That puts me at or after September before I get mine. Child support tried to tell me that I could file an injured spouse form to get my money. Not so, you have to have worked that tax year in order to be able to claim the injured spouse form. If my husband had file joint but filing single this would not be an issue. By that time I will have lost my cell phone, gas, electric, truck....you name it. This way of doing things is straight up B.S. This helps us in no way.

here in nevada its 6 months also. my ex keeps trying to stick me. my last case worker didnt do the intercept ss# verification...I found out by accident. Soooo, i had them file it this year in jan. they were dont in march. my ex is such an ass he waited until april 18 to file his taxes as he thought it was done last year as the last case worked said she was going to do it.(and then didnt, she liked my ex, im sure of it) so since he thought he was sticking me, he actually would have not been intercepted if he filed the first week of feb like he always did. so instead of sticking me, he got stung. but he reduced his hours to part time so my support is cut in half again, he then got another full time job and has NO support taken from it because the case worker says they only deduct from one employer...is that true??? so he stuck me again, he owes about 9000. to date and i just had both kids graduate from their grades. my ex sure sucks...

You know just because someone is a non custodial parent doesn't make them bad and don't ask people why they didn't pay something. God get off your pedestals "custodial" parents you make me sick with your better act in all! Lots of non custodial people are getting screwed and are not all bad and look where your loving Illinois governor is now! Ha where he belongs and he made the messed up rules and now I hope he has to pay child support some day and see how hard it really is and to live a life too! Im a woman who has had to pay and sometimes couldn't and has an arrearage but I am about to clear that up after several years of hard times! I also didn't get the rights I deserve regarding my children and due to their fathers actions it has caused allot of hardships! Sometimes it's hard to pay due to the new recession. Self righteous arrogant jerks think your so much better if you have possession of your children and its all about the mighty buck with you and not what's right for the kids.

I was referring to the CHILD SUPPORT person comment it really makes me mad when I hear or see stuff like that because we are not all bad and just because you can't pay something doesn't make a person a dead beat parent. I've lost allot of years and memories due to ignorance and blaming being a non custodial parent and it just wasn't fair. I could do nothing right by them. If I couldn't pay money I tried to make up in other ways like keeping the insurance on them and sending other things to try to help. It may not have been much but I tried! Just something for you all to think about when using the term dead beat parent when describing a parent not paying or paying enough!

My child's father cant pay CHILD SUPPORT because he has too keep his self and DOPE BUDDIES up!It's very sad when Dope comes before your child.He spend's his money on keeping his buddies high!! The hell with him.........I'm the custodial parent who put's a roof over my child's head,pay's for clothes,football and anything else he want's!!!OHHH, and most of all LOVE.So his father can kiss my a$$!!

I've been waiting almost 6 months here in good 'ol Massachusetts. The kicker is calling DOR, they can't give me any info even though IT'S MY MONEY!!!! Can't stand these agency's that hinder the raising of our children.....if it were "owed" for that long you know how much in penalties and fees there would be??? Why can't I charge them???? SMH
