According to court papers, Buckley was allegedly ineffective because he did not ask the judge to instruct the jury on the defense of extreme emotional disturbance. How does one successfully raise a back up defense of extreme emotional disturbance when their primary defense is "I didn't do it". It may be successful in some cases, but not in a case like this. It's hard to imagine a jury buying it (or Nevas agreeing to give the instruction). Also, they claim Buckley was ineffective because he did not request a continuance at the sentencing because Milano decided the morning of sentencing to take responsibility for his crime. The allegation is that a continuance would have given the judge time to consider a lesser sentence based on extraordinary acceptance of responsibility. Milano DID get credit for acceptance of responsibility at his original sentencing, there's no way the judge would have given him credit for extraordinary acceptance when the guy held the government to it's burden, denied killing Grasso, and made everyone sit through a multi month trial. Say what you want about Buckley, he did a fabulous job representing this guy; pinning ineffective assistance of counsel on him is unfair and awfully convenient. There was no evidentiary hearing to determine whether Buckley was truly ineffective, just a backroom deal crafted so that the Government could save face on issues related to the
FBI/informant(s). This has nothing to do with Mac Buckley. Mr. Milano deserves the reduction but not on these bogus grounds.
