Sewage plant gulping millions

DELAWARE, Ohio — Delaware County has paid nearly $18.5 million toward a sewage-treatment plant that sits vacant and unused in rural Concord Township, and the county has no plans to start operating the plant anytime soon.

The Lower Scioto Water Reclamation Facility, off Dublin Road, was built to handle what would come with new subdivisions and new people in southwestern Delaware County. But when construction slowed, the need for the facility slowed, too.

“Unfortunately, the timing was off — the plans to undertake this project occurred just as development slowed to a near stop,” said Delaware County Manager Tim Hansley.

Now, the community authority created to oversee construction of the plant has missed payments on some of its loans, according to an independent audit released in January.

And after months of legal wrangling that ended with a mediated settlement last month, Delaware County will pay about $2 million more to Kokosing Construction Co., the company that built the plant.

Kokosing said that Delaware County had not finished paying for the plant, which sits on about 40 acres. Delaware County countered that the work wasn’t finished.

The mediated agreement ended that dispute and put the county in control of the treatment plant. The county will be responsible for maintenance and utilities at the facility, and it agreed to push the Concord/Scioto Community Authority — the government body created in 2007 to oversee the plant — to pay Kokosing about $150,000 in outstanding payments.

But without new subdivisions to generate waste — and revenue — for the plant, the authority’s income stream is limited.
When the authority was created, it planned to pay back debts on the plant with money from the “tap-in” fees that new homeowners would pay to connect to the sewer system.

The community authority, not the county, is responsible for paying back the bonds.

The authority has been paying some of its debts with fees it collects from people elsewhere in Delaware County — those who tap into the county’s sewage-treatment system but don’t live in the areas that would be served by the Lower Scioto facility. The county allocated to the authority a number of tap-ins that were intended to be serviced by the Lower Scioto plant but are not required to be used in that area.

The revenue isn’t enough.

The authority makes payments on the bonds twice a year, in May and November. Since 2008, when the authority started paying on the debts, payments have been incomplete or missed entirely.
In May 2012, for example, the authority owed about $2.1 million, including back payments it hadn’t made from 2011. But the authority had collected enough in fees to pay only about $419,000.
The authority has not issued enough bonds to have a credit rating, and the county is not on the hook for the debts, said Caleb Bell, a lawyer who represents the authority.

“The bonds are in default,” Bell said,“and these are the types of bonds where, even though they are in default, they do not go away. They continue to be due and payable.”

When development picks up, the authority will be able to repay its debts, he said.

In the meantime, interest continues to accrue on payments that the authority hasn’t made. And the facility sits vacant and unused.

The Delaware County Republican brain(less) trust sure picked a terrific location to put a non-operational $25,000,000 (+/-) waste water treatment facility that is situated over a known limestone karst formation - a geological phenomenon, that ODNR geologist determined to be a “hazard”.

The Concord/Scioto Community Authority's Lower Scioto Water Reclamation Facility is in an area riddled with caverns and a long awareness in the community of their existence. It is, after all, close (less than 5 miles as the crow flies) to the famous Olentangy Indian Caverns that were - "...Formed millions of years ago by the tremendous force of an underground river cutting through solid limestone rock,..."

ODNR geologist determined to be not only a a “hazard”, it also makes things difficult for potential development:

“…Karst is a geologic hazard that poses specific environmental concerns for land owners and planners, developers, and officials. Such formations can cause water quality and pollution problems by permitting contaminants, such as fertilizers and sewage, to flow directly into the water table and rivers. Karst also poses challenges for building and construction projects and the developers and engineers seeking to build in or above karst-prone areas. Where karst is found, remediation efforts are often necessary to mitigate its effects.

As Ohio’s fastest-growing county, Delaware County has seen its share of development in recent years. The new karst maps will give residents and planners information they can use to account for these hazards when planning new homes, buildings, and infrastructure.…”

The Delaware Republican elected officials decided that Delaware County needed a new waste water treatment facility in Concord Township on the West side of the county. Never mind that there was nothing out there that was making sewage. Or that the area is well known as a source of quarried limestone due to the presence of massive rock formations just inches below the surface.

There was money to be made and pirated away from the public and the Delaware GOP certainly did built that non-functional sewage treatment plant for tens of millions of public money only to flush down the drain of political payoffs.

The local Republican politicians starring in creating this massive boondoggle and ripoff of public funds:

Ohio Auditor Dave Yost (Then Delaware Prosecuting Attorney after he was Delaware County Auditor and had his Ohio Tax lien and was hopefully sober and drug free at the time),

State Senator Kris Jordan (Then a Delaware County Commissioner before he was a drunken, gun-toting spouse abuser),

Convicted Criminal Jim Ward and GOP-Doofus Glenn Evans (Then both Delaware County Commissioners)

Together they created the various quasi-public deadbeat bodies to build the sewer plant known as the “Lower Scioto Water Reclamation Facility”..." Yost, as Delaware County’s prosecuting attorney did the legal work for the commissioners who approved this scam-like boondoggle

Maybe they should install breathalyzers and do field sobriety tests, and drug-screenings for the elected officials before we allow them to do public business then maybe we can avoid them sending their close friends millions of dollars of public money for nothing.

Interesting reading - kind of shows how the Republicans have swindled Delaware County with a stinky deal. The deal was approved by The Ohio Auditor, our own D. Yost, when he was Delaware County’s prosecuting attorney and as Ohio Auditor he sat on the audit of the Concord/Scioto Community Authority and in reading it we can see why. WE ARE GETTING RIPPED OFF.

The Republican crooks not only built this non-functioning turd processor they are diverting public money to their buddies. How? By ‘conveying” to the private developers of the Concord/Scioto Community Authority via “sewer tap” sales.

Not sewer taps for the non-functioning Lower Scioto sewage plant, but sewer taps for the other facilities that Delaware County owns and operates.

Generally, each sewer tap in Delaware County is worth about $5,900 each but the moron Republicans are selling them at $5,400 each in this stinky deal. Each sewer treatment plant sells tap in fees for 300 or so gallons per day up to the daily capacity of the plant. Lots of sewer taps in the multi-million gallon capacities of Delaware County’s sewer plants

Selling Delaware County's sewer capacity via sewer taps for sewage that goes into our existing plants and giving the money for them to Concord Scioto Community Authority is a shitload of financial trouble when the existing plants reach their limited capacity and no shit is being processed in the Lower Scioto plant.

This diverts money, promised to pay debt, fund operations, maintenance and upgrades from other county sewer plants to the Concord/Scioto Community Authority and its non-functioning Lower Scioto Sewer Plant.

Who gets the money – Triangle Investments (Don Kenney and Charles Vince- AKA The Concord/Scioto Community Authority) and Kenney’s wife.

Kenney, the spouse of Donald Kenney, a principal in Triangle Properties, Inc. purchase $1,400,000 of the bonds. Charles A. Vince, a principal in Triangle Properties, Inc. purchase $300,000 of the bonds.

So far the Delaware Republicans have diverted almost $28,438,000.00 away from our fully functioning sewer plants in Delaware County so Triangle Properties Inc.(Don Kenney, Charles Vince and a wife a can get paid for the bonds and pay the costs to run a “community authority” that owns the non-functioning sewer plant.

Oh yeah. Given the problems and hazardous geology – THERE NEVER WILL BE ANY TAPS OR CUSTOMERS FOR THIS REPUBLICAN BOONDOGGLE.

Sooner or later all the other sewer plants will need maintenance and upgrading and the Delaware Republicans will rob us again or tax us for that.

The proposed "bailing" out of the Concord/Scioto Community Authority for $14 million is a blatent misuse of taxpayer money to pay off political buddies, Huntington , Donald Kenny's wife (Triangle), et al.

So what should we expect next from the Delco bumbkins? You can expect Tim Hansley,(ex Dublin City Manager tax hound and fired ex Pickerington City Manager) to advise the Commissioners to raise the sales tax by 0.5%? And then guess what they will spend the money, as if there is no tomorrow ,on building Delaware City's portion of the Sawmill Parkway road to nowhere , paying Townships for EMS service and maybe even more infrastructure for Developers.

What a joke. We got rid of the three digraces Hanks, Thomas and Evans . There is a similiar future for O'brien , Merrel and Stapleton if they raise our sales tax. But the sad thing is the damage will already be done before we have the opportunity to send them packing.
