As a voter in the upcoming Sandy Suburban Improvement District election, there are some things you need to know about in regards to the current administration and why your action is needed. The election is for 2 seats on the board and there are 5 nominees. Two of the nominees currently sit on the board. As a voter, there are things you need to know about the two nominees up for re-election. First, Mark Hurst and Deborah Bell are brother and sister. In Utah Code 53-2-1 it states (2)(a) No public officer may employ, appoint, or vote for or recommend the appointment of a relative in or to any position or employment, when the salary, wages, pay, or compensation of the appointee will be paid from public funds and the appointee will be directly supervised by a relative, So neither one could vote for the other to be Chairman of the board. Yet Mark Hurst received the vote from his sister for that position. A direct violation of the law. Sandy Suburban Improvement District was Managed for many years by one person, and that woman had 33 years experience with the district. Mr. Hurst and Mrs. Bell made sure she was out of the way. She interfered in what they were trying to do and so they dismissed her. A man with 3 years experience on the board gets rid of a General Manager that has 33 years experience taking care of our district.

Thirdly, The board on a regular basis holds closed meetings and “social meetings” around the board meeting. I present legislation regarding this:
52-4-206. Record of closed meetings. (1) Except as provided under Subsection (6), if a public body closes a meeting under Subsection 52-4-205(1), the public body: (a) shall make a recording of the closed portion of the meeting; and (b) may keep detailed written minutes that disclose the content of the closed portion of the meeting. (2) A recording of a closed meeting shall be complete and unedited from the commencement of the closed meeting through adjournment of the closed meeting. (3) The recording and any minutes of a closed meeting shall include: (a) the date, time, and place of the meeting; (b) the names of members present and absent; and (c) the names of all others present except where the disclosure would infringe on the confidentiality necessary to fulfill the original purpose of closing the meeting. (4) Minutes or recordings of a closed meeting that are required to be retained permanently shall be maintained in or converted to a format that meets long-term records storage requirements. (5) Both a recording and written minutes of closed meetings are protected records under Title 63, Chapter 2, Government Records

Access and Management Act, except that the records may be disclosed under a court order only as provided under Section 52-4-304. (6) If a public body closes a meeting exclusively for the purposes described under Subsection 52-4-205(1)(a) or Subsection 52-4-205(1)(f): (a) the person presiding shall sign a sworn statement affirming that the sole purpose for closing the meeting was to discuss the purposes described under Subsection 52-4-205(1)(a) or Subsection 52-4-205(1)(f); and (b) the provisions of Subsection (1) of this section do not apply.
Not once do we seen sworn statements from the “Chairman” that he held closed meetings and they keep no records of such proceedings.
The board also holds meetings at 8am the second Thursday of the month. The chairman regularly gets away with closing meetings because he scheduled the meetings at a time when most voters are at work. This way no one has access to what he is doing. It is a direct Violation of the following regulation:
52-4-102. Declaration of public policy. (1) The Legislature finds and declares that the state, its agencies and political subdivisions, exist to aid in the conduct of the people's business. (2) It is the intent of the Legislature that the state, its agencies, and its political subdivisions: (a) take their actions openly; and (b) conduct their deliberations openly.
By holding a meeting at 8am when most voters are at work and unable to attend he has essentially cut the voter out. This is not an open meeting and they do not deliberate openly because most can’t attend.
He gets away with all of this because no one can stand up to him and there is no oversight on the part of the state. We as voters must let him know that we won’t tolerate this.
Mr. Hurst has also hired 2 employees recently with out following regulations. The jobs were never posted and no one but his friends were hired. These are not $20,000 jobs either. One was for the Attorney and the other the Accountant. Neither job was posted and there were no interviews conducted. State and Federal regulations provide dictation as to how an employment process should be followed. This was not done in this district.
If you are a concerned voter like we are, you will take the time to go and vote in this special election on November 6, 2007 to send a message that this type of activity is not tolerated even in a small district like this one. Please take a stand and plan to go and vote and vote for anyone but Mark Hurst and Deborah Bell.

Mark Hurst actually on the last election tried to have his brother n law voted in. He wants total control of this municipality. He is running the show there and has no consequences of his unethical business pratices. Mark Hurst has been the reason why your rates went up this past year. The municipality last year shopped for new benefits for their employees and had the opportunity to switch companies, improve the benefits for the employees and save $60,000 a year, but Mark Hurst declined that opportunity as well. Mark Hurst aslo wanted to spend more of your hard earn money by hiring an outside accounting consultant firm that cost Sandy Suburban Improvement District $72,000. They originally had two employees doing this job and one was fired when he began to questions the ethics of Mark Hurst. Now they have an employee that is still there and not allowed to see the books because she questions the ethics. They also rehired an employee that was fired a year ago for misappropiating funds and time. The bottomline here people is that this is a government entity that Attoreny General has even stated that there is something not right here, however the AGs'office says the county is responsilbe for overseeing, the county says it's the City. Anyway it's going to be up to you in November to make sure Debra Bell and MArk Hurst are voted out. So be sure and look at your bill and see if it says Sandy Suburban District. If it does then make sure on November 8th you go to the Sandy Suburban Improvement District at 8855 South and 7th west and vote these small time corrupt officials out of office. By the way you are also invited to collect information from Sandy Suburban to validate everything stated in this forum as it is public knowledge and by law every citizen has access to. The election is actually on November 6th. Another thing to point out is that the 2 women that were managers at SSID are no longer in management and have been replaced by men. The man that they rehired had not worked there for 5 years and was hired to take over a position without any reasoning given to the current person in that position. There was a pilot study started to reuse water and ended because the board got rid of the general manager and now all the money spent on the study is wasted which is well over $100,000.

With all due respect, I have called Sandy Suburban and these allegations are false. Mark Hurst and Jerry Simons are both experienced and well-qualified men. They should both be considered for their good judgment. The information in these postings is Sept. 2007. It is now Oct. 2009. Let us give Mark Hurst a good name restored.

I was thrilled to find out that Mr. Hurst ran for re-election and prevailed.
When I discovered that he was running, I personally investigated the accusations of this posting. There is simply no merit to these allegations.
These comments appear to be nothing more than the vain janglings of a (1) disgruntled employee and (2) a vendor (the employee’s brother) who sought an exclusive contract contrary to the state procurement code.
It is too bad that more than one person’s reputation was damaged as a result of this irresponsible anonymous posting.
