just $ 131 THOUNSAND dollars? per say, settled out of court, per say.. didn't win per say? i am laughing at the didn't win, a didn't win would mean she walked away with $ zero. i don't care how you or the city would like to spin this, but she did win in my opinion.

i think if this is going to be a lawsuit against a employer? getting fired and feel like you were done wrong? they used the "at will law?" i think you have to first go to the EEOC..THE EQUAL EMPLOYMENT OPPORTUNITY COMMISSION. this doesn't cost you. but i think it will take months for them to do the investigation, but worth it, then i bet after they come back with their findings you will not have to look for an attorney, but they will be looking for you. good luck

To LAWSUIT, Just getting back in town from IL. But to answer your question on who Jones Attny was it is Denise Reid Hoggard, she is with one of the top 5 lawfirms in AR. NESTRUD, CHISENHALL, AND JULIAN P.A. But they specialize in employment law. Can you let me know what type of litigation you will need, you may need a civil attny. Whoever called her the scumbag Mcbloodsucker must have been one that Mrs. Hoggard got some blood from, or could still come back and get blood. She is still monitoring the case and the training the city has to abide by and She will. She is a good civil rights attny too. She has a wonderful history of winning suits and winning means large settlements like in Jones case....for people whos rights were PROVEN to be violated. Settlement means the party in wrong does not have to admit to the wrong or law violations publically, however some of those hush hush law violations are having to be corrected in the city of Poc. now. Let me know if you need more general advise. Guest is right, EEOC must be contacted first within 180 days of the bad act or firing or whatever, violation was. HWP, DID YOU MISS ME?

sounds like to me that somebody is jealous of the fact that a WOMAN finally stood up for her rights and went head on with the courts.

i know she may not be a very nice person, especailly from what ive heard as far as sleeping with other peoples husbands, but one things for sure.. she got hers.

With all due respect for Mrs.Jones Since I Started the initial post on the case.....I have learned many facts based on evidence in the case depositions, witness testimony, firemen testimony, Her own chiefs testimony, former chief and mayor testimony and expert witness testimony including other departments and chiefs.. There was never any such thing sexual related to this case. This was not a sexual harassment case. She was professionl and no testimony came out contrdictory to that. If I were trying the case, trust me, I would have found any bad acts relevant to bad behavior such as affairs. This is first question among many a attny, good attny will ask client, because they know it will come out by opposing side and thier witness's. It did not. I want my client to tell me the whole truth no matter how bad, so we have no surprises and we can have a defense ready. So based on facts, not opinion, evidence, she was clean in that area and this case believe it or not, was a gender discrimination case just as complaint stated. If any sex envolved, normally a woman will add to complaint sexual harassment. Hers was strictly Civil rights violations, violations in overtime pay, violations on promotion, freedom of speech and gender discrimination and wrongful termination of a job. Her thank you letter in paper last week only confirmed to me she is respectable. The mayors statement about her was disrespectable and breached a contract as she was proven to have did no wrong as they asked the same of her to sign they admit to no wrong. She only did what many others should be doing now, many persons rights are being violated , fair pay, hiring and firing practices are illegal. She in my opinion and some people close to her said she is a honest person and just did what was right, afterall she was fired, she never sued for anyting over 6 yrs. Just worked and exceled to better serve her community. How many of you know someone out there that has lost a job, due to economy, or unfair practices, or downsized so the ones with green cards can come in and take over. You may find youself on the same end of stick as Mrs. Jones someday, and its employment discrimination. The Paula Jones was a sex scandle. Trust me, I have seen it, defended the innoncent and the guilty, in sex cases. This was not one of them. Why do some have trouble believing that exercising your rights in a court of law makes you prey to slander. Someone is in court everyday defending themselves against crime, or wrong doing. The sex scandles are on the front page of the enquuirier. Look at whats happening to wal-mart....class action suits all over nation, unfair pay to women,promotion issues, and denying promotions so pay raise is not involved. Hispanics getting the jobs of women and men who are being let go soon as they reach promotion stage and pay raise stage. Google it, Another friend of mine is envolved in a huge class action suit against this walmart now and we have a local lady joining in along with thousands of others.This stuff happens, and these persons are not all haveing affairs. In my practice if one man or woman told me they had affiars...generally each time they dropped the case when I told them every dirty deed about them and the affair would come out publically. AND IT DOES. Are we seeing it everyday on TV. as I stated in beginning, I dont want Mrs. Jones or anyone here to be trashed because I talk about lawful actions they took against wrong doers. But i know they will, but i Will defend anyone I know and hope others will too. Same for Mrs. Linda Collins Smith. She is a great lady. She is running for State Rep, the SEX word is all over her site too. Please show respect for our ladys who have and still serve our community. They work, not on werfare...trying to change lives for others who may experience this hardship someday. You may be a victim someday of wrongdoing.

Hey Mic, If a boss tells you that you are not allowed to voice your opinion and you are to shut up and follow his command; is that not against my civil rights under the freedom of speech? His "command" is wrong and under handed and a lot of people may end up hurt or loosing their jobs?I don't mean get in his face, I mean do it without insubordnation and diginity. I'm to remain positive about his decisions, even when they are wrong. I'm not looking for a lawsuit, just some advice on how to handle this situation.

I am sorry to inform you that YES....the boss can say shut up and follow his command. The AT WILL LAW in AR. says that you can be fired just because your boss dont like you. But If he violates any of the civil rights of sex, origin, race, religion, age, gender, or you have done something legal like complained to DOL, EEOC, OSHA, Or even a attorney, and he or she knows about it and things have changed, you may have retaliation and that is in violation of Fireing at will. The at will law has weakened since 2004 and is favoring employees more and more due to the many many employment lawsuits filed by employees. So not knowing details of your business, If you see any casual connection of the above referenced civil rights to your issue then investigate it further or talk to someone who can advise you of what to do.
