Anyone hear anything about the progress, or lack of on the Eden Condos or Ceebraid-Signal?

No I think they re still in Chapter 11 but Erica (Project coordinator) said that hey will deliver the buildings C & D in 2007

Actually, they are not in Chapt XI, and construction, though very slowly and in my opinion minimaly, has begun.
Frankly, I don't believe anything that comes out of Erica's mouth- she has said so much and always with a caveart of subject to chnge, and change it always did. Last I heard, building "A" will close end of August, "B" Nov, "D" April 2007, "C" July 2007, but with a hanful of guys working to build 3 buildings, may as well be Moe, Larry & Curly. |

I have a closing date of Sept. 5 on a unit in building A. Of course, this is the 10th closing date I have been given so I am not very confident in their ability to deliver. I did a walk-through of my unit back in March 2006 and it was finished. Does anyone know Florida law on what MUST be completed before anyone can move in? Does the clubouse have to be finished? The pool? Being from NY, I am not used to this way of conducting business and have been appalled by what Ceebraid has been allowed to get away with. I have written to Congressmen, City Councilors, Palm Beach County Commisioners, the Mayor of Boca Raton, the City Manager, the newspapers, TV stations, etc. and have been given the brush off every time. I have met Erica Clancy and she is telling us what she is told to tell us. I do not think she is actually capable of telling the truth because I think she has forgotten what that is.

I have been in contact with Erica also. Total Crap. I am thinking very seriously abouting retaining a lawyer, as have a few others have done so far. I have been by the building and have only seen 3-4 people cleaning up.

It seems like a bad joke. I agree with Kate. I moved here from Boston expecting to have a home in Jan 2005. I was told the drop dead date is April 2005. P.S ..We are still not in. And yes, I believe they have hired actors to sit on the site and pretend they are working. 3 men and a hammer will not get this project done. It is a shame and I can not believe the city has allowed this to go on this long. Shame on them. I had my original close date in Oct..walk through and all. Bldg A has had its CO since Sept of last year. It is an endless nightmare. Theu hurricanes are not the problem. Mgmt of the project is and they need to be fully accountable. I have a close date for Aug 21st. If this does not happen , I suggest we pull as many of us together to file something and fight. |

I was at the site this past week and there was some movement, about 30 to 50 workers mostly in buildings C&D, the building A looks very finished to me, I cannot understand what is holding them to deliver those units at least it would provide money to continue with the project.
Relative to filing I believe that some people have already started to file, do you believe there will be a class action? I personally would like to wait as long as there is movement in the construction, what do you people think?? |

You mean Erica who doesn't answer her phone or have an ounce of integrity in her body? I guess that is required to work at Ceebraid. Everything this company says and does it dishonest. Meanwhile they've had $43k of my dollars - a good portion on my net wealth - for over 2 years.
I live down the street and have been driving by weekly - sometimes daily - for 2+ years. They've taken hours and hours from my life. |

Hi All,
I too have been through a long and arduous process with Eden. I bought in building A in June of 04 and obliviously they have not delivered. They have given me 9 closing dates with the latest being August 27. I drove by today and there are not 30-50 workers on the site, I counted approximately 10. I and a few others buyers have retained the same attorney and have filed suit for breech of contract. I have also been in contact with the Mayor of Boca. To outline, building “A” did receive a CO last year but the city would not allow occupancy because of the overall condition of the site. Boca East LLC has responded to the suit by claming six months of Force Majeure defense or "Act of God". They claim that the hurricanes have stopped them from delivering the condos in the two year contract period and they deserve another six months. I myself and going to fight. I do not believe a word they say and do not trust them to ever complete the project. In addition, I do not want to live in a war zone and have no ability to sell or live in my property in the manner in which I was promised. |

I live out of state and plan to rent my unit out. I am waiting for a unit in building B but like Jerry do not want to close and have to attempt rent something with no clubhouse, pool, etc. What is the option to delay closing until the common areas are finished? Contractually I am required to close but contractually they were required to deliver a unit within 2 years. They already missed the 2 year delivery deal line so what would the new deadline be with 2 years plus 6 months? I hope the city will require the common areas to be completed prior allowing occupancy of building A and B.

Jim, there is no contractual obligation for Boca East to finish the common areas before closing and the city has no say nor do they care about that particular issue. In answer to your question, yes they are now claming 2 years 6 months to deliver the units because of delays they claim were hurricane related which is totally false. Many projects have been completed on time in lieu of the hurricanes. Our only recourse is a lawsuit (class action) to stop Boca East from continuing to step on the buyers. As I have said I and a few others have retained the same attorney, if interested let me know.

Have one question. If they are saying that they want a six month extension due to the so called Hurricane affect (LOL), then should I be able to get my deposit back if I am at 3 years now.

There is a construction schedule -timeline for all aspects of construction availble as public info at city hall- it outlines thr different construction phases,time alloted and delivery dates.
This is the time line the City said it would use to enforce Ceebraids finishing the project expeditiously....well......the y are way behind the time line - only a couple of months into the projection agreed to- and city halls answer, well we can't do much about it as long as they are up to code and get reinspected every 180 days.....last i looked there was an American flag, not a banana hanging in front of city hall. New completion "anticipated" dates will have buikding B -January C-July D-September Clubhouse-Feb Pool-March ..........what year??? there have been never more than 20 men working at the site, avg 5 for the past 2 weeks. Fighting with Ceebraid is a waste of breath, they just don't care and will do what suits them, The way to get some action would be to give some grief to their lenders- Lincoln Financial and US Bank-they have the most to lose. Do you think they, Ceebraid, are enjoying their weekends poolside or not sleeping and typing in blogs? |

Rich - People I know at 3 years have demanded their money back and did receive it after bickering with Adam Schlesinger. No attorney was needed. Waiter - I agree, Boca City Hall has been remiss in helping its citizens over the corporations. I would write directly to the Mayor at: SAbrams@ci.boca-raton.fl.us You can try the lenders, but I do not know how that would affect anything. Our best bet is a class action suit. If so inclined we can fight them together. |

In my opinion a class action suit is the wrong thing to do if you ever want to take ownership. all it may do is give Schlesinger the excuse to stop building and even file Bankruptcy for Boca East llc.especially if it is after he gets his $ from closing on building "A"...and then get it back under another corp and raide the sales prices . If the City shuts down thwe project, well that's a real mess and it could take years to get anything started again, if the structures are deemed safe after more years of sitting idol and not ordered demolished. Believe me, I have been through Hell and back and to hell again- not yet back- with Eden, but i'll be damned if I don't fight to actually close and move in. I don't know if you are an atty -God knows I am a fan of the law and getting things done through and with it....... and sorry if I offend anyone, but in my opinion and experience, atty's often serve to screw up and complicate the deal and cost lots of $....been there done that...... Getting Ceebraids actions or inactions out there, public, in the press , tv,...and annoying their source of income and cash flow- their lenders, is the only thing that will bother schlesinger. Do you think he really cares about anything but whats good for him? If you hire an atty or get Jesus resurected to represent you, schlesinger will give you his money back- if its good for him- if he wants to, not because of any suits- read your contract- everything- all the cards- are stacked in his favor. How long did the last class action suit you know about take? 3, 4, 7 years? I would say, try to hit him where it hurts most- in the public eye, in the financial community- his lenders, in his pockets. Write letters or emails to the head honco's of the lending co's and ask them- as his partners- to be accountable and publicize that, the lenders don't want the hassles- or bad press, they are the only ones that can really put pressure on Ceebraid |

Thanks for all this info. I bought in April 2004 and was told yesterday via Erica that I will close in A YEAR FROM NOW. She along with Ceebraid Management are such scum. I do not believe that a class action can achieve anything. I will ask and get my money back in mid September if progress is null.
