I think this reporter should of clarified the guys statement instead of making it appear as a fact.

The way I see it is they don't quite have an air tight case yet and they cant afford for any case sensitive info to get out at this point and its been made clear that the murder prosecution would be put in jeopardy if info is leaked before a trial so people better keep their mouths clothes if they want the case to have a fair shot at prosecution.

CHASKA, Minn.– Carver County saw a courtroom shocker after a judge threw out a murder case before it could get to a jury, clearing a man accused of stabbing a man following a bar fight at Kelly’s in Chaska last June.
Although Jesse Rogers immediately claimed self defense in the stabbing that left Jason Foster dead, he was arrested on the spot and was charged with second-degree murder. Since then, he has spent the past nine months in jail awaiting trial.
On Wednesday, a judge decided that the prosecution simply did not prove its case and said there was insufficient evidence to proceed to a jury trial. One hour later, Rogers was a free man.
The homecoming that no one saw coming has the victim’s friends feeling furious, wondering when or how justice will be served.
“It was no fun being locked up in jail — especially knowing it was in self defense,” Rogers said.
It all began with a bar fight in Chaska last June that involved racial slurs and punches. That fight continued into the parking lot, where Rogers says five men confronted him.
A judge can do what he wants to do. If David talks, it can end up like this case.

It is getting to the point that people need to just take care of it themselves. In Karen's case there should be organized rallys where people wear guns on the outside of their clothing to demonstrate how they now have to protect themselves because law enforcement is apparently content to let murderers walk free and they don't seem to care what the community at large thinks about it, they care more about doing whatever they want to do when they want to do it. A very weak press causes this because there are no real checks and balances. If you want to get away with murder just go to Dyersburg, TN or Chaska, MN. The only way to stop this nonsense is for people to organize and demonstrate. Look at the Zimmerman case. Law enforcement wasn't going to do anything until a group of neo Panthers actually showed up in numbers and publicly stated that they were going to take care of Zimmerman themselves, only then did the the Trayvon Martin case head for the court house doors. They were not going to do anything with it until those very public demonstrations started happening This case involving Karen is a d*mn travesty and injustice to her, her kids, her community and anybody that lives within a couple hours of Dyersburg. I am furious that someone capable of doing that to another person is free walking around Wal-mart and probably laughing ha ha ha. Law enforcement and elected officials have to be reminded by the people that the officials serve the public, not the other way around, and they owe the public a reasonable explanation for what is and is not going on in her case. I think the only way to effectively get it across to the powers that be is to make a sign, strap on a fire-arm and go march in the street at the capital of TN demanding justice and information for Karen and now this other person. It is sad but that is what it takes. We have a right to know what happened to her and we have a right to have the investigation investigated if necessary. They go way too long without informing the public on this case.

As far as being thrown out, it probably will or would be due to lack of evidence and a poor investigation right from the beginning. If a Judge is really saying the mess about someone and or family talking, then he needs to be informed about the sister blabbing all over the other KS thread. She constantly insinuates, indicates and drops hints accusing DS. If she isn't doing that, she is bashing him or bitching that he didn't do anything or enough to suit her. Just what did she or has she done to help in this case? Nothing, other than try to make everybody believe DS killed her sister. Then she gripes about him getting an attorney and wonders why does he need one? Really makes a lot of sense! So I doubt a Judge ever said anything about people talking and throwing this case out, because if so, it would have happened long ago.

Exactly right! I believe investigators may have told certain ones, like DS and Sons to not discuss what they may have talked about amongst themselves. I hope the sister's dislike and hatred was not the cause for the judge to seal the autopsy info. I have seen cases where the family members were against each other and it caused problems within the investigation. Never know, maybe DS requested the Judge to seal it. I have always felt that DS was ruled out from the beginning. Not cleared, because no one is usually cleared till someone is convicted. It's also possible that David asked for no one to be informed of any info except him. He would have that right as her husband to request that if he wanted to. I'm sure he must be aware of what the sister is saying for the whole world to see about him.

Sounds like you and Oh No need to do some catching up. First of all, Jacque Waller's husband IS being prosecuted as we speak. His arraignment was held early this week. Secondly, have your sister murdered, your own life threatened, your murdered sister drug through the mud, etc. and see how low you lay. If you can claim that you'd keep your mouth shut and just sit back watching especially in a situation like this, then you're part of the problem....that is unless you do so hiding behind a keyboard. Wow...what integrity. Wouldn't want you as my family member or friend. Definition of cowards with no backbone.

It has been almost a year oct that not one thing has been said about mrs swift death , waiting on autopsy results, waiting on forensic results. they will never do anything about her death I personally think it has a lot to do with politics and some wealthy people. They probably know who did it but let it go long enough she will be forgotten that what our sherrif thinks.
