Uh, no. Convicted felons forfeit the right to bear arms. In fact he said the reason he ran is that he was carrying a piece, even though he knew that would violate his parole. To bad, so sad, hope they reinstate the death penalty soon.

So in your world, the perp had a gun, but didn't use it, and the cop shot him just for the halibut. Then, fearing for his life for not having done anything, said perp pulled out his gun, shot the officer who had just shot him, then stood over the officer and shot him again. Sadly, given that said officer is dead, he can't testify that the paroled perp carrying the gun and running from the law after an atercation pulled his gun first. Sorry, I'm not buying it.
