If you haven't noticed lawyers are trade marking almost every phrase and word in the English dictionary. Look at anything printed by corporate American and almost every word is protected by copyright or trade mark law. It is job security for lawyers, as they create the problem for which they are the solution. Any money created by the protection for the corporation likely goes to lawyers in the form of salaries and fees. These laws don't stop other countries like China and India from producing black market items. It is lawyers blowing their own horns.

This is an example of lawyers exploiting the tort system for personal gain. There is nothing good or decent about this. It's robbery writ large.
The intent of trademark law is to prevent infringement from competitors. Last time I checked, Lionsgate Entertainment was not producing or selling baby clothes. The owners of the boutique were not producing or mass-marketing movies. So, they are not competitors. The owners of the boutique should counter-sue for millions in damages from this frivolous lawsuit. Lionsgate has deeper pockets, which need to be drained to prevent ruthless and worthless lawyers from bringing cases like this to court. |

The claim that the phrase could imply that it official movie merchandise is ridiculous. Perhaps it is possible, but not probable. Certainly there are people out there that were reminded of the movie; I was not one of them. I did not see the correlation until I read the article.
I’m interested to know if all dialogue is copyrighted in movies, or at least in “Dirty Dancing”. If that is the case, over time, we entrepreneurs will run out of creative catch phrases that can be used, and we will end up having to purchase them from movie companies in order to start a business. The most preposterous part of this whole thing is that even something similar to an original can be accused of being “close enough” and therefore target for a lawsuit. I think everyone should copyright every aspect of their lives. Eventually a movie will have something that is “close enough”… you get my point. On that note, what is this world coming to? |

It is not the Lawyers they are hired to do a job. Perhaps if more judges would throw out some of these stupid lawsuits and award damages to the person being sued some of this might slow on down! Hey my house is being foreclosed on can I sue the bank for not giving it to me because I am such a nice person and they have used my name for financial gain (The payment I have made)or perhaps blackmail since I have not made the payments they are going to throw me out there for they have threated my well being? What do you all think? |

i think that when it comes to business the owner is going to do what he/she has to do to sell the produce and if that means using a SIMILAR LINE then so be it. Its not like he is using the same one so its not like he is copy righting and if the customers like it then their going to stand behind him 100 percent. i just think that if anything Lionsgate Entertainment should come up with some other saying so there can be some customers that go to them and view what they got and move on. its not like their out of business or anything!!!!!
