NY's legal limit is for all practical purposes zero.Drink one beer and drive and you can be arrested and convicted of DUI.Simply put pretty much everyone who drinks in Boonville and elsewhere in NY has at one time or another commuted a felony.

The legal BAC is .08 percent. Thats about a beer every 45 minutes. A first time DWI with .08 percent BAC is not likely to treated as be a felony offense. Driving with a BAC more than .18 percent is a felony, but at .18 percent BAC you're wasted, right? And who's stupid enough to drive when they're that drunk anyway?
Lets say you were driving with a .23 percent BAC and, just for the sake of discussion, hit somebody and drove off. That would be a felony. Know anybody dumb enough to try that? And for us CDL holders the fines and points can be compounded. But what CDL holder could be dumb enough to risk that?

It's true a low BAC will not likely be prosecuted as a felony if it's your first DUI.Neither the state or the federal government for that matter wants to put people in jail if they can get away with it.That costs them money.They would much rather hit us with hefty fines instead.
