On Jan. 12, Gutierrez sent two e-mails via the FBI's Web page in Washington, D.C., according to a statement issued by the U.S. Attorney's Office in Colorado.

"I'm going to assassinate the new president of the United States of America. P.S. You have 48 hours to stop it from happening," Gutierrez wrote in the first e-mail."

there was no victim! how can they prosecute when there was no victim. are you going to tell me Obama actually read that email and lost some sleep over it? that case would never stand in new mexico.

It's a federal crime to threaten the President of the United States. Not (necessarily) a state law violation.

Any President, Vice President or former President. There are provisions for other elected officials as well in the U.S. Code.

Are you saying attempted murder isn't a crime?
