Hey All, I went to school with Brian "Timberland" Haynes (That's what I called him). He will always hold a part of my heart and he is my first love, and I am so hurt right now that I can't even breathe. I just got my cousin Daisy Patt's message regarding the shooting. I hope is will be okay, and I hope there isn't to much damage. Brian is a fighter he is not a quiter and I know he will fight to see parents and his beautiful baby Daisy. No one deserves to be shot over something so simple as grass. The bible says you reap what you so and that's what the shooter will get in the end. God will spare him and give his family support in this time. Gina was a great friend to me, and she love all her kids. I know she is hurting right now, and I don't know what I will do if I lose my first love. This life will be very painful to get through. Please keep us updated, and if there is a website, bank account for the family please post it so I can donate some money for the family. This would be a great idea if there is no support fund establish for Timothy.

We are writing to you in concerns for a beloved and fallen family member. On February sixteenth, Brian Haynes, 24, of Drew, Mississippi and his girlfriend, Beth Ballard, 24, were riding a four-wheeler, enjoying their ride when their world was turned upside down. Richard Adam Thompson, 24, came out of a trailer on Curtis Smith Road near Drew, MS and confronted Haynes, in his truck, for alleged trespassing. The man told Haynes to leave. Haynes knowing he wasn't tresspassing, since he had known the small area since childhood, refused to do so. After words between Haynes and Thompson, he then backed his truck up and hit the four-wheeler she and Haynes were riding. When Haynes approached Thompson about the incident Thompson shot Haynes, at point blank range, in the side of the head with a .38 caliber handgun. Thompson then fled the scene. Haynes was flown from a hospital in Cleveland to the Elvis Presley Trauma Center in Memphis. He is still in critical condition. Thompson has been charged with aggravated assault. Thompson was released on a twenty-five thousand dollar bond.

Governor, we feel as a family of a hundred or better, that this is a great disjustice. We all personally know, as a fact, someone who shot an illegal deer from a motorized vehicle and had to serve eight days in jail. Thompson served less days than that for shooting a human in the head. One man is fighting for his life while the other walks freely. Allowing individuals who take the law into their own hands or allow individuals who will take a human life to walk freely is not acceptable by our standards or many others. What has our justice system become? Any man that takes a fully loaded handgun and points it at another man's head then pulls the trigger knows what the outcome is going to be for the other person. It's just that simple. There is no justification. Even out of self defense, Haynes had no weapon and Thompson could have easily drove off or better yet he could have called from his home and put our hard earned tax dollar to work by letting the sheriff and his deputies do their job. We also feel,Governor, that by Thompson having many tithes and family within our local judicial system that justice will not be in our favor. It would be appauling to know that this man would receive minimal punishment and sent back into the free world to harm someone else.

We, as an entirity, have always supported Mississippi for nearly one hundred years and looked up to our leaders for guidance, support, and what is just. We now ask you Governor, to return the commitment for us. The question here is...What can you do for us? We have included a copy of the front page article of our local newspaper with further details.

Hey Beth, you don't know me but I am one of Brian's friend from Drew High School. I pray that God gives you strength in this difficult time. I'm so mad and sad that I can't even sleep tonight. The last time me and Brian talked we got into a little disagreement, and I pray that I will be able to ask his forgiveness when he gets better. Brian can light up any room. His stories "Brian Stories" are so so funny. He always has a story to tell about something. He is a real person, and I know you love him with all your heart and all your soul. I know he loves you to the same. Take care of yourself and your baby. He will pull through because he never gives up. Every since I've known him at the age of 13 y/o, I've known him as a fighter and a strong person. When you pray, tell God that you love him and you can't live without him. Also, Beth ask God to give him another chance without any limitations. I will be praying and fasting to God for his speedy recovery. Take of yourself and when you see my Gina and the twins give them the best huge you can possibly give them. Even though we never met and maybe never well, I love you and I am praying without ceasing for you and Daisy and that new born.

For two days I've been trying to leave messages on this forum for my family && it wont let me ..so im trying again today, Do u have to be a member or something? It let me post the 1st one but the other 4 wouldnt post...I was trying to tell the family that we are praying for Brian to come back to us, && that from experience I know the exspenses are unreal , I had my dad (Lenoil Woods) in one hospital && my mom (Ann) in another, 100 miles apart...at the same time , with only one of me, to be there for them... so i know it can get overwhelming, I live in Louisiana, but I'm only a phone call away if there is anything i can do...you can reach me at [email protected] && I'll give you my numbers in private...I spoke with my Grandmother (Glendora Woods) && her thoughts && prayers are with you all as well ...Please get in touch with me so i can send a donation to help out the family. Beth you are a hell of a woman for sticking beside Brian now. He needs your love to get through this. Lou, I know you holding it down as well as a mother in your position possibly can. We are praying so hard for him and his baby girl has sent angels to be with her daddy. Adam, I hope you burn for this. You've all but taken away a 3 year olds world. How do we explain to her the an idiot decided to take justice into his own hands all over something so petty? That man fighting for his life is her whole world and you took that away. You will get what you deserve... All in due time. And Beth your baby is an absolute doll. She's beautiful.

I don't know if this helps but here is what i looked up under attempt murder charges.

English Law On attempt murder charges.
In the criminal law, attempted murder is committed when the defendant's act is more than merely preparatory to the commission of the crime of murder and, at the time of these acts, the person has a specific intention to kill. While on the other hand, unattempted murder goes from the waist down due to major organs and arteries above the waist. First, acting deliberately and intentionally or recklessly with extreme disregard for human life, the person attempted to kill someone, and the person did something that was a substantial step toward committing the crime.[Mere preparation is not a substantial step toward committing a crime.]

An example would be where someone fired a weapon without regard for human life, such as a drive by shooting.

I believe Adam falls under this list.

Victim, Legislator Want Attempted-Murder Law

JACKSON, Miss.-- Attempted murder doesn’t exist in Mississippi law. Victims are pleading with lawmakers to change that.

A Jackson businessman, shot in the head during a robbery, said he was shocked to find out his attacker can only charged with aggravated assault.

That businessman, antique store owner Donnie Register, survived his brush with death during an armed robbery in December.



A man fired a gun at his head and the bullet deflected off Donnie's wedding band and lodged in his neck.

He teamed up with his legislator to change state law. The bill they support, House Bill 644, would create the charge of attempted murder and carry a maximum penalty of life in prison without parole.

That’s a big difference from the current law, in which aggravated assault has a maximum sentence of 30 years.

“If you live, it’s attempted murder as far as I’m concerned,” Register said.“When I said that it was attempted murder,(police officers) said ‘We don’t have that charge.’”

Rep. Ed Blackmon of Canton chairs the state’s judiciary committee. He said similar bills have been presented in the past, but failed.

Blackmon, an attorney, said it’s absurd that someone who shoots a person in the head faces the same jail time as someone who hits a victim with a bottle.

“I don’t believe anybody can stand up and offer a good reason about why we shouldn’t address this issue,” Blackmon said.

Blackmon said the bill will pass through his committee and be sent to the full house for a vote.

Both Blackmon and Register are encouraging the public to contact their legislators if they support the proposed law.

It may not have been my place to do something but I contacted a myspace group called Hope and Support. It is a prayer group that also helps with finances in a family's time of need. This is the same group that helped baby Kaleb Schwade who suffered from baby shaken syndrome this past summer. if you have myspace you can check out there page at http://profile.myspace.com/index.cfm...
