She is trying to get permission from counsil to start the daycare at the new home she purchased. She has to get special permission for that because she is wanting to start a business in a residential area. Lot of neighbors are pretty upset about it.

I think that she was denied. I believe it was reported in the paper.

Where abouts by the highschool is she trying to have the daycare?

Once denied by the counsil members, can she again go before them to request permission? If so how many times?

That will be awful if she purchased a home and cant have her daycare there.

Yeah, they did deny her. It was the house on 920 Shawnee. Everyone protested against her in the neighborhood. I was watching it on chanell 3 and Amy Bottomley was one to contest the home-based daycare. Correct me if I am wrong but doesn't she run a vending machine business out of her home? They came up with any crazy reason not to allow it. I feel really bad. Yes she can appeal the decision. Through circuit court.

she did not give notice. she still has her current daycare and will continue to run her daycare at its current residence. all is still going well with her and her business. she is a very intelligent business woman and will keep going forward.

You people really need to investigate each daycare before you trust anyone with your children, there is a web site you can go to that lists EVERY violation a daycare has been sited for,and trust me,very few around here have few to no violations, matter of fact you might be suprised what you find.Investigate.

As for watch out said, go on and do your own investigation in www.IN.gov .....I was purchasing a house to run my daycare out of, and I was denied a special exception. I am appealing and hopefully move forward.

I do not live up there but I would never vote for your business to be allowed. You should look for a different home to do this type of business in.
Keep appealing but its a lost cause.

This is Vaughn, it would be the easiest appeal to win because all the protesting was invalid, non- factual, and very discriminatory, the decision was "Arbitrary Capricious" meaning the decision was depending on individual discretion and not fixed law. And only half of the block came to the meeting in protest, just to name a few the neighbors to the right of 920 Shawnie were not against the day care. Jim the store manager of Marsh was looking forward to us moving in the neighbor hood. And as far as the Bottomly's opposing me, that hurt my feelings, I thought I was a friend of Chris Bottomly, we played basketball together; and as far as traffic, how would ten more cars added to the existing 200 cars that already drive up and down the road cause such an increased impact to the neighborhood. And who in their right minds would put in writting that if someone constructs a fence it would create a flood hazzard to the neighbors house, if you were to tell that to any excavating professional he would laugh at you it is physically impossible. the bottom line in Vaughn's opinion is that the board did not personally want the day care in the area. Two of the members live near the requesting loction and automatically denied their approval. As far as the neighborhood, I feel they did not want a bi- racial family to move on thier street. They did not convience me or the audience that there was a real concern for the kids being in danger, because if all evidence of danger were removed then they still would not want a day care in their neighborhood. It's just funny how the "state" would approve it but the area commision would not, makes you wonder if politics will ever work. Thanks for making my wife tougher she needed to see the truth, Vaughn Johnson

Yeah the neighbors had the nerve to send in a written convenant for their neighborhood, stating, "no residence could be used as a business". But, what do you know, there are currently several business being conducted from Shawnie from personal residences. So the covenant was thrown out at the board hearing as invalid and non legal. And we can appeal through circuit or superior court if we choose to. I have several attorneys interested in the case, but i am still wondering what is the real denial for us to conduct a small safe daycare in the basement of a 3200 square foot home on Shawnie?

Vaughn, I really don't think there is any basis at all for the biracial accusation. Please don't start accusing people about race-based issues. This is getting hateful enough without throwing that in the hat as well.
