BY the way: I'm sure that Springettsbury police officers don't just give warnings all day for violations of the law. How do they feel about their chief breaking the law? The public has a right to know!
yeah and what about some of his people inside one of the polls campaigning for him on election day? They were told to get out and they refused! 10 feet from the door is the law!!!

Hey isn't it funny that they finally removed the letters to the editor about Dave Eshbach on here since this all happened. I think the latest said "Dave Eshbach a tradition of integrity and excellence"?? Yeah right and all the big republican guys endorsing him. This is what they get for supporting someone in a primary anyways! They all (Platts,Grove,Gillespie,Kuerle ber)ought to be pissed and ashamed. Especially on our dime! What comes around goes around!

Could this be considered election fraud? The federal government has decided that it was UNLAWFUL for him to be a candidate for this position. How can an unlawful and ineligible candidate win something that he is ineligible to even run for? Just wondering.....

He's an honest man? Without equivoaction? Not only did this guy break a federal law but he covered up the actions of Gary Utter. He let Utter murder Mr. Whitaker. The fact that this happened tells you he doesn't know how to run a police force. If have a person that's not listening don't you think there should have been more cops at the station? I could never understand why the law allows cops or DA's run for office. This is a major conflict of intrest. This guy would believe all the lies of the cops.

Unfortunately for all you idiots out there. The courts should be determining whether or not he violated anything at all. Many things are open for interpretation. Besides in my opinion the most corrupt thing out there is the federal gov. where no laws seem to apply to them

I find this story difficult to believe. A police chief is caught breaking the law that he has sworn to uphold. He then tries to play stupid saying he does not understand the law, even though he is married to an attorney. SO he retires and is allowed to be a judge? Is it any wonder that people have no respect for the law? Something smells really bad here. What else has he done? What will be the next article in the paper about this sleezeball? This makes me sick! Has he no shame?

Exactly what law did he break? Please, enlighten me. An "Act" is not a "law". Please, show me case law on the Hatch Act....You will not find any, because there isn't any!!! And get away with what? The fact is, the federal government ALLOWS him to become a judge if he resigns. And no, I'm not from NY. That's what is assigned to me.....Born and raised in York County, PA.

First I'd like to say that Chief Eshbach ran his campaign "for the People" and "being fair and just" but most impotantly he said he is qualified because he "knows the law." He even said he had his "ATTORNEYS" (multiple) look into it. I am a lowly Prison Records Officer and even checked into it just to be sure. I did it myself because I wanted to be sure. I wanted to leave the voters without any doubt that I was an honest and moral man. One poster said it best, "Ignorance of the law is no excuse." Especially for a police chief.Why hasn't he been fired from his positon? The Hatch Act is very clear. Springettsbury Township needs to step up and fire him, HE HAS AND IS violating federal law everyday since he started his election while acting as chief of police. If I would be caught in commission of a crime I am sure I would not have the opportunity to just say I'll stop committing the crime in a few days and it will all disappear. We have laws for a reason, and a police chief is supposed to enforce the law...now will he? If it were me I would be so embarrassed and withdraw from the race immediately and apologise for my "ATTORNEYS' actions and most importantly apologise to the voters who voted for me. I hope the other poster is wrong that said this and the other alleged election violations won't just be left go because of political connedctions. We all know I have nothing to gain from this I came in dead last but at least I didn't violate federal laws. Maybe that's what it takes.

The Hatch Act states very clearly the penalties for violating the act. The fact is as soon as he started his election bid he was violationg the Hatch Act.

Well said Jeff! I met you during this campaign and I respect you! Everything that you said here is true! Dave should hang his head in shame. You may have come in last, but you are and honest man. You would have my vote if you ran again. That is more than I can say for shameful Dave! Dave is not a man of honesty, he is a man of deceit and shame. I have NO respect for a law enforcement officer who breaks the law and then thumbs his nose at the taxpayers who pay him. Our society will NOT tollerate actions like his. I just read your post. You made some good observations. Let me share my observations with you... Not one other candidate for district judge in the entire county name dropped the way eshbach did. Not one other candidate spent as much money as he did. Not one other candidate had a congressman suggesting to voters that they vote for him. Not one other candidate had back to back letters sent to the editor. A judicial candidate is suppose to act in a moral and responsible manner demonstrating integrity and impartiality. The PA code of jusdicial conduct says so. Not only did he break a federal law but he also violated the PA code of judicial conduct for candidates. He needs to stop his lying and just tell the truth. He was given 2 weeks to resign or withdraw. That's the option given to the other chiefs of police in the same situation. People need to read more than just the dispatch and daily record, they only tell half the story.

Not as clear as you think. The Hatch Act applies to running for office in a "partisan election". In some states, judges are elected in non-partisan elections. In PA, candidates for some judge-ships and all school boards are allowed to cross-file. If it is a cross-filed election is it "partisan"? Some will argue it is not, other will argue that it is - there is the confusion. At the end of the day, the federal bureaucracy set up to administer the Hatch Act gets to decide. As a candidate, he should have checked before he decided to run...

When Dave Eshbach wrote a letter to the editor supporting Brad Jacobs for Register of Wills he violated federal law AGAIN! No candidate for judge or MDJ is permitted to show public support for any other political candidate. This is also in the Hatch Act! Would somebody like to report this violation of federal law to the Office of Special Council? Is is time to prosecute this lawbreaker or promote him to judge? The choice is YOURS! This is ALSO a violation according to the Pennsylvania Ethics Commission! Oh, I forgot, I'm sure he had his attornys check this too! Sounds like he should fire his attorneys. They are incompetent as well! Is this what we want for our judge? I can just imagine what his rulings will be like! What a joke!

I would like to add.
There is also another part of the Hatch Act that applies to Chief Eshbach. He is directly responsible for the Federal Funding (grants) that his department receivedand he was responsible to dispursin them.
