A man who claims two bar patrons attacked him seeks more than $300,000 from the patrons and the bar where the incident allegedly occurred.

Rodney Sumoski filed a lawsuit March 4 in St. Clair County Circuit Court against Donald Goforth, Eddie's Bar, also known as McBride's Place, Reginald Allen and Rusty D. Kempf.

Sumoski claims he visited Eddie's Bar, an establishment located in Dupo, on May 23 when the attack occurred after Allen and Kempf allegedly became intoxicated.

"That Reginald Allen and Rusty D. Kempf's intoxication was at least one cause of the occurrence in question," the suit states.

Because of the incident, in which Allen and Kempf struck Sumoski in the head as he was seated, Sumoski sustained damage to his head and suffered great pain and mental anguish, according to the complaint.

Sounds just like another bar fight. I am amazed any selfrespecting lawyer took the case. Drunks fighting other drunks.....go figure.

These guys are just something to deal with. How were the owners to know these idiots would come in the bar and attack someone violently. I don't think it's fair to bring suit against Don for his personal assets. I would say the insurance should cover his part and those other two idiots need to be paying. If anyone knows any of them it's pretty obvious Don's the only one with any assets. These people are just trying to run a business and never get in any trouble and these two mentally challenged idiots come in and attack someone because they are disturbed and now people are going to suffer because of it(Don and the man attacked). I think they need to be removed from society because they can not conform to normal society.

That wasn't just another bar fight. They almost killed that man for no reason. I'm not exactly positive about the details but I think he was in ICU, had brain surgeries, and almost died. Not only do they need sued, they need their freedom revoked. I'm tired of these turds!

I seen Rusty Kemp knock some guy out cold at Bob's one night. Not only did he knock him out, then he got on top of the guy and continued to punch him while he was unconscience. The guy was so wasted to begin with that he couldn't stand up. There was no reason for Rusty to do that. WOW. I will never forget that.

Rodney had part of his skull removed then reattached weeks later to prevent the swelling of the brian from killing him.. Rodney is not a fighter and he did not deserve this and it is a damn shame the bar owner has to be sued but $300,000.00 might cover his medical bill as Rodney will never be the same again after this... And yes he almost DIED!!!!

I don't understand people anymore. If the guy is down and not getting up there is no point to keep beating him. Why is there nothing being done about stopping these guys? People go to jail over bogus charges all of the time. The only reason these guys keep walking is because they are always in trouble and they know the laws from personal experience. Reggie could probably defend himself in a courtroom with all the crimes he has committed.

I mean if you look below in the article - the paper is obviously implying some intimidation may be keeping these guys from serious terms.

Court and police records from 2000 through 2009 contain an impressive catalog of criminal charges at least 35 against Allen, all of which were ultimately dismissed for one reason or another:

Fifteen incidents of assault or battery, including a 2000 case in which Allen allegedly pushed down a young woman described as a "household member" then kicked her in the face.

In another 2002 case that resulted in a battery charge, Allen and two accomplices admitted to an officer that they'd beaten a man in a dispute over a stolen motorcycle. When police arrived at the hospital, the victim was injured so badly, he was drifting "in and out."

Six incidents involving damage to property, including one instance in 2000 when, during an argument at a Dupo auto-body shop, Allen shattered his adversary's car window with a glass jar. A shootout erupted, and Allen fled. Police later found him hiding in the closet of his grandmother's trailer.

In a different damage-to-property episode in 2003, Allen was trying to retrieve his girlfriend late one night at her family's home in Cahokia. He broke through the screen door and began beating the front door with a golf club. As the girlfriend sobbed and her mother screamed hysterically, her father came to the door naked and armed. Allen cocked back the golf club as if ready to hit the father. When the father fired a shot at the boy's feet, Allen ran away.

Many of these charges were dismissed in plea bargains. But in at least eight of them, the victim simply failed to show up for court. On one occasion, the reason was all too obvious.

Two thirty somethings beating a 60 something almost to death. And that is after the killing at City Nights. The system is supposed to serve and protect. These two creeps need to be locked up for good. Those that support him should get some kind of sentence for being stupid.

They're not in jail because this is St Clair County and specifically Dupo/EC. The Riverfront Times made a lengthy case about why Allen should be in jail. But his daddy's money and political ties kept him from doing too much time and out of jail after allegedly killing that black man at the club his daddy owned. But daddy is gone now. Kempf? Last name, nuff said. All it takes is a phone call and a donation to keep some people above the law.

Shame on the St.Clair county states attorney. There has been corruption on all levels of that political machine for years. How many people need to get beaten or killed to get any type of repercussions? Major case squad needs to be called in to take over for these jokers.

Well when Chris the bar owner, who didn't want to call because people were smoking in her bar (REALLY!!!)anyway when the cops finally showed up, the drunk guy woke up from being knocked out and he was pissed & confused, so he wasn't thinking right and got aggitated with the cops, so the cops tazed him and beat the crap out of him. Made me sick to my stomach.

Good luck getting "assets" out of Don since they're not making ends meet theirselves when his cancer AND stroke nearly killed him and he hasn't worked since...no med insurance...no rehab...greedy f-er...sorry that happened to him but sue who's responsible, not Don. And I was there @ Bob's that night too...it was broke up fast...Rusty is a bully. Jen and Don has had enough...this is definately going to hurt his recovery...simply sad

What is really sad is that they do have assets,and people know this. I'm talking about vehicles, property and business ownerships. It is wrong, they are not trouble makers and everyone knows this,and now they are going to be sued. They need to have those other 2 locked away and getting somemental help.
