I would say that would depend on the outcome of this election. If we get more of what you would term "boot lickers" then no. If not, I think heads will roll. Just my opinion but I'm firm in it.

Apparently she can! And she did so under the pretext of avoiding a lawsuit. I've been told that there is a 2 year statute of limitations on a suit of that sort so if that's the case, the CM did indeed just give money to this woman for no reason whatsoever. Both womens' claims were from 2007 and 2008.

I haven't an inkling what the process would be but I bet Annm knows. She's pretty darned sharp when it comes to that sort of thing. I'm sure she'll chime in eventually.

I would guess the rangers would be the appropriate authority in this case. Also civil suite would be justified.

The initial authority would be have been executive session in which this was discussed and approved by the City council. Vote should have taken place in Public to approve this negotiated settlement. There are no official documents of a settlement formulated by our City Attorney and signed off by Mayor and city Manager as any settlement would have been done.
Initially what was said for the reason of the forgiveness of the debt was "severance package". There severance packages given earlier to employees laid off. I think maybe 6 were laid off. Possibly given 2 weeks with pay. Of course this severance package was much more than 2 weeks pay. Because she said it was severance package, initially, she had been given authority to provide that by the council - Don't know if there agreements other than 2 weeks or so offered to those laid off. However, this employee was not laid off. She was reduced from full time to part time, and the employee decided to resign "I guess they finally got me". There is a whole back story to this that started with a lengthy meeting with me, my witness, CM, Mayor and a former council man who asked if he could sit in on the meeting. A lot came up in those 2 plus hours. I have a degree in Records and was an investigator for the State of Texas and expert witness for two States for the AG office for Fraud. I also was a Medicare auditor. I am disturbed when I find documents that are completed that are not truthful. I do bring those up regularly when I find them. I found some here and told CM so. She knew, and she knew I knew. And now my witnesses know. hmmmmmmmmmmmmmmmm You havent heard anything about those in the media - have you ?

Problem is - the current authorities for the City would back up this give away so I am not sure it is worth the effort at this time to report for one issue, but there are many other issues that are certainly there that need to be reported. I dont agree with the give away - it is not in my opinion and was not at the time a settlement.
IN the end, that position is gone. The city is saving substantial money. The person replacing her is doing as good or in my opinion better job performance. So the question is was it worth $ 6000 to go on.

Texas Rangers I understand must be called in by Law Enforcement. Local Law enforcement typically for this would be the District Attorney.

There were 11 employees layed off. given 2 week severance pay and paid for vacation time. took money to continue insurance to end of month. and paid credit union money they would have collected that month. was given nothing for the sick time built up. Hired 1 person back that same day. city had to save

I've never understood the hired one person back the same day thing. Did the city realize that they had messed up or did they somehow save money firing/rehiring because of vacation/wellness pay or something?

If it is the one I am thinking about. The person was laid off from their eliminated position, but were qualified for another job opening that was available and they got that position at slightly less pay and did not draw their termination benefits.

That makes sense. So, having terminated he or she, did that negate all of their prior benefits accrued at the previous position? Or would they have transferred to the new position?

I do not know the details. I just remember hearing someone was hired back and asked the HR Director. I was told that someone from a terminated position applied for a vacant position and was hired for that position. They are still working for the city, just in a different job.
