A release from the city of Dunkirk Department of Public Works was issued Thursday reminding all property owners that the clearing, shoveling and maintenance of their sidewalk is the responsibility of the property owner.

When did Dunkirk sell its plows? Streets suck even with a 4 wheel drive. Kids safer on sidewalk than in the washboard streets.

How about they get that sidewalk plow out and running?

Doesnt matter if you keep the sidewalks clear. Some morons choose to walk in the road.

Its funny- i read the article in the disturber this morning, and on my way to work i saw 3 sections of public city owned sidewalk unshoveled. Do as i say not as i do (or dont do)

If everyone who could, would shovel their sidewalks the problem would be very small. Pointing the finger doesn't relieve you of your own responsibility as a responsible human being.

I shovel my walk way and the elderly neighbors along with all our sidewalks--we are cornerlots, so there is quite a bit of walk to shovel. The other neighbors sno-blow theirs...yet the neighboring streets are never shoveled out. It gets very annoying year after year to be ones following the rules when the majority igonor them and there are no consequences. City will not enforce this. Would be hard to...can't ticket some and not others, that's a lawsuit waiting to happen!

It doesn't matter if the city or village plows the sidewalks or not. The laws on the books in all of these places state that the owner/occupier of the property is responsible for making sure sidewalks or clean. Yes, some of the municipalities own plows and utilize them, that doesn't mean that residents are allowed to rely on them to mitigate their responsibility.

And it would not be hard to enforce. Up the fine to $500 each offense and have an officer walk the streets. You would make a fortune the first couple weeks and soon enough I bet every sidewalk in the area would be shoveled. Even a $500 fine will be cheaper for the owner, considering the million dollar lawsuit if someone gets hit and killed walking in the street in the front of your house because your walk isn't shoveled.

The City could have a policy to shovel any sidewalks that are not shoveled and charge the resident, much like they do if you do not mow your lawn.

Also, remember, that if the City does plow the sidewalk on a regular basis, they are considered partially responsible if there is an accident.

This is probably why they don't do much anymore. If they did, insurance would go up which would require higher taxes to pay for it. If there was an accident, the city is liable, which again is paid for with tax funds.

It is easier to have the resident be responsible, especially since they already are according to the law anyway

Hey, forget about the snow...I still have leaves and branches they never picked up. They were put by the street..as requested. Last year we took care of all our leaves and branches. I guess it depends on who you are...friends with the mayor?
