It might be helpful for the editor to next time research the difference between COURT probation (the sentence for most DUIs)and Formal Probation with supervision via the Probation Department.
It might also be helpful for the editor to understand that sentences for all law violations pre-determined (set) by law, although there are some variations in terms of confinement times depending on mitigating and aggravating circumstances. This information (penal codes, vehicle codes, health and safety codes, etc.) can be readily accessed by anyone now on the world wide web.
The Probation Department does not supervise individuals on Court Probation. Supervision via a Probation Officer is not part of the sentence for up to four misdemeanor DUIs as specified by vehicle code, unless unusual circumstances exist. This is PER LAW, not the Probation Department or the Court. The law also does not specify that any specific department or entity supervise an individual on Court Probation.
I am not without heartfelt sympathy for the victims in this and similar cases and I am not without frustration as to some laws, but the anger here needs to be directed more at California law, not the Court or Probation systems.
