Men face drunken-driving charges

can you tell me which one of them should not go to jail? the law needs to get harder on these type people.... drunks.... and get them off our streets. Waterworth 2nd time, he should have gone to jail the first time. but the law waits until they kill someone. and god knows if we let them go they will.

Not proven guilty till found guilty. That is the law in this country.

Drunk-driving case against LHA head Wallace will head to trial
LAWRENCE -- The drunken-driving case against Lowell Housing Authority Executive Director Gary Wallace is headed to trial.
Judge Laurence Pierce will weigh arguments heard Thursday in Lawrence District Court and decide whether to dismiss anything Wallace said to police before being arrested on Sept. 17, 2008. Pierce will also set a trial date for the case.
Wallace, who turns 46 this month, was allegedly intoxicated when he drove into a service station parking lot in Methuen and asked the attendant to fix two flat tires on his Ford Crown Victoria automobile. His lawyer, Michael Bowser Jr. argued that police did not read Wallace his Miranda rights and did not have probable cause to arrest him.
Assistant District Attorney Jannelle Amadon said police weighed all the factors -- a smell of alcohol on Wallace's breath, slurred speech, glassy, bloodshot eyes and inability to keep his balance -- before placing him in custody.
Pierce said he would take Bowser's motion to suppress Wallace's remarks under advisement, at which time he would set a trial date.

But IF and when they are found guilty I would support 20 years in prison. This country should spend billions on more prisons. I would love huge prisons be constructed just to house drunk drivers. Keep them off the roads. If a person is convicted of a third offense there should be mandatory amputation of their limbs so they can never do it again.
