I would like to go on record that I oppose most of this concept.
First, why should it be a requirement for a sole proprietor to have a DBA or other company registration and how does this protect anyone?
Why does it matter how many years someone has been in business?
Both of these have nothing to do with protecting anyone or whether the individual or business is able to meet their customer’s needs, nor does it mean that they are any more or less reputable. Anyone can go pay ~$10 and get a DBA. Whether they are a new business or have been in business for years has nothing to do with their capabilities. As far as,“fly-by-night” operators, we have already consumer trade laws that cover such things. Consumers should insure they understand who they are dealing with, but in either case, you still have to track them down to prosecute.
Whether a company (or sole proprietor) has liability insurance and worker’s comp is a contractual matter between the “company” and the customer. Worker’s Compensation Insurance is not mandatory in Texas and such ordinances are outside the their scope and exceeds the requirements of Texas State Law. Both of these measures can place an undue hardship on the lower class of sole proprietors who are working to support themselves. We must certainly keep in mind, the rising unemployment factors we are seeing and realize that there are many more that may be trying to just put food on their table and keeping a roof over their own heads. It is NOT the responsibility of the City to make requirements to mandate such matters that would normally be determined between the contractor and the consumer. It would serve to place undue hardships on the contractor and increased expenses upon the consumer, who might otherwise obtain quality work for less money, should they be willing to also accept some of the risks.
ILLEGALS - I would support almost any legislation that would reduce this problem However, there are already federal laws that cover this and they should be ENFORCED! This could be easily accomplished by our own police force, as well as our citizens. If you suspect someone is using Illegal Aliens, contact ICE (immigration) and report them! They will investigate and take care of the matter, including deportation of the illegal aliens and fines/jail for those who employ them.
