Update re the supposed Daytona Gateway Marina project at E.ISB & S. Halifax Ave. in Daytona Beach = a proposed riverfront highrise hotel, marina, restaurants, townhouses, etc. covering 5+ acres of property & 5+ acres of wetlands/river for the marina.
The Blue Water VI, LLC, developers (from Ft Lauderdale) incorporated itself in 2005 for the sole purpose of coming up to Daytona Beach to buy up 15 properties along the river.
Then they swooned the Daytona Beach City Commission & the Planning Board back in 2006-2007 to approve their Planned Commercial Development in the tiny residential/professional zoned neighborhood, which the PCD rezoning destroyed the value of the buildings & skyrocketed the value of the properties & the taxes.
Then Blue Water VI, LLC, quit paying their property taxes on those 15 riverfront properties, letting their tax debts for 2007-2008-2009 (at one point totalling half-a-million dollars) be auctioned off for tax lien certificates (costing the taxpayers up to 18% interest & fees).
Blue Water VI, LLC, then also defaulted on all 15 balloon mortgages to their financier for those 15 properties between 2008-2009, with said financier then moving all those properties into his personal trust with his son as guardian of the trust (father & son also in Ft Lauderdale).
In addition, Blue Water VI, LLC, put the entire "development opportunity" up For Sale for $25.9 million ($10 million MORE than what they paid!) so that yet another out of town carpetbagger developer can come through town & snatch it up & build who knows what. Blue Water VI recently submitted documents to the St Johns River Water Mgmt District (SJRWMD) wherein they state that even a warehouse could be allowed on the property. I'm sure the S. Halifax Ave. neighbors are not expecting a warehouse!
(BTW, the final decision for a permit from SJRWMD will not be made until July or August after the Board of Trustees (BOT) for Internal Improvement gets to hear the submerged land aspect of the case. Speak up, neighbors, to the BOT before July 27th. The BOT is made up of the State Cabinet, ie, Charlie Crist/Gov., Alex (female) Fink, State CFO, & Charlie Bronson, Agriculture Commissioner. They all have their email addys online.)
The Daytona Beach City Commission has sadly proved itself to be a "sucker" when it comes to developers. Vote Yes to Amendment 4!

--BLUE WATER VI paid their whopping delinquent taxes for 07-08-09 on 7/12/10, approx. 34-days after the above info was posted.
--The 15-separate-lots were combined down to 2-parcels on the same date, 7/12/10.
--They managed to pay their 2010 & 2011 taxes on time for the now-2-parcels.
--But their 2012 taxes, approx.$58,500+, are delinquent (due between 11/1/12-4/1/13), & have been "Advertised" for Auction/Tax Lien Certificates as of 4/26/13, & are available for bidding at BidVolusia.com .

Everything involves leaving a paper trail. Brett Dill IS Bluewater LLC. Dill now owns the MG Tower, he controls the property that's off the tax rolls on the corner of Beach & Second. The Second Street Market is connected to Bornia- Bornia is connected to Garrett Garrett is conected to the commision the commision is why your taxes are raised. When Brett Dill was asked about future development on the corner of E- I.S,B. Halifax [ON Wele] Dill said there are no plans for that property. The comment was made on 5-21-13

HERE'S THE PUBLIC RECORD FACTS 1-5,(with 6-10 further below), to the best of my knowledge after researching same, as of 5/24/13:

1. As of 9/27/2011, the new & SOLE (ie, SINGULAR) MGRM ("managing member") of BLUE WATER VI LLC, owners of the E.ISB & S.HALIFAX marina property, is the son & trustee of the original (elderly) financier of the project (SCHUMAN) who held all the mortgages/loans for the properties at E.ISB+S.HALIFAX. The mortgage papers are freely viewable in the public records of the CLERK OF THE CIRCUIT COURT website.

2. That son & his elder dad (SCHUMAN) are not local people, but are in S.Fla, as were the original BLUE WATER VI LLC corporate members PATEL, O'LEARY, & SAAVEDRA (No DILL on the corporation documents, ever!) Read the corporate documents yourself, from inception in June 2005 & continuing, at the FL DEPT OF CORPORATIONS website, freely & publicly available

3. The mortgage papers/loans between SCHUMAN-Son & Elder Dad (the financiers) & BLUE WATER VI LLC (Patel, O'Leary, Saavedra) stated that if BW-VI LLC defaulted & did not pay back the financiers/SCHUMAN for the mortgages/loans by Feb. 2011, that the properties would then basically belong to the financiers (SCHUMAN-Son-as-Trustee for Elder Dad).

4. The corporation BW-VI LLC (for short) of PATEL, O'LEARY, SAAVEDRA, spent 5-years (2006-2011) trying to get the required wetlands/submerged lands permit from SJRWMD (ie, ST JOHN RIVER WATER MGMT DISTRICT) to build the marina. That is a STATE agency, not a local one. You can see/read ALL THE *TONS* OF DOCUMENTS for that intricate, long, drawn-out permitting process freely & publicly available at the SJRWMD website.

5. The SJRWMD permit was finally approved in early 2011 (applied for permit 2006, approved early 2011).

HERE'S THE PUBLIC RECORD FACTS 6-10, as of 5/24/13:

6. Shortly after SJRWMD approved the original permit in early 2011, then in Feb. 2011, the mortgages/loans (which had already had time extension modifications added previously) became due from BW-VI LLC to SCHUMAN-Son-as-Trustee for Elder Dad/financiers. After a grace period for most of that year 2011, on 9/27/2011 the Son/SCHUMAN took the reigns of the corporation, BW-VI LLC, as Trustee for his Elder Dad, & removed PATEL, O'LEARY, SAAVEDRA as "Corporate Members," with Son-as-Trustee now the SOLE, SINGULAR, "MANAGING MEMBER" of not only the corporation, BW-VI LLC, but naturally, the PROPERTIES (E.ISB+S.HALIFAX) in the corporation's name. Nothing fishy about any of that since this was basically spelled out in the original mortgage/loan papers from the Get-Go since Son-as-Trustee & Elder Dad/SCHUMAN had put up the $$ for the corporation to be able to buy the properties in the first place.

7. Prior to that, in Summer 2011, on 7/15/11 (when Patel, O'Leary, Saavedra were still corporate members), BW-VI LLC applied to SJRWMD for an amended permit REMOVING ANY PLANS for the high-rise hotel/condos/shops/restaurants but KEEPING ONLY the MARINA & a "DockMaster's Bldg.", pavement & infrastructure for same. That request was approved by SJRWMD on 8/12/11.

8. Then in Summer 2012, a year later, on 6/6/12, BW-VI LLC (now with SCHUMAN/Son-as-Trustee as Sole Corporate Managing-Member) applied again to SJRWMD for another amended permit, this time LOWERING the number of BOAT-SLIPS for the marina from 156 down to 138 (original PCD plans were for 172, then 169, then 156, & now 138 boat-slips). That's plenty in my book so good!

It's all good & looking better as the years go by: NO TOWERING MONSTROSITY HIGH-RISE BLOCKING THE RIVER & SUN with noisey restaurants & bars, increasing traffic congestion in that tiny neighborhood, etc., & A SMALLER MARINA.

9. Also, BW-VI LLC still has building permit extensions on file with DB P&Z (these extensions came from Fla's Congress, the Senate & House, for ALL BUILDERS ACROSS THE STATE, that's why they are labeled at the P&Z site as "SB" = "Senate Bill"). There's 2 of them for BW-VI LLC extending the "start time" to start building through Oct. & Dec. 2014.

10. Lastly, as for the DBNJ, they don't make reporters like they used to. They don't do their homework. The last DBNJ article re BW-VI LLC E.ISB+S.HALIFAX MARINA was published 5/10/2012 STILL saying there would be a high-rise hotel, etc. later on. Yet that article was written NINE (9) MONTHS AFTER SJRWMD had already approved the newer permit on 8/12/2011 clearly stating the developers BW-VI LLC WERE NOT GOING TO EVER BUILD THE HIGH-RISE HOTEL, but only the marina. So if you want to rant, rant re Eilleen Zaffro (sp?), DBNJ-reporter who didn't do her homework re her 5/10/2012 article.

Was he talking about the marina property or the OTHER unrelated properties bought by THE CITY on E.ISB right in that area?

Either way, I already KNEW the high-rise hotel/condos/shops/restaurants at E.ISB & S. HALIFAX (owned by BLUE WATER VI LLC) were TOAST & had planned to post that very info & more before you rudely interrupted this thread with extraneous unrelated junk!

Why would you trust what Dill says anyway? If he's anything like DBNJ reporters, they don't do their homework to get their facts straight.

I don't watch WELE, never heard of Dill (who is NOT a member of the BLUE WATER VI LLC corporation), & don't have to because all you have to do is READ public records online, specifically all the public entities/sites listed in the original & follow-up posts, including the PERMITTING agencies such as SJRWMD, P&Z, etc.

Dill's news 5/21/13 on WELE was *OLD* news, anyway, even IF he WAS talking re the marina. See the 2-posts above re PUBLIC RECORDS FACTS that I just posted.

Stormwater treatment for the upland development will be provided by four interconnected stormwater vaults and one exfiltration trench. The proposed dredging and marina construction will impact 5.68 acres of the Halifax River. No mitigation is required for these surface water impacts. The project is located within the Halifax River Hydrologic Basin."

A forture in tax dollars has been thrown away on proposed plans and reseach. You discribed what the plan was.. then mentioned how it didn't work.. then moved on to the next plan.. There's nothing concrete about that, it's old news You have no varifcation of ownership in these deleopment companies. Previous history and present status certainly varify who the real crooks are. You need a list of the names
