There are lawyers who uphold the law. And then there are preditor attorneys that circle the unfortunate to get a pick at the carcus.

Lawyers are bottom feeders. Wexler is one and most of them enough law to break it and not get caught. Scum.

In reading the views of most of the writer they feel good the lawyers be dammed.I agree with that part for there greed. But what about the person that was hurt, the person who went in for an operation to remove his right leg and they took off his left.We have to carry auto insurance if we want to drive in Florida and they will take your license away if you don't carry it.Why should we expect less from Doctors or lawyers. It may sound great to you until something happens to you.The courts should make it that lawyers have to take cases that seem to have merit.

Well Haven looks like you're outnumbered about 50:1. There are way too many attorneys in the country. They don't produce much of anything and only cost the average person more in insurance priemiums and mant other aspects of our lives. There is not a company in the U.S. that manufactures step ladders because of lawsuits brought against them because users were injured by falling off. I wish we could go back to the days where we relied on common sense instead of always playing the victim. This country is turning into a bunch of "victims". My point will be proven if Hussien wins the election.

This is insane, lawyers are a bunch of money makers - people sue and the ones who's getting rich are the lawyers.
Doctors need to be more careful with their decision making and really pay attention to their practice. That's all they're getting paid. If you can't do a good job, then don't practice medicine.
Patients need to decide when to sue or not. Some patients do it for the money too.
I heard this latin lady at one of the mall. her kid was climbing all over the shelf. The mother told him these exact words " Don't climb, if you get hurt, we have to sue the store" Duh, your kid is at fault, pay the consequences of being hurt!

It's time the pendulum swung. All the suits have driven up the cost for everyone. The trial lawyers have gotten FILTHY rich in the past. Guess they thought the gravy train would roll forever.

If you have some kind of medical procedure done and you know the risks ahead of time, you're not entitled to 10 billion dollars if something goes wrong. At least make the damage amounts somewhat reasonable instead of picking random 6- or 7-digit bulls.hit numbers. And then you morons wonder why your health insurance costs so much. This has nothing to do with health insurance fcker

Some here have serious issues...hope you can overcome them soon.
If one goes to the hospital for a so-called routine procedure and gets butchered, for lack of a better word, then seeks legitimate, reasonable reimbursment for the pain and suffering experienced at the hands of a doctor who knew that he/she inflicted the pain, should the doctor and/or hospital not be held responsible?
Not the million dollar "windfall" that used to be, but some kind of acknowledgment that this doctor did something wrong and knew it but did not admit to it in order to save face and thereby his/her career. What happened to patient safety and well-being? Did the sue-happy lawyers take that away?
Lawyers these days won't touch a malpractice suit unless you die.
What a shame.

The reality is the profession has refused to police itself it is a classic case of the fox in charge of the chicken coop.

It's been there for 3 years now, 6 months after he told me that. Lied? Then he told me I needed a bypass of the right led, a stent on the left illiac AND a right carotic endartectomy and that we should do them all in the same WEEK! I never had any of those done, am fine with chelation therapy, and because of my decision to run from this guy, I'm "only" the victim of a failed open heart surgery. Thanks a lot That is one lousy hospital..I should have sued them when my Dad died...took them 6 hours to get a doctor to see him at ER. He presented with signs of a heart attack. Stay away from this place!!!

Yes, there are lawsuits that are just money grabbers. Then again there are patients who do need a lot of expensive relief.
Consider the man (in So.Fla.) who had the wrong leg amputated. Is he one legged? No. The other leg still has to come off so now where he could have been one legged he is now no legged. That man has a case.

This is such an old story.... It has been going on down here since the 70's. Malpractice insurance got too expensive, the lawyers were the only one making money.

If lawsuits hurt doctors, then what are doctors so unaffordable? Doctors simply charge every penny they can and take no responsibility. We should be expecting to see a big drop in the cost of medical treatment since doctors have always said the lawsuits increase the costs. I doubt the people will be handed down the savings.
The lawyers this article speak of are the defense firms. Defense firms have done whittled down the ability to attach liability on a doctor, hospital, etc. Now, the defense attorneys have worked themselves out of a livelihood in defending malpractice action. The loss of cases goes both ways.
Defense attorneys have now eliminated the rights of the people to recover for botchy medical procedures, botchy home building, and car accidents.

Yes, that's right, get rid of all the lawyers and thus the patient's right to hold Doctors accountable for their negligence.
For some of you that hold that position, I truly hope you are never in the position where an incompetent, lazy or even drunk (it's happened) Doctor removed the wrong limb from your body, left a sponge in you during a surgery, or managed to botch up an operation on a loved one so badly that they left them crippled or worse.
I know this Board loves the extremes--both right and left--but you know what, there's another option (gasp!). It's called a BALANCE between the need of good Doctors to obtain malpractice insurance and the rights of patients and their good lawyers to hold Doctor's accountable for their mistakes.
B-A-L-A-N-C-E-D malpractice reform. Why is this such a novel concept to the Florida legislature?
