Judge David Barrett Pulls Pistol in Lumpkin County Court Waves It Around!

I was reading the State news in the Atlanta Journal Constitution Online [it's free] today. I was shocked to see an article ENTITLED "Judge Brandishes Gun In Court".It detailed how Enotah Circuit Head Judge David E. Barrett pulled his pistol out from under his robe Wed. while on the Lumpkin Co. court bench and came down off the bench and offered it to a client to "SHOOT HER ATTORNEY". D.A. Jeff Langley had to calm him down and make him put the gun down, as he was waving it about. HE HAS TO GO....NOW!!!

I have read everything about this appalling matter so far. Besides the fact that Judge Barrett has no business making decisions about peoples live's [GOOD OR BAD] he committed A CRIME! Jeff Langley as the District Attorney of this circuit is DUTY BOUND to prosecute ALL PEOPLE EQUALLY, ESPECIALLY WHEN THE CRIME IS COMMITTED IN FRONT OF HIM! MR. LANGLEY DO YOUR DUTY!

Langley asked him to put the gun down. Guess he thinks that's enough. Anyone else would have been arrested.
The DA has to practice law in front of the judge. That's why he's not doing anything.

He didn't come off the bench. He did wave it around. No one seems to know if it was loaded. There's at least a dozen witnesses plus the security video.
Ask the DA.

This was posted on another site. Maybe this person was in the courtroom and witnessed this bizzare behavior.

Barrett waived it around and pointed it toward attorneys and the DA. The DA told others the gun was pointed at some time towards him, guess he just didn't wanna tell the newspaper that.
It doesn't matter where he pointed it, it never should have left it's concealed location! The average person would probably have been shot for pulling a gun out in a court of law. A judge who does so for no life threatening reason should recieve no less judgment than the rest of the citizens.

The woman's lawyer, Andrea Conarro of Dahlonega, on Saturday described the scene, as Barrett swept the pistol across the courtroom, "as one of those slow motion kind of events."

"Later, as it sunk in, I was upset, and I felt like a tragedy had been created," she said,

The courtroom would have to be empty if you are "sweeping" a gun across the room and it isn't pointed an anyone. It doesn't have to be pointed at a specific person to be dangerous or life threatening!

It is so high time for Judge Barrett to get OFF the bench. I've seen him in action as a Defendant and also as a juror. Even though, in my situation, he made the Plaintiff his target, he was still highly unprofessional. Judge Murphy Miller sets the standard for excellent conduct and Judge Barrett is an embarrassment to the Bench. He can not let his thinking side stay in check as he gets emotionally involved in cases which is CONTRARY to the law. Yet, about six months before the community is to vote, he relies on our poor long term memories and turns on the charm... thanking jurors, being so patient. Oh, my God - what a contrast. Then, as soon as he's re-elected, it's business as usual where he complaints about "oh, how hard he works!!!", his long hours (poor guy... public servant?) and loves to take every chance he can to belittle those before him. One day he spent his precious time crucifying an attorney for failure to wear a coat into his court when the attorney was ONLY there to listen to another attorney present a case. He is a psyche case and it is such a blessing that he showed his true colors. Hey funny thing to note, also - the video tape machine was "broken." Go Lumpkin County - business as usual.

Thank God Langley was there to be the hero and calm him down. It might have gotten out of control without his manly presence!

Judge Miller does set the standard. It's odd that Judge Barrett told a client to shoot the attorney that is dating Judge Miller.

I practiced law for 42 years before retiring and moving here. I have been called to jury duty 5 times and selected 3. At one time I taught in a large Law School. I feel I am somewhat qualified to render an opinion on what I have personally witnessed, as a juror and when I have sat in on the more notable trials of interest,he presided over. It is my opinion the David Barrett ia a deeply troubled individual with no business making decisions affecting people's lives.He has neither the temperment nor the personality one need's,to be a good judge. In addition, it is my opinion his knowledge and use of the law is used more to achieve the results he desires on that particular matter than an even handed application of the law.His normal everyday behavior with party/litigants,witnesses,atto rneys and anyone else unlucky enough to come near him,violate several Canons of Judicial Ethics concerning treating all parties with respect etc. His constant head shaking,eye squinting,scowling,loud sighing and other non verbal communications which are done in front of the jury and to obviously make a point to the jury of his displeasure are TOTALLY IMPROPER. In conclusion If he is not the worst judge as far as ethics and the administration of justice goes,I CANNOT RECALL ONE WHO IS! His knowledge of the law, while good in fact adequate, is not nearly as good as he thinks it is.[illustrated that when lawyers are arguing on their feet,he affords himself the luxury of a computer which he constantly checks and uses to respond with] This is a matter for the state's JQC, LET THEM DO THEIR JOB,IF THIS BEHAVIOR AMONG HIS REPORTED OTHER [IF PROVEN TRUE] DOESN'T WARRANT REMOVAL, THEN A STRONG LOOK AT THE JQC SYSTEM WOULD BE WARRANTED.

Has anyone heard the status of this? Amazing how except for one brief comment it has managed to avoid the news. Is he still practicing, is he being investigated, is he making any comments on his behavior, is Langley? Anyone acurately know what's the latest?

This Judge Barrett is not a joke. I was the defendent he never checked my defense. Later he threatened me and the accurysor to put as both in Jail. The accusor started to cry when court was closed. I went to her to accomodate her ( Wrong!!} Judge saw it
and said stay away from her or you go to Jail

My neighbor's nephew works for the State Supreme Court as a Law Clerk and he told her that Judge Barrett when resigning had to sign the statement below as a part of the resignation process for the JQC NOT TO TAKE ACTION AGAINST HIM.[see GA. JQC WEBSITE PUBLIC NOTICES]I checked.
His exact words were, "Barrett couldn't judge a dog show or pie eating contest"
One thing for sure his, lording it over people is over...be nice to people on your way up...because you'll sure as Hell see em' on your way down! He ain't hit bottom yet, I hear tell. Geronimoooooooooooo
"Barrett will not seek ,request or accept Senior Judge status for any court for which he is currently eligible or might become eligible in the future."

Yep he cleaned out his office and left with his pension in tact ( our hard earned money ) Lumpkin County judicial system along with the district attorney's office is a sad sad mess. In my opinion honesty doesn't reside in that system.

Had the pleasure of witnessing him in action earlier this year in Towns County...what a farce of a bond hearing for a dear friend of mine. He was rude and didn't seem to be too interested. Almost as if we were wasting his precious time. He had to make an issue out of the charges and finally when it came to trial, He was extreme in the sentencing as if to make an example of the offender. At the end of the bond hearing, he yelled at my friend's Mom for a remark she made concerning her child. Definitely rude and uncalled for! Was very happy to hear him make his departure from the judicial system in such a dramatic way!!
I say "YEAH!!". Just wish we could have had a chance with a different Judge or a way of appealing the sentence....

The DA langley need to be fired.. he refuses to take cases depending on the out come not the crime committed.. read the Blairesville forum as well hand picking jurors.. and the list is very long. The FBI needs to investigate the entire bunch and prosecute as allowed by law... not allow them to retire with tax payers paying for their sorry asses the rest of their lives PROSECUTE them as they would prosecute the one that elected them
