It should be noted somewhere in this article about the stabbing, and death of Tyshawn Bieirra that the assault that occurred had NO apparent connection to any gang activity. The charge of gang assault DOES NOT imply that individuals who did this were in anyway associated with a gang (Bloods, Crips, etc...) New York State law reads((-§ 120.07 Gang assault in the first degree.
A person is guilty of gang assault in the first degree when, with
intent to cause serious physical injury to another person and when aided
by two or more other persons actually present, he causes serious
physical injury to such person or to a third person.
Gang assault in the first degree is a class B felony.))

To imply that Tyshawn Bierra was in any way associated with a gang is extremely insulting to his memory. To suggest that the individuals responsible for his murder were associated with any gang without proof at this point, is just poor journalism.

This is Tyshawns brother. I have read alot regaurding my brothers death. I must say i am shocked and literally sick at some of the comments being made. This very unfortunate situation was not a result of gang violence. Please do not believe everything that you read or see in the media. My brother was a honest and peaceful person. The violence in this country is out of control, another thing that is out of control is assumptions made because of a persons race or socioeconomic status. My brother did not have a violent history at all, and even if he did (which he didnt) no one deserves to be murdered in a senseless act of violence. You shouldnt have to know the victom to feel compassion. CHECK YOUR SELF, and reserve judgement for the higher power.

I went to St.Gabriel elementary school with Tyshawn and still kept in contact with him and he is a nice guy and would never get himself involved in such nonsense as a gang. He was a great person and loving also. I miss u TY and I love u....

To the Bierra Family I feel your pain. Every thing flashed back to Darryl and it has been hard for me to deal with. I know God is in control but when is all of the violence going to come to an end. I can't believe this article at all! I went to school with Ty and he was a good guy, never had problems with anyone, and everyone liked him! He was the kind of person who is so easy to love and talk to. His mom raised him extremely well, he showed nothing but respect for others and he was a good person. He wasn't affiliated with any gangs or had any involvement with them, and It's really sad to see him go, and in such a horrible way. He didn't deserve that and now I feel like it's my mission to stop these things from happening. Ty will be missed and is and always will be loved. He hung out with a tight group of guys who loved him so much and was like his brothers, and they will definitely keep his memory alive! I just hope this article above will be corrected....

My heart goes out to the Bierra family. Ty was such a good hearted person.. He was always smiling. Nobody cant say anything bad about Ty. He hung out with a close circle The D.I.P fam. and was always there if u needed him. I guess everything happens for a reason and god wanted to u to be with him. I just heard about the death of this student on saturday night, but when I look it up and saw who it was I was very shocked (last person I would have thought) My first year I lived right next door to Tyshawn, never really said much to him or engaged in conversation with him but really seemed like a nice cool kid and very humble. I know there are plenty of people out there talking about gangs invovled with this crime but I'm almost 100% sure this kid was NOT in one. He was in the wrong place at the wrong time,(could have happened to anyone) this crap is happening everywhere in this country and will happen again to someone, It just seems like no body learns anymore about what happens in the past. Just knowing Tyshawn from seeing him on campus and in the dorms has made me really upset and I have been feeling some pain from this. I just wanna send my condolence to his family during this very hard time. Take Care.

I am an attorney. Gang Assault is the charge against the defendants and has nothing to do with the victim. The charge Gang Assault is saying the defendants acted as a gang, not that the victim was in a gang. The charge is to address a situation such as this where these thugs acted in a "gang" against one person.
