Man enters plea in abuse case

COOKEVILLE -- A man who was arrested for the aggravated rape an of 3-month-old infant back in 2008 has pleaded guilty to a charge of aggravated child abuse. Richard Holman, 25, of Sparta, will serve 100 percent of a 20-year sentence after entering the plea in Criminal Court Thursday morning. Aggravated child abuse carries a possible punishment of 15 to 25 years in prison and a maximum fine of $50,000. The aggravated rape of a child charge, meanwhile, mandates a 40 to 60 year sentence. "We just felt with the facts and the circumstances of the case, that this was a good settlement," Assistant District Attorney Beth Willis said this morning. "But we're very happy with the results, because he's going to be in prison for 20 years."

Holman has been jailed since December 2008, when he was indicted by a Putnam County grand jury and charged with aggravated child rape. That November, he and his girlfriend at the time, Ella Amish of Cookeville, had called 911 and reported that the infant -- her son, but not his and identified in court records as "Baby John Doe" -- was found not breathing.

Paramedics rushed him to Cookeville Regional Medical Center and then to Vanderbilt Hospital in Nashville. Doctors said the infant had suffered a broken leg, had bruising and lacerations around his private parts and had a serious bacterial infection from paper towels found inside his body. The injuries required surgery, and the infant was hospitalized for several weeks.

Holman denied the accusation during a bond hearing held early last year, saying the injuries may have resulted from an effort to treat a medical condition the baby had -- he told police the infant had "anal fissures and he was treating it with paper towels and peroxide and he must have pushed too hard," Cookeville Police Detective Sgt. Bobby Anderson testified. By accepting the plea, the state has agreed to null the other count in the indictment. Holman will also have to register as a violent sex offender upon his release. Amish was also indicted back in 2008 -- charged with aggravated child neglect or endangerment and aggravated child abuse. Her case is still pending, and Willis said she was still due in court on Monday, April 26.

Go to the Tomkinsville, Kentucky topix and read about the child molester that served 10 years in prison and has since his release raped and murdered a 78 year old woman. People what is wrong with our justice system? Throw the bums out if all they want to do is make deals with the devil cause that is what it amounts to. Dealing with monsters.

Something is wrong with this picture. The man got 20 years and the child got life... I do not know what is worse knowing that this guy was allowed to abuse this child by the mother or knowing that my tax dollars will support him for 20 years...
China had a great idea, something like this would end with him getting shot in the head and a bill for the bullet sent to the family...
I think something needs to give when it comes to sex crimes...

My heart broke reading this. 20 years might has well been a slap on the hand. Cause any person that could do this to a child and then make excuses for it deserves death. Agree with pain China has the right idea. Its not fair that this child will forever live with the effects of what happened to him and by the time this childs adult life will be starting this man will be getting out of jail. Not a fair sentence at all he got off easy

I agree with everyone here. 20 years is just bullsh*t. I had hoped for him to get at least a life sentence due to the nature of this sickening sex crime.

But, the judicial system has to allow even sick f**cks like this to enter a plea agreement. His defense team and him knew he would've got life if it had went to a jury trial.

I think all molesters should be executed in a very painful way. I have 0 tolerance for these demonic monsters. Statistics read that 9 out of 10 released sex offenders re-offend shortly or just after release.

but the liberal whiney babies think he should have the right to do right in his life and correct his mistakes.

Let god forgive him and man punish him. Last I check god didnt put men in prison nor come down and stop the abuse from happening.

Crimes like this should have a stricter punishment...its called death.

and yes our justice system is based more on manuvering than appropiate punishment for crimes committed.

on the upside, hopefully he gets raped enough during his 20 year sentence that he actually feels bad for his actions.

The mother should not be allowed to birth another child,her child removed and placed with actual humans, the man should be castrated.

I can't imagine what facts or circumstances Ms. Willis could be referring to that would lead the D.A.'s office to plea bargain a case like this. I can't imagine a jury in these parts that wouldn't nail this mf'er to the wall. Hey Beth ... did you ever think that when this creep gets out of jail in 20 years he'll be 45 years old? Then what? We let him back into society? I say life without parole. With any luck his fellow inmates will take care of him sometime in the next 20 years. Criminals have certain things they won't tolerate (harming or killing a child) even if the D.A.'s office doesn't.

How about we start holding defenders and judges accountable for these idiots repeating crimes. If a judge allows a deal to be made, the offender repeats crime, prosecute the judge as well...same with the defender(lawyer). That might cut down on some of these ridiculous deals.

Or you could just publicy hang all molesters for first time offense. Try that for awhile, see if that makes these monsters think twice before molesting an innocent child.

I'm just wondering where was the mother at when this was happening. Was she in the room or did she come home after the fact and did she ever try to protect this guy. I remember hearing about this at the time it happened and it's total B.S. the guy is even allowed to breathe I'm just curious about the mother and her role in this.

to the "mom"? Sadly,this guy won't be in any danger whatsoever in prison. My nephew is a prison guard and they have to protect animals such as this. They will be in segregation away from the main population. Personally I think they should have a public hanging but that's just my opinion of coursse.

A man just a few towns away raped and molested over 7 girls. All of which was his OWN family. He served not even 3 years in prison. Them girls got life..... this country is SICK.... why does ppl get away with such little punishment when they rape a child??? This baby that this has happened to from this 25 year old is sick and deserves a lot more.... This country needs help..
