"There's no way they'd be prosecuting this if my client wasn't a state police officer at the time." That is exactly right. He had a extraordinary responsibility that night and apparently failed to fulfill it. Some professions are never "off duty" and police are one of them.

Low-va-to is a scumb bag, period!! This guy will fry I hope. They sure did not look loke drinking buddies in court. See, ya shouda made a better decision you numb nut. It is time to pay the price. How can you be such a success and a dumb ass at the same time. This is the problem with law enforcment officers, they think just because they have a gun and a badge they are all that, well low-va-to your it! Hope they string you up by your nuts.

Cops are human also and they share the same hypocracy as others, however the quote from Reagan is a bit too much this morning. Reagan should have been thrown is jail for his Iran Contra crime and for spreading crack cocaine throughout the west coast.

I bet these guys get off with a slap on the wrist. A year in jail at most.
I say disbar Fierro. Make sure Lavato never works as a cop again, nor can own a gun.
Transfering their pensions to the Tenorio family might be in order.
Learning what it`s like to be a homeless street person might be a good lesson learned.
But they`re still well connected, no real punishment will come from this.
Maybe the Tenorio Family will get some satisfaction in civil court.

Fierro is "distraught" and therefore on the medical unit? A hopeful sign of a bit of conscience. But let him squirm anyway.

Ambro, you're right on with the change of careers for both defendants. How about stockboys at Walmart...that might be one version of he**!

Silly comments this morning, Lovato faces the same charges as Fierro. Fierro is in medical because he is suicidal (ploy) to get out of regular population. Lovato should be in jail, but bailed out. I bet he has plenty of enemies in la pinta. His atorney will fight his case on technicalities. Angela better read every single word, and not make assumptions. Fierro has alot of money, where does it come from?

CF has so much to worry about right now, it is understandable he invoked the 5th. His worries are enormous as he must wind down his personal affairs and get ready to do his time. The judge retains all discretion at his sentence so there is the slight possibility that a prison term can be avoided. The lack of remorse or admission of obvious culpability may have been key to his defense but it will work against him in the penalty phase of the proceedings.

As to the other accused, he had many opportunities, and especially as someone who is charged with the protection of society, to influence the events of that fateful evening for the better. His only salvation might be that he was too inebriated to help the situation but that is going out on a limb. Some consideration for his occupation should certainly help and he will need to some soul searching and maybe learn that humility may help out up front.

The prosecution has a difficult standard to prove in this case. I don't see them getting a conviction.

Let's just hope that you never require the assistance of an attorney. They are paid to defend the accused and do so with whatever tactics or resources are at their disposal. That is how the system works and you would probably appreciate that should something happen and find yourself in a defensible position.

You know what? The transgressions both men comitted were enormous and multiple. Number one; being drunk to the point of blackout (their stories, not mine) hopping into the car, and purchasing more alcohol, etc.... I do not know, however, that Lovato shares the same culpability as Fierro. Think about it, Lovato did not drive, claims complete drunkeness, apparently neither was aware they had hit someone.
I disagree that Fierro is going to get off lightly, I think he is gonna get slammed. Whether he does all the sentenced time remains to be seen.

Sam Bregman, Lovato's attorney needs to wake up! Lovato being a cop had the responsibility to prevent Carlos from driving drunk and didn't do it. Technically a cop has the duty to enforce the law 24/7. Lovato is just as guilty.

Excuse me, having friends that have been killed by drunk drivers I think I can honestly say that New Mexico wants justice, let me put it this way if I was in Fierro's shoes, I would probably not have even stood a chance to be out of jail awaiting trial. It is not about passing judgment, I want justice and this is a country of freedom of speech.
