My ex wife is completely insane. She is the most manipulative, greedy person alive. I have several pictures of her nude and performing lude acts in public on other chicks while we were married. Is it legal to post them considering they have been in my possession for so long and she obviously knew they exsisted because she posed for them.
Nope

Possession has nothing to do with it. Unless you have a signed consent and release, you can't legally post any (nude or otherwise) pictures of her for public display.

Well, you can, buy she could sue the s#!t out of you...and most likely win.

I would be very careful there, if I were you. While I am not 100% sure that it is illegal, she possibly could get your in trouble because she has not signed a release form.

Of course, if she's hot, you can send them to me!

I actually had this problem once, someone posted pictures of me, and I tried to take legal action. None was taken because i willing took those pictures and was not under the age of 18. I also knew that he had them, and the law said that it was his property and as long as he wasnt selling them or using them for any commercial gain, or to degrade my name,(like saying i am a prostitute or something), he was doing nothing illegal. But take it from me, it is not worth the embarassment you will cause her. I learned my lesson and will never be an idiot with naked pictures again! Girls dont take them if you dont want the world to see em!

Guys I am going to save you and not email them to you. I do not know why I married her in the first place, low self esteem, no self esteem, but she is very unattractive. She is about 4'9, completely flat chested and has a deformality, and is overweight. She is very very skanky and is an alcoholic. I promise you do not want to see them. I am on the verge of never finding other women attractive after dealing with her. That bad take my word. I am very embarassed to of even married her.

I'd say if she didn't copyright them then you won't get in trouble but don't take my word for it. Google it. Google has answers for everything.

Well I did google it, and 9 out of 10 says its not illegal because the pictures are mine to do with what i please as long as i dont charge people to view them, if i did charge she would be entitled to some of the money. There is a rate-my-ex site, and it is completely legal, no signed consent forms or anything, as long as they are over 18 and the pictures were not stolen. Thanks everyone!

Hey dish!t, I've been a photographer for 15 years, if there's one thing I know, it's laws regarding display of photographs.

Try not to depend on google so much.

Apparently you don't know them well enough to realize that it isn't illegal as long as the person having pictures taken of is fully aware. The laws are; if you consent at the time of taking pictures, then the picture taker has full rights to the photographs. The right does not apply for profiting off of the pictures, that does require additional consent forms.

Go educate yourself and get back with us mmkay? Thanks.

I know someone that had something similar happen to them but not nude pictures.
The police ended up at his home twice telling the person not to post them. I do not know if it is legal or not however. But id advice you not to do it, it is a form of harassment id think.
The only real way for you to know what is legal or not is consult a lawyer before you do such a horrid thing.
Also will it really do your heart and soul any good to be
so bitter and act on such hatred towards another? Let it go. Even if it is not against the law it is the wrong thing to do, act like a grown up, even if it is hard at times.

That is so true, no woman will ever want him if they find out he did such a spiteful thing.
I know id never ever have anything to do with a man capable of such a thing.

The "picture taker" as you so eloquently put it, does own the copyright to the photos, as does anyone that takes any picture, but copyright ownership doesn't automatically grant public display rights.

Why don't you educate us, how is the "picture taker" is going to prove he had his model's consent?

Well since it was so apparent that you couldn't comprehend what you were talking about in the first place, I thought that it might be best to dumb it down for you.

We aren't talking about model's here, nor are we talking about profits. Therefore making your point moot. TCA states that if a person is knowingly posing for a picture to be taken, then they are consenting. Plain and simple. Some states require that you have written consent regardless, however Tennessee is NOT one of them. The difference in making it legal or illegal is determined by the intent. NOT by simply publishing them. In this case, if the woman was posing IN public while taking pictures, then there is NO argument. Are you educated now, or do we need to bring out the crayons for you?
