Perhaps I missed something important, but isn't "driving while intoxicated" the same as "operating a motor vehicle with a blood alcohol content of .08 of one percent or higher"....just worded differently???

Driving while intoxicated is applicable if the driver is driving erratically as in unsafe/unsignalled lane changes, crossing middle line, weaving all over the road, making illegal turns, etc. You can be under the influence even if you have had only 1 drink. The Blood alcohol level is not an issue, the manner of driving is the issue.

Driving with blood alcohol level in excess of .08% means just that. You can have a blood alcohol level over the legal limit and be obeying all the traffic laws. The manner of one's driving is not the basis of the charge; just the blood alcohol level is. Of course, from a practical standpoint it is highly unlikely that a driver with a blood alcohol level in excess of .08 will be driving safely and obeying all the traffic laws.

The 2 charges are not the same. You can be convicted on both although usually if you plead to one charge the other will be dropped.

They probably know from experience.. not education!!! lol JUST KIDDING!!! Thanks for the info but I don't drink so I am not personally worried about me but now can pass the info along to friends and family!
