Why of course! The 'lying in wait' enhancement, telling his friends he was going to kill her, stabbing them 45 times, getting into the house with a key, etc. Why that wouldn't preclude a death penalty, especially in the glorious State of California where you can get away with anything!. Wish I was on the jury.

Oops forgot. The defendent is Hispanic! Of course he isn't going to be punished. He can go to prison and join a gang. Right in his own neighborhood too! High Desert.
