The Texas attorney general will investigate allegations of misconduct by Liberty County Judge Phil Fitzgerald as well as another leveled at an unnamed district judge, all of which are sparking a firestorm of controversy in this suburban county east of Houston.

The investigation comes as bickering between elected officials has intensified and commissioners-court meetings have been turned into what County Auditor Harold Seay once described as “an inquisition.”

At the peak of the storm, Fitzgerald, who said he is innocent, wrote a letter to District Judge Chap Cain calling for his resignation after he had publicly accused Fitzgerald of possibly tampering with government records.

Now Liberty’s chief prosecutors have jointly called for the attorney general to intervene.

District Attorney Mike Little and County Attorney Wesley Hinch have asked that the state conduct the investigation and, if necessary, handle prosecution.

“We made this decision only after many hours of discussion and soul searching,” wrote Little and Hinch, to assure the public that these issues are addressed in “a fair and objective fashion.”

Complaints that the two attorneys cited in their letter to the attorney general to be investigated include:

• Whether Fitzgerald violated the Texas government code when he failed to “timely disclose” that his brother-in-law was employed by a subcontractor hired by Liberty County to remove debris after Hurricane Ike.

Fitzgerald has acknowledged leasing 16 of his trucks to his brother-in-law for the work. Fitzgerald was given an undisclosed portion of the $3.2 million paid to the subcontractor.

Fitzgerald said he did nothing wrong because he did not vote on the contract and was not being hired by the county.

• Whether Fitzgerald “exceeded his constitutional criminal jurisdiction” or “tampered with a government record” by signing orders to dismiss drunken-driving charges against two prominent citizens, personal injury attorney Glenn Vickery and a relative of the former county attorney, Sarah Cross.

Both cases were dismissed for “insufficient evidence” with a notation that Vickery’s case had “no lab results.” However, Liberty Police Chief Richard Skarpa said Vickery’s tests were in his office and nobody asked for them. The tests showed Vickery, 70, had three prescription drugs in his system that possibly affected his driving, authorities said.

At that time, Fitzgerald was earning a monthly stipend as executor over the trust fund for Vickery’s daughter.

State ethics law does not allow a judge to hold such a position, said Seana Willing, executive director of the State Commission on Judicial Conduct.

County Court at Law Judge Don Taylor has since voided the dismissals, saying they were done without his knowledge or consent.

Taylor has also produced two letters in which Fitzgerald lobbies for changes so that he might have power to dismiss cases in Taylor’s court.

• Whether Fitzgerald used a generator owned by the county to power his private business during the aftermath of Hurricane Ike.

Fitzgerald could not be reached for comment on that allegation.

• Whether an unnamed district judge or his staff submitted statements for travel reimbursements that were inaccurate or had “irregularities.”

Little and Hinch say investigators are free to explore other issues that might arise during their investigation.

The attorney general’s office said it could not comment on how the investigation will proceed nor the amount of time it will take.

You aint seen nothin yet. Wait till you hear about the sale of the ground up Hurricane debri. The County Paid a contractor to haul this debri into a site to be ground up, then paid them to grind the debri into mulch and haul it off. Well the contractor sold this mulch to a paper mill. I wonder how this money was divided up. If they was a scammin, surely they wouldn't let this money get away that easy. (COUNTY BUMPKIN)

Talk about a web, all these County Commissioners was approving to pay the bills for all these scams. It was FEMA money so no one would ever miss this measley 3.5 million dollars. It makes a difference to me, it was still my money I paid in TAXS, whether Federal or County. I,m sure there was plenty of money to go around to everyone involved in this scheme. Thank you Attorney General of Texas for excepting this investigation. Just don't drop the ball on this one.

I wonder if the Attorney General is going to go all out and finally investigate the Liberty County Law enforcement (including the dispatch office)??? I know more than most people do and I really should not. If I do whom else does? How is all of this going to pan out? Will they finally be investigated for abuse of power? How about checkingout more in the court house of people dismissing charges that had no right to do so? Will all of this finally be investigated? I think that it is well past time. drugs being left out in the open, officers getting drunk and stoned then driving, reports unfinished, officers leaving and the reports kinda "forgotten". drinking in the county when was that allowed? Misplaced files, Dispatchers disapearing from their post and off lord knows where, Rumors of officers and dispatchers having sex on duty!? who's minding the store? Officers using their official capacity to dig up information on their wives...Now thats scarry. Since when do our tax dollars go for "Adult Day Care" with cars and computers for toys? Dating while on duty...now theres a good one see how many of liberty countys good old boys are on dating web sites during their shift. Wives I think you had better start looking because I know some of them are yours. Last but not least good one. taking the county car out of the county so that you can go on a date!!

I personally know about these lost files. They are put in the very bottom file cabinet, all the way to the back and laying down flat. This way if someone complains too much then they have an excuse,"OH THE FILE MUST HAVE SLIPPED DOWN ON BOTTOM". I,m now wondering if these police you are talking about might have had a party with some of the smoked sausage the County paid $28,000.00 for. This sausage bill was approved by our Commissioners Court. Well I'm getting hungary now so I think I will go to Moss Hill and get me a SAUSAGE SANWICH at Fitzgeralds store.

I didn't think Liberty County officer's dated I thought they were all out just looking for a pc. of a$$? I hope someone does come in and take a close look at all of the offices in Liberty County. From the top to the bottom. They all need a good spring cleaning.

YES THAT'S RIGHT, $28,000.00 dollars for smoked sausage. I could have had a big party with either one, the sausage or the money. I wonder if I could maybe get some of this sausage on the next Hurricane. You know Hurricane season is just around the corner. (JUNE 2009)

Do you think during the next hurricane they will make the Liberty County Deputies actually work or will they just be the ones who get fed first again and be the ones hording all the MRES? Nice to see several deputies gained weight durring this last hurricane. Not to mention wern't they the ones getting 55 gallon drums of fuel for their personal use?? i saw several go by in their POV's. Have they put a camera up at the Liberty and Cleveland fuel pumps for the S.O. Yet? maybe their fuel consumption will cut down once they do. Them they will start catching some of the real theives in Liberty County!!

Naeveh, The Old County judge owns a store in Moss Hill,Texas. He sells smoked sausage. I don't know if there was ever any sausage bought with this $28,000.00. This may have been some kind of money scam and the $28,000.00 may have been divided up among the scammers. Lots of things could have happened to the $28,00.00 or the $28,000.00 dollars worth of sausage. Maybe some day we will soon find out.

I watched the Channel 13 news last night and found that Wayne "THE WATCH DOG" has been back to Liberty. Seems as though the OLD JUDGE used 16 pieces of his equipment,leased through his brother in laws shell of a company to another company(C&C) that was doing Hurricane cleanup in Liberty County. It was said that C&C recieved 3.2 million dollars for their bill and that 1 million dollars of this money went to the judges bro-in-law. No one knows yet how much the judge got (seems like some of the tickets have been lost or C&C won't send them in) Looks like this C&C was charging 50% more than the low bidder, and the OLD JUDGE and COUNTY COMMISSIONERS approving to pay this bill. These Commisioner hand picked C&C for this job. Does this sound like there may be some smoked sausage on the grill?

I am now hearing rumors about all this same kind of FEMA scam that has now surfaced in Chambers County. Things like $100 per/day for a Port-A-Potty, $750 per/day being paid since the Hurricane, for a refridgerated van. I am also hearing rumors that Fitzgerald was also involved in part of this. WOW, LIBERTY-CHAMBERS COUNTY MAFIA. Smoked sausage is done, come and get it.

It's never a good thing when any government goes unchecked. Isn't that the reason we came to America in the first place; leaving England for some of the same things?????
And our local government, ya it's got problems, but so does our National government!
I think it is a good thing to keep check on what goes on behind close doors, and hidden in closets or desk drawers. Let's just hope it doesn't take years to figure out what happened, because the money is gone now, the suspected misuse has already happened. If it's true something needs to be done. If it's not then peoples personal reputations are at risk. How long will we wait for the truth? And speaking of truth, will we ever REALLY know the TRUTH?

Neil Diamond(singer)who raised 1.7 million dollars for Hurricane releif for Oak Island in Chambers County has now came up missing. It now seems that no one knows where the money is or where it went. Strange that you could misplace 1,7 million dollars. Does this sound like a fish story? If it looks like a fish and smells like a fish, more than likely it is a fish.
