Can someone answer this question for me? An american couple flys overseas to vacation in say Germany and the wife ends up going into labor and has the child in Germany. Do the couple become illegal aliens because the child was born there?

You cannot exile a Natural Born American Citizen. Any individual born in the US is considered a Natural Born American Citizen. Therefore, the parent is "anchored to the baby". Negative. Both parents are still US citizens. If both have been a US citizen for at least 5 years after the age of 16, they have the option to register their child as a US citizen. If less than 5 years, I believe they have to apply for naturalization of the child, which might hold them up in Germany. My recommendation - stay in Germany, they have better beer :)

In other words, Mexican people who visit America and have a child, should be returning to Mexico or be escorted back. And I do agree on the beer thing.

I as well of most of us that live in this area are tired of the Mexican Invasion that has been going on for 30+ years.
An American can't take a million bucks into Mexico without paying for an FM this and another FM that.
You can buy a condo there but you better not try to paint it yourself without an FM permit.
But we have this illegal migration going on and our lame Gubt. does little to stop it.
Looks to me like the Aztlan movement is winning bigtime.

Agreed. Baby anchor laws are insane. Only difference here is that America is much more desireable than Mexico.

That is why I included being escourted back to mexico after the child is born. Hospitals should also be fined for not reporting the birth of a child of parents from another country. Maybe when hospitals have to start paying big fines they will start obeying the law and doing the paperwork. Plus the money from the extra large fines to do some good for the U.S.A.

I just like to get others opinion of what an "anchor baby' is. We do not use the term in my agency. The website you used in an anti immigration site so they are twisting some of the terminology. I need to look through my immigration law books and get the proper wording the way the law is written.

The hospitals are required to make these reports, however there is little the border protection agencies can do. The baby has already been born. I understand what your saying, and totally agree, however its unlikely we will see any changes to the anchor baby loophole. Hospitals are required to administer health care in emergency cases regardless of citizenship, insurance or financial issues. Its unfortunate because it comes from our pockets.

You have to remember where these children are being born. The county hospital. You fine them and you are really fining the tax payers. The law says that healthcare cannot be refused.

The whole extended family. The parents of course get their "right" to stay and collect welfare on the first and all the following anchors.
