I don't want to laugh too hard at this one because accident's do happen and we all do dumb things. However, just a friendly reminder that we're all potentially one dumb mistake away from a negligent homicide charge:

A former Eastchester police officer was indicted Wednesday in the Nov. 3 off-duty shooting death of an acquaintance while showing off a laser-equipped handgun.

A Westchester County grand jury indicted James Pileggi, a 29-year-old Eastchester resident, on a felony charge of second-degree manslaughter. The charge means he is accused of recklessly causing the death of Andre Everett of New Rochelle.

Everett, a 27-year-old real estate agent, was killed in his driveway on Albert Place after walking out to meet some acquaintances who had driven up in Pileggi's white Infiniti, authorities said.

Pileggi was sitting in the front passenger's seat with two friends, an unidentified New Rochelle firefighter and another man. As Pileggi showed off the laser feature of the 9 mm Glock, the gun went off, shooting Everett in the throat as he stood by the rear driver's-side door. Everett died at 9:40 p.m. at Sound Shore Medical Center in New Rochelle.
Pileggi, a two-year member of the Eastchester force, resigned from his $74,009-a-year job in November. He previously served for four years as a police officer in Mount Vernon.

He is free on $50,000 bail.

Pileggi's lawyer, John D. Pappalardo, maintained his client's innocence Wednesday, insisting that the shooting was an accident, not a crime.

"There were three individuals in the vehicle, and we have spoken to all three at length, and each are adamant and have confirmed that this was nothing other than a tragic accident," he said.

Arraignment on the indictment is pending. Pileggi faces up to 15 years in state prison if convicted.

Assistant District Attorneys Fredric Green and Perry Perrone will prosecute the case.

Ooops, I meant to post that on a concealed carry thread. However, the sentiment is the same on this thread.

Anyone who thinks they are above making a mistake that could have unintended consequences can throw the first stone.
