boone county could not catch the crooks robbing mr jones,, so he had to do something to help protect his self from may being kill by the crooks,

If Jones was not in fear of bodily harm or death then he had legal justification in shooting.

Sure he did he was being robbed. You have a right to defend yourself and or your property with deadly force if necessary even to stop a robbery of your possessions.

He's a 92 year old MALE veteran. I'm sure he was scared, but he's not going to admit that. If he hadn't had his firearm, he probably wouldn't have been scared. These punks got what they deserved, and no, I don't feel one bit sorry for them. You go breaking in on people, especially the elderly, and a bullet is what you deserve! I can only imagine what they would have done to Earl if they had walked in on him unarmed. They had broken in on him 2 other times for God's sake! Everyone's boo-hooing and they've even set up a memorial fund for Adam (the robber who got killed.) F*ck him. He shouldn't have been breaking in on people and that wouldn't have happened.

It doesn't matter what you believe old men think, it's what can be proven and what can be proven is the statement by the old who himself said he was not affraid...therefore, it could be concluded that the man was not in fear of bodily injury or death.

I guess the instructor and video at my CCW class were wrong and you are right. Sorry man you are wrong in Ky that's the law. When I have time I'll give you the KRS number I don't know it by heart. But I promise you of someone is robbing me they will meet with the same fate if at all possible.

No, YOU are sadly mistaken! The great state of Kentucky says it's lawful to shoot an intruder. This 92 yr. old hero waited for the intruder to break IN to his home, he shot him dead.....CASE CLOSED!!

KRS 503.080 Protection of Property (Castle Doctrine)

(1) The use of physical force by a defendant upon another person is justifiable when the defendant believes that such force is immediately necessary to prevent:

(a) The commission of criminal trespass, robbery, burglary, or other felony involving the use of force,...

(2) The use of deadly physical force by a defendant upon another person is justifiable under subsection (1) only when the defendant believes that the person against whom such force is used is:

(b) Committing or attempting to commit a burglary, robbery, or other felony involving the use of force, or under those circumstances permitted pursuant to KRS 503.055, of such dwelling; or

(c) Committing or attempting to commit arson of a dwelling or other building in his possession.

(3) A person does not have a duty to retreat if the person is in a place where he or she has a right to be.

Thanks for that posting. Basically the presumption under the law is that the intruder has come to do harm.
