In 2007, our past HOA President reported that our Tiny Tot Lot Play Gym was damaged from vandalism at a Board of Directors meeting. Later, one of our Board members took on the responsibility of reporting the incident to the Montgomery County Police and to our State Farm Insurance Agent.
Board members discussed that they had not received any management reports from our contracted community management provider, which was MTM Management Associates (MTM) and Michael Potter, President of MTM. This was one item added to several that resulted in the Board voting unanimously to terminate with MTM. Our community managment contract with MTM read in part: "The Agent (MTM) shall promptly investigate and make full written reports as to all accidents or claims for damage relating to the management, operation, and maintenance of the Common Areas and Community Facilities, including any damage or destruction to the Common Areas and Community Facilities estimated cost of repair or replacements and shall cooperate and make any and all reports required by any insurance company in connection therewith." So much for having a CONTRACT! We will let any future consumers decide the value of the Community Association Institute (CAI) credentials claimed by Mr. Potter For more HOA resources, checkout the Maryland Homeowners Association at: http://www.marylandhomeownersassociation.info... |

This is great. We need to document the records of incompetent and anti-consumer property managers.
Our HOA has had similar experiences with MTM that has led our budget into a deep well of unforgiving legal bills and that has harmed our resident homes values. Checkout your contract with MTM for vague and misleading language. MTM had claimed in our previous contract with them that they were providing "full service" meaning financial and property management functions. Later, MTM and Mike Potter claimed that they were doing some property mangement functions as "freebies" and had decided that they would no longer handle our Architectural Control applications. An experience HOA attorney advised the HOA membership that the MTM contract should have been reviewed by an HOA attorney before signing as it was totally in favor of MTM at the expense of the HOA membership. |
