FACTS
Balsamo is the Director of Athletics for the East Haven Public Schools, a position
he has held for many years. Cathy Finkle is a private citizen who resides in East
Haven, Connecticut. Cathy Finkle is married to John Finkle, the President of the East
Haven Board of Education.1
Between March 19, 2004 and April 8, 2004, Cathy Finkle telephoned Balsamo’s
office on numerous occasions expressing anger that her son had not been elected
captain of the hockey team. During these calls, Finkle also criticized, belittled, and
ridiculed the other players on the hockey team. In April 2004, Finkle telephoned
Balsamo in anger to protest the fact that her son had played in the outfield, rather than
third base, during one of two back-to-back Junior Varsity baseball games. Finkle
informed Balsamo the purpose of her call was to send a message that, if her son was
not allowed to play third base in the next baseball season, the Baseball Coach would
lose his job. Finkle concluded the call by warning,“You better not f**k my kid!”
On October 29, 2004, Finkle again telephone Balsamo at his office, but said
nothing and hung up. Finkle called again, this time subjecting Balsamo to a tirade
concerning the fact that her son had not been made captain of either the hockey or
baseball team. Finkle leveled harsh criticism on all of the coaches who worked under
Balsamo and the other students who played on her son’s hockey and baseball teams.
This tirade continued for approximately forty-five minutes.
Sometime on the evening of November 2, 2004, Finkle confronted Balsamo at
the end of a volleyball tournament game at East Haven High School Gym. In front of
several hundred onlookers, Finkle screamed at Balsamo,“Why didn’t you let Jordan
Vollono play? You s*ck, you #$#$%#%#! You better fix this!”

At this time, Finkle, in his capacity as President of the Board of Education, called Balsamo. Finkle did not agree with the coaching techniques of the school's volleyball coach, claiming he was not giving adequate playing time to a particular individual. When Balsamo defended the coach, Finkle “flew into a rage and denounced the plaintiff.” Compl.¶ 10, Third Count. In June of the following year, Finkle and the East Haven Board of Education denied this volleyball coach reappointment. Finkle made a public statement claiming that the reason for this denial were issues that “the athletic director [did not] work very hard toward” resolving. Compl.¶ 13, Third Count.

In April of 2005, Finkle's son, a student athlete at the East Haven School District, took a trip to Florida. To go on the trip, the boy turned into the school a false medical note claiming that he was sick. The boy's coach called the Finkle residence and was informed by Finkle's other child that the son was in Florida. As a result of this, Finkle telephoned Balsamo and, using profanity, demanded that disciplinary actions be taken against the coach.

Late in April, Balsamo received a complaint from a physically disabled student that he had been picked on by other students, including one of Finkle's children. After investigating the issue, Balsamo wrote a report documenting the complaint. Finkle replied to the report by writing a letter to Balsamo stating, among other things, that Finkle was “in awe of your arrogance.” Id.¶ 12, Third Count.

In October 2005, an allegation of sexual harassment was made against Balsamo. The East Haven Board of Education hired an attorney, who prepared a 23-page detailed report and concluded that the allegations were false. After receiving that report, Finkle ordered another investigation of Balsamo. Balsamo alleges that Finkle knew these were all false. As a result of this second investigation, Balsamo was suspended without pay for 10 days.

The bases of the claim for intentional infliction of emotional distress against Hennessy relates back to a time before he was a member of the Board of Education. Hennessey' son, a captain of one of the East Haven athletic teams, was involved in a verbal altercation with another captain, which altercation led to Hennessey's son claiming he was assaulted by the other captain. Balsamo investigated the matter and determined there was no assault. He then counseled both boys to behave “in a sportsmanlike manner toward each other.” Id.¶ 4, Fourth Count. Hennessey's son refused and behaved in a rude and disrespectful toward Balsamo. Hennessey then called Balsamo and “berated” him. Compl.¶ 4, Fourth Count.

Shortly thereafter, Hennessey became a member of the Board of Education, stating that his goal was “to get Fred.” Id. Thereafter, Hennessey and Finkle met with Balsamo and stated that,“If you can't make me happy, I'm going to do something about it.” Id. at ¶ 5, Fourth Count. Hennessey was also involved in the process of pushing for the second investigation of Balsamo after he was cleared of the sexual harassment charges. Balsamo's suspension was the result of these actions.

I think you should be ashamed of yourself, and the next time you want to bring out personal information you might want to check on your own camp on what is going on in their personal lives, which the repubs I am sure would not stoop as low to try to discredit someone in your camp. Shame on you. And you are a prime example of why I will not vote Democrat.

It is my business. When someone whos so critical of someone elses qualifications they best make sure theirs are in order.

Bankruptcy? IT WAS FINKLES PALS WHO FUDGED NUMBERS!!!!!!!!!! and it was confirmed by the audit, the same audit Finkle paraded around demanding to show Aprils mismanagement of the town.
Yet with the audit and auditor in front of him WITH THE TRUTH AND FACTS he asked NOTHING!!!!!!! HE TUCKED TAIL AND LEFT.
The audit showed and confirmed 3 very important facts:
1) the previous administation overstated revenue and never corrected the short falls.
2) the board of education let out a very large payroll entry.
and 3 and most important
APRILS ADIMINISTRATION UNDER SPENT WHAT WAS BUDGETED BY NEARLY 1 MILLION DOLLARS.

You want the truth to be known, well there it is.

Furthermore, Everytime i turn around Finkles camp has told flat out lies expecting them to slip by,
his website, shows the "audit" for 07-08 (which was put in place by Maturo's administration. Which he shows what he says is the over spending, look right next to that highlighted number, that 78million was the budgeted amount for expenditures the 75 million that was actually spent was 3 million lower, now figure in the overstated revenues that did not come in, your left with 600,000 and change.
I am sure if this was not the truth a Mayoral candidate would have immediately said something to dispute that when the auditor stated these facts.
He goes on to mislead about property sales and the airport can expand, no John they can't. Not without the voted East Haven now has on the airport board. Seats that were not there before the settlement.
DEP came to East haven and flat out said East Haven had absoultely no authority nor grand to stop the runway expansion area. Or should we have kept throwing money into a losing fight. If it was properly addressed in 2006 by Maturos administration maybe just maybe we had a case but that came and went totally ignored.

He goes on to say April cut 23 jobs. April doesn't have the power to cut any BOE jobs. The BOE makes that decision. The Mayors administration stepped up with a plan that would save those jobs. Of course certain people within the BOE don't like that because it eliminates something they can blame on her.

Stepped up with a Plan? You call that a plan? Were you at the boe meeting? Did not see you there! The plan was to limited the security at the high school, the plan was to lessen the handicap transportaion, the plan was to cut more money from school text books and so on and so on! This was her "PLAN". At the cost of the children. She also has a plan that will put the boe into a lawsuit breaking contracts SHE signed with OR & L. Not to bright if you ask me. She also only gave them this "Plan" hours before the boe meeting which I have witnessed over in over on many boards how she waits before the meeting is to start and the comments are "I am looking at this for the first time- how could I vote on it? That is why it was tabled - for review by both newley hired finance personel, not because of John - it was also voted that way by "your" dems as well - the smarter ones obviously. This is not about Dem or Rep - this is about our "Children" and what and how the budget should be spent. I have faith now especially since they are under a microscope that is HAS to be done right for the childrens sake because if it is not I am sure there will be an upevil. The part I find so hysetical to watch was Marilyn trying to get it passed without discussion at first, her puppet strings are so obvious, and Paul Hungo losing his cool about budget - what he said is correct but the proposal needs to be reviewed and all need to work together to do what is right - well see what happens...to be continued

I agree with you on the review, it shouldn't have been voted on that night. Theres good and bad in that plan. As far as John goes, he has his own agenda, and he's counting on the education panic to gain votes. He is counting on jobs to be lost for votes. His Board of Education caused these issues we are now forced to deal with. John has lied time after time. He's sacraficed our children for over 10 years. He cant manage his own finances but yet he's a great candidate for our town? I don't think so. Members of the BOE also have their own agendas and they need to booted out come November ON BOTH SIDES.

Yet again, at Town Council, another lie on Finkles website was called out and he said nothing. THE TRUTH ABOUT THE AIRPORT AND THE ABILITY TO EXPAND. His fake document, and the fact that the airport cannot expand WITHOUT East Havens votes on the Airport Board,(votes that were not there prior to the agreement with Tweed). These facts were bought to the Council and Finkle did not question them, just as he didn't question the auditor.
He should change his name to Fakle.

Finkle was chairman of the board for 10 years too long. Maybe his running for mayor and getting beat will show him the door. I don't want to say it again, but if he can't manage his own finances, and he hasn't managed the school systems budget HOW CAN HE AND HIS BOSS (WIFE) manage our town? My son was on one of the high school teams George is speaking about = and its all true - MOMMY came to his defense he didn't get any votes to be captain, because he's about as good a role model and his parents.
